Wrong and wrong. "Standing" refers to the court's ability to hear a case. Cease and desist letters have nothing to do with it, and it does not turn on Apple's ability to succeed on the merits. As to Apple's "legal foot hold," this does not necessarily depend on any "previous contractual obligations" if Apple was harmed by tortious conduct (for example). If you acquire information illegally and then share it to someone's detriment, they may have a cause of action against you. That's not necessarily what happened here, but your statements do not accurately describe the law.

As to the theory that Kang was merely speculating, that's what discovery is for. :)

Except literally none of this matter since my understanding is that Kang and the others noticed are not in the US, so US law does not apply. Not unless they meet minimum contacts test to the US somehow; which I have no idea who these people are but doesn't sound like they have any ties to the US in any way.

So their law could be if you do x the spaghetti monster comes after you. Who knows what their country's laws say.

It's still, as a lawyer myself, underhanded and wrong. Legally correct doesn't put you on the moral high ground. And then preaching about fundamental rights while abusing some peoples'; EVEN IF it is legal to do in their country. Feels very....slimy to do.

Notice how they haven't sent it to US people as far as has been reported, because they would likely be considered the press here and protected rebroadcasting the information.

I don’t agree with hackers hacking into suppliers to steal schematics of future products so they can be posted online. But I do think leaks and speculation do create a buzz and hype for future Apple products and it creates money cannot buy marketing for Apple. They are one of the few companies that sell products people get excited about and most other companies must be extremely envious of this. If there were no leaks about future products and websites and forums like this one did not exist I don’t think there would be the same level of enthusiasm for future Apple products.

However I understand that it must annoy Apple to do new product presentations when the specifications of them have been revealed and discussed at length here for several months prior. I enjoy reading about the possible specifications and features of future Apple products but also wish we could go back to the element of surprise that existed in the Steve Jobs era at Apple when the iPhone and iPad were announced. I sit through the Apple presentations now and Apple announcing new products and features I already knew or suspected were coming months ago puts a dampener on thpings.

I understand that Apple wants to have as much totalitarian control over its products as possible but threatening leakers who are not breaking the law by posting confidential images of future products etc seems very heavy-handed. It must be pretty scary to receive a legal threat from Apple because of the power and resources they have. Getting into a legal battle with them potentially for years must be incredibly stressful and it could lead to financial ruin.

How can it be both valuable information but also misleading or not accurate?
Rumors are often a mix of accuracy and inaccuracy, and the same person can share both things for different products.

Where the rumors are trade secrets that reveal details of upcoming products, they are valuable. Where the rumors are made up, they are misleading and not accurate.

The rumors are often things like "the new iPhone will have four cameras, including a 4x optical zoom" where it is accurate that it will have four cameras, and inaccurate that there will be a 4x optical zoom." There's lots of rumors where enough is accurate that it makes the part that's inaccurate seem even more credible.

Kang’s response seems to indicate that, at least in some tiny measure, he is aware that he is doing something he should not be doing. Is it willful dissemination of trade secrets and/or information known to be protected by NDA? Perhaps…
If he signed an NDA then he would had been in trouble long ago, either that or Apple’s Social media department came back to work haha

This case is dead in the water in America. First amendment protections apply since he isn’t an Apple employee. Apple is just being a bully.
Still can't share trade secrets.

I have started to skip all “reportedly” or “leaked” information about HD. It helps built up my anticipation for the keynotes - they are now way more interesting… for me. Not everybody can handle the stress. :)

He’s not under NDA, but his source of information likely signed one.

I doubt Kang has committed any crimes, but a judge in a civil court is going to interpret “dreaming” as “knowingly posting trade secrets on the internet”. Of course everyone here enjoys juicy Apple tidbits, but the reality is that we are seeing things Apple likely didn’t intend us to see (as noted by this story).

Thus Kang is being disengenuous when he describes his posts as "riddles and dreams", as if he is merely offering his speculation on future products. That's not what's going on. Instead, Kang must be receiving confidential Apple info.. That's what Apple is complaining about.

Likewise Apple is being disengenous when it says leaks need to be stopped because they might be inaccurate and mislead customers. If the leaks were inaccurate, Apple woudn't care. Instead, Apple doesn't like the leaks precisely because they're not misleading customers.

Commenting about derivative versions of Apple products just takes the air out of saving up for some next great thing because more often than not, there wont be one. The long waits for refreshes and the hype surrounding the next best thing is something Apple relies on to generate more sales.
