I agree with Samsung on this one. Apple are trying to screw Samsung over by getting them to pay damages priced on the 'complete' phone rather than just the infringing parts of the phone.

Samsung were found guilty of infringing on some of Apple's patents and therefore Samsung should only pay damages for the patents they infringed on.

Apple were caught out for doing the same thing with a different phone manufacturer and that manufacturer did the same as Apple, requested that damages be worked out based on the 'complete' phone and not just the infringed parts. Apple appealed stating that it is unfair that they are being asked to pay damages based on the 'complete' phone.

Can't have it both ways Apple.

Apple won in Korea (Samsung found to infringe bounce back utility patent).
Apple won in Germany, resulting in a ban on galaxy tab.
Apple won in Netherlands on two patents and Samsung had three phones banned.

That’s a lot of winning for a company that hasn’t won.

Apple won preliminary sales ban (on Galaxy Tab's) that was reversed later after trial in Germany. In fact, Apple lost every single claim in Germany.

Both Apple and Samsung won and lost some in South Korea -- whereas in the US, Apple's win was one-sided. Neither appealed since they were more symbolic and not practical -- no significant sales ban that couldn't be worked around or damage award wasn't significant enough.

Apple won a few frivolous utilities patents out of many claimed in Holland -- they were so trivial that Samsung decided to work around the infringement to avoid ban, rather than appeal.

It was a truth blown out of proportion and unfairly attributed to Apple.

- Suicide rate at Foxconn is 10% of the national average

- Other companies products were made in the same place but seldom got a mention

- Apple were the only ones to actually try to improve conditions there but were the only ones being blamed.

The whole thing was a sham.

- suicide rate at Foxconn whose average age is only 23, compared to 35 for the whole nation, is fairly high for that age group
- Apple went to Foxconn in China knowing their workers' low wage and poor working condition to save money.
- Apple's PR gives a lot of garbage about the Chinese's engineering prowess, etc, but let's not delude yourself.

I don’t Believe this particular ban was reversed in Germany (others were). But the point is that the claim was that Apple lost everywhere. They didn’t. In fact, the only place they had a pure loss was japan. And you can’t dismiss their wins as “frivolous” just because there were workarounds. There are ALWAYS workarounds in technology utility patents. The fact remains that Apple actually won findings of infringement on valid patents in most of the lawsuits they filed around the world. Samsung did worst in most of these countries. So let’s not pretend that America is somehow the one country stupid enough or biased enough to find for Apple. The key difference between the us and these other countries is that in the us there is a jury that hears patent cases.
