Sounds like he may have panicked and opened the case as a hedge against no tracking. If he gets it, he might close the case.

Yeah, I have a feeling the buyer is as terrified of being scammed as you are. Maybe they've been burned before. Have you tried discussing it by email or phone with the buyer?

What he's trying to say was, there are better ways to improve your financial situation than a risky eBay transaction. On an iPad 2 no less, the most scammed item on eBay right now.

Well, I didn't know the iPad 2 was the most scammed item on eBay right now, and we're just trying to do whatever we can to pay our bills. I don't think there's anything wrong with trying to make a little extra money, the only mistake was on my part by not getting the signature confirmation and insurance.

Reading all of this, I decided to call PayPal's dispute dept. It's been already said within this thread and yes it's true that you should do the following to have a conclusive decision in your favor:

If the item is $250 or more though I like the threads advice of $100 or more

1) Ensure a tracking number is applied
2) Ensure a SIGNATURE is required at the destination

To further cover you
3) Ensure that insurance is applied

The burden of proof isn't predominately on the buyer but is on the seller.

Of course you've learned a valuable lesson here and hopefully all turns up well for you and your wife in these rough times.

This has taught me today also.

Good Luck

Furthermore advice, the biggest/worse cost is the insurance cost at times, however its is worth it, consequently, for shipments valued over 500 dollars, you still have to visit the physical post office and purchase it(insurance) personally.

The insurance is actually more for the seller than the buyer.

That insurance money is given to you in the case you file a claim, in order to replace the lost/stolen item, and then you can resend the item in question to the buyer.

It's certainly possible. Now that they've opened the case in the resolution center, all correspondence is supposed to go through there. I've politely asked them to wait a few days but it doesn't matter because that's not how it works. Once a case is opened eBay gives you 4 days to either refund the money or provide proof it was delivered. So even if I ask them to wait a week, eBay will only wait 4 days.

CLose your account and let them send it to collections. It will be overlooked by most lenders with the exception of credit cards (which are generally automated checks). Don't let them take the money from you then you're out EVERYTHING. Better to resolve it later when you have some extra money.

Oh, I did want to ask. Since Apple said the device hadn't been registered yet. Do you need to register it in order to use it?

Why did you buy the iPad 2? With the sole intent of re-selling it? With the time you wasted most likely waiting in line for it and the hassle of selling it and ebay/paypal fees you paid for the auction, i think you should have just picked up an extra shift to "pay the bills" as you say....

not everybody has a job where you can "just pick up an extra shift" you have posted a couple of useless comments to the OP

seems like the OP was just looking to make a few bucks to make ends meet and things went a little south on the plan.

Good Luck OP ... it may still be delivered to the buyer over the next few days

Now, now... None of us are in his shoes, we do not know what situations/difficulties he's enduring. Let's avoid passing judgments.
A large percentage of Americans are a paycheck or two from major trouble if they do not have, as Suzy orman recommends, a 8 months emergency savings fund, at least 8 months worth of monthly expenses, put aside for a rainy day.

If you do not have anything productive to say.........say nothing at all.

Thank you, and for everyone that has made supportive comments. I really do appreciate it.

Apple OC is correct. The company I work for doesn't have "extra shifts" I can pick up. In fact, I was hoping to avoid giving out a lot of personal information but if everyone must know, I was cut down to part time after Jan. 1st and I've been working part-time at another company too just trying to get 40 hours a week between the two.

IDK about that. I saw 64G 3G's going for $1400 today with bids!! I may not be a math genius but umm.. That's about a $500+ profit. A couple of those would do just fine.

If someone is unemployed for whatever reason, survival instincts kick in. Not saying that I condone such behavior but then again I'm employed and haven't had a need to such measures.

In time of survival, ethics sometime go out of the window. I can't remember if OP bought that particular model but by his wife being layed off unexpectantly with bills = Some possibly survival moves.

Are you saying that selling an iPad 2 on eBay is unethical? It's simple economics, supply & demand. Demand is higher than supply, thus prices on the secondary market increase. There's nothing unethical about knowing that and taking advantage of the situation to better your own situation, especially in times of need.

In what sense? If I was trying to scam the buyer why would I be posting about it on here asking for advice?

Just sounds like your stirring up for reaction. If I were you, I would be posting more on the eBay boards than this one. Since your wife is unemployed and you've said it more than once in your thread, sounds like she should be doing this instead. Sorry if this is real, but it doesn't even sound like you bought more than 1 pad. You only talk about to stir it up. Again just my opinion.

I'm sorry you feel that way. I'm sitting here at work and I have this thread open while Im waiting to hear back from my boss about something, hence all of the replies. I'm not trying to stir anything up. A few people had questions and a few people felt like making accusations so I wanted to clear everything up for those who asked.

It is unethical to purchase a product with the sole intention to sale it to another for a profit with this particular product. If you were to tell Apple that you were buying it just to resale it for profit, the possibility would lay that they would tell you to kick rocks.

Your situation, however, is an exception!! You're not trying to obtain one to uphold a plush lifestyle but to SURVIVE!! BIG DIFFERENCE! I personally wish you had 100 iPad 2s with you to make a profit. I am irritated at scalpers making it hard for buyers that want to buy for their personal use but that's another story.

OP I've been and absolutely know what you're going through. This isn't the place to spell all of that out but I understand.

So like I said you do what you have to do to take care of your family because nobody, I mean nobody else will.

Exactly, he NEVER expressed an intent to sell/ship them to Hong Kong......and this is NOT to upkeep a Beamer, Benz, & Bentley lifestyle...... it's to help out with his living expenses and mortgage/rent.

I see what you mean, and I do agree. I get irritated with the practice of scalping as well. I guess given my current situation I never considered myself one of them. Thanks for the kind comments. :)

Thanks again. :)

I'll keep everyone updated on the progress of the case. And I'll definitely make sure to use signature confirmation and insurance from now on! :D

That is probably one of the most intelligent, and well though out posts I have seen on here in quite some time. GREAT POST! :D

Oh, I did want to ask. Since Apple said the device hadn't been registered yet. Do you need to register it in order to use it?

No. When you first connect it to iTunes to activate, you get a prompt asking you to register it, but you can just click "No thanks." It asks you several more times each time you connect to iTunes, but after about the third time it gives you a button saying something like "never ask me again." And once you click that, you can just merrily go on with your unregistered and fully functional iDevice.

I would file a report with the police department and say it was stolen. If you purchased it with a credit card, you might have some kind of protection or you might be able to file something with your insurance company.
