This is great news....hope more suits follow even though I'm usually against lawyers. Apple needs to come down a few notches....enough with the "hold the phone differently comments"....can't wait till that comes up in court.

Depressing how stupid people are. You can't complain to the FCC, they're not interested in you reporting poor signal strength where you live. You can't sue either because you weren't harmed.

If you don't like the way the iPhone 4 works for you.. get your invoice or your receipt etc., put everything back in the box and just return it. Apple will be happy to take it back for as long as you're within the return policy.

Fun fact: In the iPod battery class-action lawsuit from 2005, affected users got either a battery replacement or a $50 Apple Store gift card. The plaintiffs lawyers got $2.7 million.

Seriously, for some people returning the iPhone is not an option. Some folks sold previous versions to fund the new IP4. Others are tied to AT&T by family plans, business plans or other binding contracts.

As far as contracts go, you're not under contract with the iPhone. You can use any handset you want. Also, your contract will be nullified if you return the iPhone. So that argument is pretty much full of holes.

No, they don't deserve anything but their money back. Seriously, to say someone deserves a functioning product is just ignorant of our trade laws.

I didnt say anyone was entitled by law for a functioning product. But to say that loyal Apple customers and even new Apple customers dont deserve a functioning product because they are not entitled to it by law IS ignorant.

Who is to say what you deserve? Its really Apple's choice. There will almost always be a small minority that has issues with every consumer product, the iPhone 4 is no different. The only difference is AAPL's stock price.

How about you return the phone if you don't like it? If you want to wait it out and have Apple fix it, then wait it out. Lawsuits are a waste of money and time. This is a prime example of why the USA isn't as great as it once was. :(
 
Oh please, Apple is a person in law. Apple has rights and responsibilities and they are not all fiduciary!

I'm talking about the wave of people going around creating negative publicity to drive down AAPL, just so they can short the stock, then buy it low. It really doesn't take a genius to figure that out.
 

If by interesting you mean non-interesting I agree.

We have way too many lawyers in this country, and most of them are bad at their job.

In this time of economic downturn they will do anything to try and make a buck. They are not doing anything else, so they hope to file nuisance law suits to earn money so they can buy a 2nd edition iPad 3G next year.


By the way the real lawsuits and criminal cases will come when Apple starts suing people for slander and libel regarding their products, and the SEC charges people with stock fixing and manipulation.
 
Too bad at&t customers can't join a Class Action Lawsuit. Also, all the claims are false, and the issue is really with the FCC in regards to available power, both from the phone and the tower.

Just look at AAPL 10 days ago compared today. People are creating this issue and capitalizing.
 
Actually, the advice to just return it, is completely sensible. Probably the most sensible thing you will ever be told in response to your complaint.

Can you wait? It might take a month or only 2 more weeks but I'm sure it will come. We have steadily become a "I've got to have it now society", which is a VERY bad thing.

Did you ever think that Apple is remaining hush so they can hire a team, address the problem, provide a fix, and the issue a statement? Damn, just be patient.
 
Why should I have to pay a restocking fee to return the phone or pay $29 for a bumper to "fix" it? I don't care how minimal the cost is - I've already bought the damn phone. It should be in working order when I purchase it. All Apple has to do is come out officially and say that there is a problem, and they're going to take care of it. That's it.

I will never understand those of you who blindly follow these big corporations and baby them. They put out a product that doesn't work like it should. It's their responsibility to take care of it. It's not whining. It's wanting some kind of accountability.

ETA: And what's with all of this "Be patient" bull****? This isn't my first phone, and this isn't the first phone that I've bought on launch. You know what? I've never had these kind of issues before. They need to at least make some kind of announcement about it instead of saying it's not an issue and leaving their customers in the dark.

The only thing that I am mad at apple is because of jobs smart ass remark on holding the phone the other way. But apple is ape and they will fix it!
