From the same crowd that endlessly speculates & breaks down every supposed Best Buy inventory screen shot & NOW you are mad someone gave you a legit sneak peek two months early???? Give it a rest people. The engineer is a Apple employee= HE IS APPLE. APPLE LOST THE PHONE. APPLE IGNORED MULTIPLE REQUESTS TO RETURN THE DEVICE. APPLE NEEDS TO SHUT UP & GO BACK TO COUNTING THEIR MONEY.

Still, according to Gizmodo ("One of them was Facebook. And there, on the Facebook screen, was the Apple engineer, Gray Powell.") if you had the guy's name and seen his facebook page, how hard is it to send a private message ?

If you know the name, what he does for a living roughly and who he works for how hard is it REALLY to track him down ?

A spammer sent me an email this morning, just mentioning only the city he lived in. Had no details on where he worked or exactly what he did other than spam by email addresses off websites. Just for the exercise of it, I was able to find in a few minutes, his middle name, his wife's name, his age, her age, his son's name and age, his younger brother's age and name, his home mailing address and his separate P.O. Box address, market value of his home AND his REAL phone number, among other things, without spending a dime.

(and that was with zero help from any social media site like Facebook)

Apparently, though this guy knew enough to go to Gizmodo and get $5000.

We really need to remember the real victims in all this. The poor SOB maintaining this forum and its server!

"WHAT THE F.... 500 COMMENTS...THE STORY WAS ONLY POSTED 5 MINITES AGO!!"

And please explain how this is advertising for Apple.

You're kidding, right?

you haven't seen this story mentioned in every type of news media this last week? you haven't seen the tv news, the countless internet mentions, the newpaper and magazine blurbs?

you haven't heard people talking about this situation?

you can't be THAT sequestered. this has been a top news story for over a week. if that's not advertising for apple... WTF is it?

Pretty sure he's making a bonanza through the advertising, I wouldnt worry about it

I can't believe that the idiot who found the phone didn't realize that his legal fees are probably going to cost him more than $5,000.

Even if he doesn't get in trouble in the end you just know this will end up costing more than that by the end.

Don't worry, he'll get a book deal.

OF COURSE IT'S ADVERTISING FOR APPLE THATS WhAT I WAS SAYING...

this is a perfect case of perfectly waste of court time.

the phone was lost, not stolen.

Stolen does not mean "ripped out of your hands" or "snuck out of your pocket." Theft occurs whenever someone takes something they know that doesn't belong to them, and converts it to their own use.

exactly the iphone was stolen but more subtly

It became stolen when the founder SOLD something that wasn't his with no real attempt to return it to the rightful owner.

while right, i would venture most people if asked, would assume it's lost and not stolen. doesnt mean thats an excuse but the legal definitions are not known to most people

I also bet people if asked would agree that the person who found said lost item sold it without making every reasonable way to return it would agree it is wrong.

Loving some of the legalese in here. No, I don't know any better myself but at least I don't posture as otherwise.

'Now Mrs Simpson don't you worry. I watched an episode of Matlock in a bar last night. The sound wasn't on but I think I got the gist of it...'

Gizmodo should hire this guys lawyer and claim it just a prank!

It would be interesting to see what the maximum punishment is for what Gizmodo did. We know hacking into a private e-mail account and committing identity theft and mail fraud in TN COULD result in 50 years. What would Giz time max out as?:rolleyes::mad:

"David Kernell, the 22-year-old son of a Democratic state lawmaker, is charged with hacking the Yahoo! e-mail account as Palin campaigned in 2008 as the Republican vice presidential candidate.

Kernell faces up to 50 years in federal prison if convicted of identity theft, mail fraud and two other felony charges. His lawyer has said the case is a prank and Kernell had no criminal intent." - other than to embarrass her... probably got that from hearnig from his toting the party line politician father... HuffnPuff

Actually, no. The locals always stop by for halloween trick or treat and stuff. He's actually reasonably approachable, all things considered.

The "locals" all live within a gated community, have background checks run and are frisked by security before approaching Steve's door. ;)

i disagree

i believe most people wouldnt even go that far as what that guy did

heck all you need to do is look at

A non attended ipod/iphone will get taken right away

Or how about this?
http://www.buzzfeed.com/ashleytalong/iphone-glued-to-sidewalk-prank-hpz

Fact is that most would NOT ask for the original owner

Sad to say that an individual who does seek out the rightful owner is a rare thing these days

Please explain to me how someone losing an item, another finding it equates to theft.

The state of California states that picking up a phone that doesn't belong to you is theft.

Plus the guy clearly left the bar with the phone without ever leaving it with the owner of the bar. My theory is that he planned on keeping it and once he found out the phone was a exclusive prototype that he was so lucky to find, he figured to make money off it which is did. $5000

Finders keepers only works for people who find, keep, and hush up.

Oh c'mon fanboys, get back in the REAL WORLD!

With LENO and LETTERMAN all making fun of this whole ordeal and Apple, if Apple and Steve Jobs sue either Gizmodo or fire the employee or go after the poor but now rich idiot who found the phone, guess who will look bad?

DUH! ............... A P P L E !!!!!

Of course no fanboys will get anything I just typed and will cite legal precedents, blah blah blah, like anyone gives a rats ass.

If anything, this is a good thing for Apple!

Best advice for Apple from me is to **** about this and surprise us with something new on the official launch with an added feature or 2.

Oh, if the fanboys didn't notice, this phone is hardly a breakthrough device, nor was anybody surprised by its features.
