Why should I have to pay a restocking fee to return the phone or pay $29 for a bumper to "fix" it? I don't care how minimal the cost is - I've already bought the damn phone. It should be in working order when I purchase it. All Apple has to do is come out officially and say that there is a problem, and they're going to take care of it. That's it.

I will never understand those of you who blindly follow these big corporations and baby them. They put out a product that doesn't work like it should. It's their responsibility to take care of it. It's not whining. It's wanting some kind of accountability.

ETA: And what's with all of this "Be patient" bull****? This isn't my first phone, and this isn't the first phone that I've bought on launch. You know what? I've never had these kind of issues before. They need to at least make some kind of announcement about it instead of saying it's not an issue and leaving their customers in the dark.

Exactly correct....Apple needs to man up and make a statement....NOW....not tomorrow...not next week...NOW. Can be a blanket statement but they need to say something ASAP

If I buy a product that I feel is defective, do I:

a) Return it and get a refund

or

b) File a lawsuit.

Now, what would a sane rational person without too much time on his hands do?

Oh and save the lame "Return your phone" comments homers....how about Apple fix and address the problems first.

No just return your phone. At this point there is no known problem that is going to be fixed.

If that does not work for you then return it. They can't fix a problem that does not exist. So if you are sitting there waiting for it, well return your phone. Otherwise you have NOBODY to blame but yourself.

Are you planning on paying everyone's restocking fees?

No problem huh well I'm sure some lawsuits will say differently....let's see where this goes then homer. I bet Apple is going to have to fix this "no problem" one way or another...care to place a friendly wager???

Ever heard of BETA TESTING-----------Well all you early adoptors are BETA group one for iphone 4. Apple knows it and they rely on it. My buddy works for the company and widely known interenally this is the practice.

I bought mine at Best Buy. YES THERE IS, GENIUS.

Then your state sucks. California Law guarantees a full refund for all mobile phones. The reason for this law? To make sure people are satisfied with reception before being tied to a phone and carrier.

The bolded -

Now there's something I can agree with.

I'll bet you something. I bet you any amount you want that Apple doesn't payout one cent but they fix the problem. Want to bet?

Your probably thinking, "Yeah, see then something got done!". Your forgetting all the money and man hours spent on a stupid lawsuit or lawsuits. God America is doomed and people like you are the cause.

Huh? Did you know that you are a consumer with choices? Did you know that you don't have to buy an iPhone?

People blindly buy the new iPhone without ANY research and then complain about it.

Apple has a 30 day return policy. If you've had issues with your phone and don't like it, GET YOUR MONEY BACK!

This country is ****. You are not entitled to anything!

You dumb?
It's called false advertising. A phone that doesn't work as a phone. You are entitled to your money back and compensation for my time wasted.
Piss off fanboy

There is absolutely no compensation owed for your time wasted. They're legally obligated to refund you in full. Thats it.

This is my first post here on this site so go easy on me.

Any way entitled to your money back yes, but compensation for my time wasted?
NO.

I just want my money back without having to pay a restock fee.

This is a prime example of why the USA isn't as great as it once was.

America is doomed and people like you are the cause.

Jeezus lol, would you **** already.

I'm pretty sure its people LIKE you that are dooming it.

You say if you dont like it return it

I say if you dont like livin in it, move to some 3rd world country and pawn your spiffy phone for a shack and some ant infested rice....

i dont want any sort of monetary compensation. Unless its has 2 commas in there, of course. ;)

Seriously, I think everyone just wants the IP4 to work as demonstrated in the keynote, commercials and as i'm sure Apple intended.

How can everyone say just return it and get your money back?
I dont want my money back! I want my potentially bad ass iPhone 4 to work as intended!
I was able to get my death grip issue solved by repositioning my sim card as explained by Jav in a different thread.
But I still get a blue haze on my pictures when taken in low light (no the film does not cover the flash). My wives IP4 takes great pictures at night but the death grip issue cripples her phone.

