It could be sold as new but broken in production with someone attempting to repair it before release.

I don’t think so, it’s a fabrication problem probably in the anodising process or whatever, I really doubt people install these keyboards in mass production
 
OP, it occurs to me that since you are not the initial purchaser of the MBP in the first place -- you've mentioned that your mother was -- and since a look at your profile suggests that at this point in time you are also still what in the US is called "a minor child," meaning not of legal age (in the US, don't know about Switzerland) that this is one reason that people at the store don't seem to be respecting your thoughts, concerns and requests. Isn't it likely that some of those people might be more willing to pay attention and listen to your concerns if it were your mother, with receipt in hand, stating the issues and requesting a replacement machine?

My parents are currently in another countries working, but the receipt is under my name in the store. I told to the Apple supervisor about how the store didn’t take me seriously and now I’m just waiting for an answer. I have a brand new MacBook Pro with a cosmetic issue in a box without the option to use it because it could be a bad idea for any future exchange or refund.

I expect to have a positive answer tomorrow.

Thanks for the explanation -- you must be in boarding school, then -- anyway, as long as you are the one who has the receipt and it is in your name, that is the key factor here, which is why I had brought this up in the first place. Let us know how the response from Apple comes out after you've had further contact with the person from there.... Good luck to you!

I got this answer from the store:


In response to your request because it is a cosmetic damage which is presented caused by bad handling, it does not apply for change due to warranty.


The quality processes carried out by our Apple supplier involve an accurate and detailed review of the products before sale.


The warranty applies if the product has any technical failure and additionally the equipment was used outside our facilities.


Though we are unable to help you with this particular issue, we are available to respond to any further queries you may have regarding your Apple products



Seriously they really believe I scratched my own MacBook Pro for fun.

Well last update:

The Apple supervisor called me and she told me the cosmetic issue is not superficial but a defect of the process of anodising the case, they came to that conclusion after using a special equipment to take pictures from the store that they have in their laboratory, apparently the cosmetic issue is not even a deep scratch and there’s any evidence about an object trying to remove the key but instead a problem of fabrication that doesn’t interfere with the normal functionality of the keyboard, she also told me my MacBook Pro is still eligible for the keyboard replacement since the issue is not as big as I though, she also told me the store send to me an apologise for the way they treat me as costumer and offered me a discount in a dongle... still better than nothing.

So basically I need to keep the MacBook Pro.

Also, these keyboards are very prone to failures. Can you imagine them denying service if it’s one of the keys that has a scratch? They’d be claiming used inflicted damage and deny the warranty claim, leaving this person to $600 in replacement fees.

that is pretty much the thing, that you should replace any apple devices having a cosmetic glitch when bought.
 
What year is the MBP? You can probably get the whole keyboard replaced under the keyboard replacement programme due to sticky keys.

My laptop (2017) lasted about a year with the original keyboard. When I got it fixed, it came out of Apple service depot with misaligned keys and had to send it right back. Then the 3rd set lasted about 2 months and the 4th about 3 months. I’m still experiencing issues and didn’t replace the 4th repaired keyboard. I’m waiting until the new MacBook pros come out this fall because it will have a redesigned keyboard and they will replace my whole computer with a new one on the 5th bring in.
