Would it be considered piracy when I already paid for my copy of Leopard, but since in the uk we won`t get it (from apple store) until monday or tuesday, I am gonna download it and install it? I am an owner of a license therefore it should!t matter in which way I obtain the software, right?

I wonder the same thing. I mean, I do have my copy coming in the mail... and once I have that, they can't say I pirated it because I'd have the real copy to prove that I bought it. I also would have the receipt and everything.
 
Actually, based on what I've just read from a couple of people that have it, it really is the final legit version. And these aren't kids, they've been around the scene for some time. Newsgroups are something...

If you downloaded a copy of the final release of Leopard from a pirate site you have become complicit with the pirated software by the mere download of pirated software.

Downloading pirated software is illegal.Period.

Lets also not forget that since you are downloading it using bittorrent you are sharing it with others. So, its no longer _just downloading it_, its much worse.

Ah, I understand. It's not like I can't wait 3 days... I'm not THAT crazy about Leopard. But, if you think about it, there is only 1 version of Leopard GM so, really, nobody would really be able to prove that I didn't install it off of the retail DVD unless they actually saw that I downloaded it and burned it to a DVD.

Actually, if you really think about it, your ISP can prove that you downloaded it.
 
What about those people who pre-ordered the iPod touch and then when they found out they were available at the stores ahead a time, they drove to Best Buy and bought one and just returned the one they get in the mail? How is THAT fair for Apple? So, they sell 2 iPods and then have one returned. So they sell me a copy of Mac OS X Leopard, and I download it for free until I get the real one in my hands. As for saying that it's sharing through the BitTorrent, EVERYONE is sharing it... not just one person, so that means those people were going to break the law too whether or not I was there. I dunno. I'm still going to wait anyways... it's only a few more days.
 
Actually, as long as you have a license to use the software, it doesn't matter where the hell it comes from. If I have a copy of Windows XP and lose the media, it doesn't matter if I download it via BitTorrent or purchase replacement media. I have a license to use it, and can do so. This case is slightly different as no one has the actual license to use Leopard yet, but in a few days, the situation will be exactly the same.

you have a very good point here, and i agree with what you are saying.

i know that distributing Leopard is illegal. but to me, they should go after the ones who put it on the sites to begin with, not the ones who are downloading. if you stop the ones putting it on the site, there will be nothing to download. case closed

Not the same, by a long shot. Torrenting copyrighted material is still illegal, even if you have bought the software previously. You have to remember that you are also seeding out to other peers.

Well yes, of course it is piracy.

You have not yet agreed to the license upon installation -- and you could easily cancel your order or sell the Leopard package on without opening.
 
I actually started to d'load it be stopped at about 1gb. I was just going to install it on an external to mess with it until friday. Yes, I do have a pre-order, would be happy to post my order confirmation if you dont believe me. But after thinking about it I didnt see any purpose to download this whole thing only to demo it for 4 days prior to getting and then installing the real thing.

Yeah, and those people who are downloading it without buying it are the one's stealing and just because BitTorrent uploads while you download the other people are still downloading it and who's to say that THEY don't have licenses at their house? ... so in that case... are you really doing anything illegal. Isn't this the reason why there's a disclaimer on the site and or software saying "Do not download anything you do not own or hold the license to." and I think that's why those Torrent sites don't get shut down.

Off topic by a little bit: If you own a cassette tape and you want the files on your iPod... do you HAVE to buy the music again or can you download the digital files since you actually own the rights to the music you obtained on the cassette tape?

I guess it will be on the newsgroups also then. In that case it can be downloaded without sharing - still illegal of course but you're not perpetuating it and I suppose the number of people that are prepared to pay for the subscription is limited.

I'm going to buy my copy on Friday evening but I'm going on vacation next week, doh, does that suck or what!!!

Pricing is good and I'm proud to pay 129EUR for quality like OSX and support Apple.
 
I pre-ordered but I'm having this craziness where I want it NOW! (just like everyone else)

So I was downloading it and I read in the comments that the .DMG file is pw protected and the text file w/ the password is WRONG...

So even if it is real, you can't open it...

Someone tell me I'm wrong about this particular torrent please...

Anyway, can't wait for Fri (or possibly Thurs) for FedEx to come!
 
First, I'd like to say, I have placed my order for the family pack. It wont be shipped till Friday, that means I will get it on Monday or Tuesday...
I dont want to wait so long, so I am now downloading the final version from newsgroups. I wont tell u how, so please dont pm me.
I dont feel like I am being illegal here, I have paid 199€ for the family licence. I am just getting the DVD a bit earlier :)
 
Well personally speaking, I wouldn't take the risk of installing my machine with compromised software. It would be very easy for a hacker to plant a whole bunch of trojans and keyloggers in your pirate release and unless Apple publish the SHA1SUM or MD5SUM for the final release CD you have no way of checking that it is genuine and unaltered.

Come on guys, it's only a few more days to wait for the genuine software. Just think what an anti-climax it will be when your boxed Leopard arrives and you don't even need to open it.... I suppose you have already opened your christmas presents too eh?

I just don't understand why Apple doesnt deliver on October the 26th in Europe. If they did, then it wouldn't be a problem.

As for those of you that say it is illegal, well if it was Microsoft Software it wouldnt be as long as you hold the license for it. Media costs 20 Euros for Microsoft Products, the license more...
Of course Microsoft bundles the OS to hardware, so there is only an upgrade license for the OS but for all other products what I am saying is valid. I know, I worked for Microsoft
I assume that Apple has the same rules. As long as I dont share anything, I am not doing anything wrong.

I was just thinking something similar. Moral arguments aside, it seems a plain STUPID thing to do, to pirate and install your (OK, 'your', as in the one you use!) OS, especially when it seems to me it would be one of the easiest ways to gain access to a user's system.

For what? Having it a few waking hours earlier? So even if you are one of those people who think piracy is fine and everyone should just rip off any old corporation because they have lots of money anyway, maybe stop to think that you could be turning your machine into a big old zombie.

Just pretend Apple is releasing it next Friday (as opposed to this Friday), then we're all getting it early. :)
