I would file the dispute as soon as possible as the seller may try to remove all funds from their paypal account in the hopes of not returning your money.

It doesn't matter if he removes funds or not. If Paypal sides with the buyer, they will actually remove money from the seller's account. I don't remember if they can pull money back from a bank account, but I'm pretty sure if he has negative funds, Paypal usually calls a collection agency to get the money.

It's scary for sellers (especially since people have been scamming sellers lately), but it's there to protect buyers. In situations like this, it's an effective method of doing that.

This is from the ebay auction

The item may have some signs of cosmetic wear, but is fully operational and functions as intended. This item may be a floor model or store return that has been used. See the seller’s listing for full details and description of any imperfections.

This seems to suggest that the macbook was a return or floor model. There is no way any store would accept that as a return nor is there any way a store would put this on display.

I think the key deception in the listing is the statement here that "See the seller’s listing for FULL DETAILS and DESCRIPTION OF ANY IMPERFECTIONS." (my emphasis).

Absolute no brainer, slam-dunk that this major damage on the MBP was not disclosed. Nowhere in the seller's listing are these imperfections described with a full description and details. "minor cosmetic damage" doesn't cut it.

well good news i called the seller. He is willing to give me a refund. Im going to his computer shop tomorrow to do the return. will keep you posted

where are you seeing $759?
i was eyeing this one

Oh, I guess they don't have it right in the refurbished store.
Anyways, if I were you, I would rather buy this

http://store.apple.com/us/product/FC516LL/A?mco=MTg0NzA2MTY

over the link you posted because it has graphics that are (i think twice as fast), it has 10hour battery life, better processor, and more hard drive space not to mention that its cheaper.

I was only saying to get the previous generation Macbook because I thought you were trying to stay as low to price as possible.

dude just return it. end of story, you're making it TOO complicated. youll be piss that you didn't do this sooner. i guarantee it :]

so i went to the guys shop/store and he gave me a refund to my paypal account he didnt give me any problems or anything even offered to let me check my paypal tto see if it was all there.

Glad to see you got your money back.

Hope he doesn't sucker some other poor guy into buying the extremely damaged machine!

Very lucky to have him nearby and return this in person. Glad you got it taken care of. If you have a Microcenter nearby, they frequently have the new 13" MBPs on sale at $999. Not much more for a new unit, full warranty, etc.

sorry but you remind me of peter griffin buying volcano insurance

Sir, I have reviewed this contract, and it offers no coverage at all.
It just says "volcano insurance" over and over again and down here in small print it says:
"He's signing it. He's signing it. I can't believe it."
