Not in civil cases (which contracts are a part of). In civil cases, it's only the preponderance of the evidence. ;)

Not exactly. The Plaintiff still has to bring about a legitimate cause of action and supply some sort of evidence or testimony.

Not that I agree with the original post.

Somewhere in between.

Sorry, what?

Are you saying that downloading it off of a torrent, but not installing it is ok? If so, that's some terrible logic.

Too bad we cannot get a $50 gift certificate for turning in people admitting to pirating software.

I know we can get money for turning in people doing it at a business, sucks we cannot get money for individuals. :p

Off topic by a little bit: If you own a cassette tape and you want the files on your iPod... do you HAVE to buy the music again or can you download the digital files since you actually own the rights to the music you obtained on the cassette tape?

No you would have to buy the digital copy. With your logic, I could take my cassettes to a store and ask for the CDs since I have the rights to the music. You are not buying the music, you are buying the license to the media format. You buy the music license for the vinyl records, the cassette, the CD. Technology allowed you to extract the media to a different format, so if you wanted the music on the cassette as digital, you would "rip" it the same manner as a CD.

I was just pointing out that "innocent until proven guilty" doesn't apply to contracts.;)

Although a preponderance of the evidence usually requires that the plaintiff bring forth a decent amount of evidence, and in this case, I'd say Apple wouldn't have much trouble. Simply by the virtue of having Leopard a few days before its launch, these users have admitted implicitly that they broke the law at some point or another.

True. It wouldn't be very smart to take pictures of yourself on a pre-released copy of Leopards ichat and post it online........

Wait.....someone did.

At least he didn't do it on a very public forum trafficked by a lot of Apple employees.

Wait ... he did. ;P

That was hilarious!! I'm happy for the guy that he got to use Leopard early, all moral questions aside, but not a good idea to start posting pictures...

We'll see what happens, we're going to get it Friday anyways.

it's probably a fake like the last one.
It's legit. The uploader to one of the main forums/trackers has some what of a history of reliability. No doubt, this is the real deal.
how did it leak out?
The cat is already out of the bag in shipping channels, be it to stores or home users, not that difficult for someone to snag one just a few days prior to official release. Over all Apple did a good job keeping the lid on this one. What's happening at is time is pretty much inevitable.

It's absolutely legit, however, it may screw up your .Mac if you don't realize which way the data should sync, and thus your iPhone contacts and all that jazz...glad it didn't happen to *me* however