I just want a fix. I'll settle for a replacement IP4 if it doesnt have; Antenna issue, green/blue blob when taking pictures, yellow spots, loose home buttons, proximity sensor issues..and any other of the known issues.

Actually if you are returning the phone because it is not working properly there should be no restocking fees. The restocking fees are for returns due to a customer's change of mind. A defective phone or one that does not function properly is a different matter.

Have you tried returning yours? Don't explain the problems to us if you haven't. And don't be surprised if they TRY to hit you with a restocking fee, but you can get out of this and if they won't let you get out of it you can just reverse the charges on your charge card as this meets their definition of cause for doing that.

If you haven't tried returning yours and want to keep it then stop your complaining. I happen to love my iphone 4 and despite the minor phone glitches the phone reception is better than the phone it is replacing so far.

My prediction is that this turns into a class-action suit and Apple ends up settling or recalling the devices. Maybe even provide the bumpers free of charge, as well.

My prediction is that despite the fact that the lawsuit is a complete sham and nothing but a shakedown, that Apple decides it isn't worth the cost of defense and pays the lawyer a million dollars, more or less, and the settlement for the class is something like a $5 coupon at the Apple store. This is the usual case with class action suits like this - they're just a legal form of extortion by the lawyers.

Your probably thinking, "Yeah, see then something got done!". Your forgetting all the money and man hours spent on a stupid lawsuit or lawsuits. God America is doomed and people like you are the cause.

And people like you are the reason that big corporations get away with as much as they do. If an individual were to sell someone something that wasn't as advertised, do you know what would happen? Either they would settle the issue amongst themselves, or the person who got screwed over would sue. Apple's made no attempt to settle anything at all. I don't get the game of kiss ass everyone wants to play with Apple. They put out a faulty product, and they need to be held accountable.

Have you tried returning yours? \

Should, should, should. I've been hearing a lot of that lately. My phone SHOULD work as advertised. The phone SHOULD have great reception. I SHOULD be able to return it without a restocking fee.

Yes. I wasn't originally going to return it but after no announcement at all from Apple, I brought mine into Best Buy. They said it was a 15% restocking free - no matter what the reason.

Its quite possible YOU blindly pre-ordered but most people were informed by either research, keynotes and past versions of the iPhone.

I'll use my 20 cent check to buy some blind folds. They seem to make your iPhone work just fine.
Seriously, for some people returning the iPhone is not an option. Some folks sold previous versions to fund the new IP4. Others are tied to AT&T by family plans, business plans or other binding contracts. Customers deserve a functioning product, free of defects and have every right to demand it. If their demands are not met, then they can proceed however they wish. Return the product, complain, post on MR, or file a class action suit.

This is lame rationalization. Everyone still has a choice. There are MANY phones out there that are less than $200. They just don't have the iPhone feature set. A lawsuit says that I am entitled to owning your product, completely devoid of a single issue. No company can guarantee that without a Monet back warranty/return policy, which apple has.

This is pathetic.

Fanboys like to lean on "choice" or "free market" as their crutch for fear they have to admit a chink in the armor.

What makes this situation so hard is that there is no phone a previous iphone 4 owner would tolerate (much less have to commit to for 2 years). Apple has us all by the balls. We don't really want to return it, we just want it to work. I don't think its absurd to ask Apple to do the right thing here. Nintendo did it.

Why do you think Apple PR jumped out and denied those steve emails? Have we heard from Apple PR much on Steve's emails in the past? It's because those emails are being cited in the lawsuits. They are paying attention and they know they are on thin ice which is why they don't really say anything for fear of legal action. Same reason BP's PR has been so horrid. Its not about saving face, its about not getting sued.

A lawsuit says that I am entitled to owning your product, completely devoid of a single issue.

Is that really what these lawsuits say? Thats not what it states on the class action...

Why is it that every person that has any issue with the lawsuit generalizes about class action suits, lawsuits etc..?

stick to the facts at hand. Apple is getting sued, the IP4 has issues.
Rational enough for you?
