Ha! Microsoft isn't the company I will be thinking of for innovation but yes they have been doing much better than they once were (when they have virtually no competitors).

Now what I want to see is Apple nailing the point that "it's not about the money", and start a philanthropy program of 1.05 Billion :) Perhaps putting computers / iPads in schools?

Where have you been? Apple outfits schools with computers all the time. In fact, when I was in high school they provided 3 full computer labs as a gift to my little Indiana school, and that was about 20 years ago.
 
Let me save you a bunch of pointless grief: I finally left Android for the iPhone 4s last December, and it was like taking the clothespins off my eyelids - there is NO COMPARISON in the quality of the user experience between Android & iOS. When I see people bashing Apple, I just figure that most or all of them were NOT iOS users who switched to Android in frustration...I've never actually met one of these. On the other hand, I know several completely satisfied Android-to-iOS switchers. If you still want to do this, PLEASE go try an Android phone for a couple hours first. I bet you won't be able to bring yourself to switch.

I would never want to see a complete lack of competition in any sector, but tell me this: if we could only have ONE mobile platform, is there a single one of you that would seriously choose Android over iOS? SERIOUSLY??

I would! I carry a 4S ( work phone ) and a galaxy S3 ( my phone ) every single day.

I'll take ICS and JB over iOS any day.
 
It's not an essential component. The only reason you think it is, is because its so widely accepted as the standard. Truth is, apple patented it, and its theirs. Samsung can use many other methods to zoom. tap and drag, a zoom button, etc. They better think of something. Apple is setting standards that are becoming so popular, and second nature, that u think that's the way it should be for every other device. Gonna be a tough road ahead for Sammy.

The patent Apple owns isn't all encompassing - you should read it. Samsung could still have pinch to zoom as long as it doesn't violate the exact patent Apple has.


Further there's another option. They license the patent.

Yep, when I grew up we had Apples as well.

Tho now, schools are mostly full of Dells. Most likely due to the fact that they cost less and last longer,.
 
Given your one line dismissal of both the grant of various patents and their being upheld in a court, I will assume that you are either an experienced IP judge, patent attorney or at the very least, law academic specialising in this very complex are of law. So, in that case, if you believe the whole system is broken, why dont you write a well reasoned academic piece for publishing in a law journal, showing the (im sure) very well thought out thought processes behind your one line claim below.

Why is that bad? Samsung takes stuff from Apple and improves them, then apple takes the improvements or other stuff from google/samsung and improves them even more. And everyone has better phones in the end.
 
I hope that this is a warning to all Android manufacturers, Apple means business. I hope that Samsung will take the path that Microsoft did and actually innovate instead of blatantly copying.

The best scenario for consumers is to have a choice, and if everyone's copying Apple, the consumers don't have much choice.

There is no big deal here, it's just a news item for salivating Apple fans.

Of course Samsung will appeal, and the saga will continue for months to come and might have a totally different outcome in the end.

Doubt it. Samsung has to pay the piper.

It seems counter-intuitive, but those FRAND patents that "make the phone work" are worth far less than Apple's patents. Remember, those standards patents existed before the iPhone and they helped create $300 smartphones (unsubsidized) that manufacturers and carriers had difficulty pushing on the general public. Apple's pinch to zoom and hundreds of little and not so little innovations that resulted in a new UI paradigm created an explosion of demand for smartphones costing $600-$800 (unsubsidized).

Another thing about those standard essential patents (SEPs) is that they're very weak. In most cases, companies can easily create superior technologies or workarounds but can't, because by being part of a standard, it essentially becomes a monopoly, stifling innovation.

So yes - they could have a variant of pinch to zoom. If they don't violate the patent - or - get this - they decide to license it from Apple (if terms can be met).

Saying "no it won't have pinch to zoom" is premature.

It depends if they pay the Apple the patents for it. Or if some court overturns it by then. But I'm not on the R&D team @ Samsung, so I couldn't say until their press conference.:)

The issue isn't so much the need for the FRAND patents. The issue is that Apple wants a flat fee and to not pay a percentage of the phone cost. The problem with that is - that's not what other manufacturers are doing. Or at least most. I'm not 100 percent sure.

Apple is saying that paying x% of the selling cost of their models is too much.
 
Care to elaborate? Or is your answer to my post in a state that is acceptable to you? I'd like you to tell me why most software parents aren't silly and how they don't hinder progress.

The thought of justifying copying by implying that's it's part of the natural process of innovation is absolutely ridiculous.
Software patents do not hinder progress - they require...no...they FORCE innovation.
All those who think that patents hinder progress are the ones who have never come up with something unique. Never created anything. And most importantly, have never patented a thing in their life and then have someone infringe on their patent.
