Apple should be paying for copying Samsung phablet. Without Samsung, Apple would still be stuck on 3.5" that they determine is best for their customers.
 
While I think a lot of Apple's arguments are ridiculous and the similarities probably came up because there are only so many ways to design a rectangular phone that's mostly screen, it is sad that this is still dragging on this long.

Though I'm an Apple fanboy and would be delighted to see Samsung pay $500 million, Samsung's response is perfectly normal. Unless the jury award is lower than the cost of appeal, there's nearly always an attempt to reduce a jury award, and the tack taken is usually that the jury was mistaken or misinformed. This isn't news, it's business as usual.

However, it's still humorous. "No reasonable jury..." First off, as in any trial, Samsung's lawyers were involved in selecting that jury. Second, Samsung's lawyers (along with Apple's lawyers and the judge) attempt to educate the jury in the law. Of course, the lawyers' failure to educate/persuade the jury must be the jury's fault, not the lawyers'.

Every jury that has touched this case has awarded large sums to Apple, which makes every jury (and appeals judge) unreasonable. Makes sense.
 
Can't blame Samsung, $500MM is a lot of money for anyone. It makes every sense to try and reduce the fine.

It's not the money, it's the precedent. $500M is not a lot of money for Samsung. What they can't afford is to set a precedent whereas they copy a company and have to pay a large fine. Their entire company is based on copying successful products.

No. Apple have won numerous cases, but lost numerous too.

In terms of Apple v Samsung, Apple has come out on top in most of the hearings. Overall, Samsung was still found to be infringing on Apples' patents, however ridiculous some of those patents may be. Samsung have since appealed the first ruling and had some of the infringements squashed, and ended up with an original fine reduced from $1billion to about $400m. Since then Samsung hasn't appealed this ruling, so they've accepted blame, but they're appealing how much they should pay. This has backfired on them somewhat, with the $400m fine increasing to $500m+.

On one hand I think Samsung should just be forced to pay up now. Not sure how if there any restrictions on number of appeals in US law? But on the flip side, it is harsh the fine increased after they argued it should be lower. It seems the original circa $400m fine should have stood after the jury sided with Apple again.

Absolutely brilliant. Samsung has been using this as to stay on top of the news boards aside from their advertisement budget.
 
The US justice system (especially in respect to patents) is just plain broken. It should not take 15 trials and a dozen years to resolve this. I no longer even care what the result is - just come to one already.

Funny how companies with lots of money can just keep rejecting verdicts until they get one they like. Small companies/individuals don't have that luxury.

No. There will be no new trial. It's just more prostitution of the American Legal System. If you have the funds you can can find a lawyer in the US that will sue that the wart on your hand was from your visit to the Amphibian Exhibit at the zoo.

Ok seriously guys, why would Samsung let this go? Their legal department is going to

1) Demand retrial until they have no other recourse.
2) Delay for as long as possible paying damages

And Apple does the same thing in all their cases as well.
 
South Park should do an episode where Cartman freezes himself to wake up in the future cause he can’t stand waiting for the new iphone. I bet in the year 2546 Cartman would still find Apple & Samsung in court suing each other. Bark! Bark!
 
The amount of damages should be determined by a federal court not a local court. The whole patent system is a farce.

This lawsuit was ridiculous from day 1. Apple's demands are ridiculous, Apple's claims are ridiculous, especially since none of the companies involved have lost any money over the activity of the other. Only the lawsuit from Oracle against Google because of Java is even more ridiculous. But well, in a world in which intellectual property are more important than anything, this is not surprising, it doesn't help the competition though.

Du haben leider nicht verstanden ganze problem. Wenn du nicht nur consumer sondern auch development, dann wurdest du nicht so easy sehen. Apple hat recht und verteidigt mit kraft die freie welt der entwicklers.

Maybe Samsung should be more original and stop ripping off Apple.

But really, I can't believe Steve Jobs fell for the same trick again. In the 80s, Microsoft backstabbed him with Windows. In the 00s, Google backstabbed him with Android. Steve was way too trusting. At times, he looks like Einstein in terms of being a genius, and others, he makes extremely stupid mistakes (turning Apple's entire board against him; not getting surgery ASAP; trusting Microsoft and Google; and many others).

Google did nothing but rip off Apple. Worse than Microsoft IMO. At least MS can point to Xerox.
