It doesn't matter if the customer has agreed to the service or not, nor if it is a matter of breaking the law (that's why there is civil court, you know).

AT&T's terms of service are wrong. Period.
AT&T's argument against tethering is that it causes an inordinate strain on their network compared to a wireless device alone. Now, network load is either in terms of bandwidth or total data usage. The bandwidth is equivalent whether the iPhone is tethered or not. The argument then rests on the idea that tethering transmits more data.
You can't argue for additional charges for using more data when the costumer already pays for an unlimited amount.
It really doesn't matter what the terms of service say. If those terms are challenged, AT&T has to form an argument that justifies those terms. Just the fact that those are the terms of the contract customers sign isn't enough (the "because we said so" defense").
The only difference at this point is the fact that AT&T doesn't enforce the terms - they aren't canceling anyone's contract nor filling suit on customers for past tethering charges.
Although analogies are bad I would like to say one anyway:
Someone goes to a chinese buffet pays $10 and he can eat as much as he want. That doesn't mean that even if he is full and he paid that he can take more food to take away for free.
The buffet place know an avarage how much a person could eat and they think that for that average $10 is fair.
Now AT&T knows what average an iPhone would use for browsing and such and makes a tariff based on it. Using MyFi and thetering leads to a different quantity of data that is not considered by AT&T. You are taking away.

Yes, it absolutely does matter that people agreed to the service, because in this country, when you sign a contract, until you can demonstrate in a court that it violates the law, you are bound by it. You continually throw out red herrings, yet you don't actually show where AT&T is violating any law with their T&C, and you certainly don't show any court cases where a judge has agreed with you. The cases you mention *have* gone to court. We can point, easily, to the places in the law where it is illegal to discriminate based on race or religion. You have done no such thing where the T&C are concerned.
By what standard? You've only shown why you consider them to be wrong. You've done nothing of the sort in any meaningful legal sense.
I wrote this earlier. If you are paying for unlimited on your iPhone you are using data differently than on a laptop. There are things you can't do on your phone that you can do on your laptop. For example - download huge files/send huge files. You're limited by the iPhone's capabilities. Therefor ATT's unlimited is something they've bean counted to figure out "max usage" - and I am not talking any mythical 5 gig cap. I'm just saying that there's a max that most users will use.
But - now add a laptop - and now you can download movies, stream peer to peer files and many other things that use the network as it wasn't planned for.
Buying a tethering plan doesn't give you unlimited data tethering. They've capped it for exactly this reason.
You would have an argument if ATT had unlimited tethering and ALSO charged you for unlimited iPhone data. As there would be obvious overlap. But I'd still say my scenario applies. I just think they would have less of a leg to stand on.
As it is - ATT knows realistic data usage for the average user. And they've determined that their unlimited plan (prior) and network can handle that. They are asking a premium to use their networks in another way.
Again - there's no real argument. As of today, tethering without a tethering plan is against T&C and therefor a violation of your contract. You can call it stealing, you can call it something else. Who cares. Doesn't matter.
These stealing cable analogies are completely off-basis.
It's more like your cable co brings you a box AND TV than says 'You can only use our service on this TV, if you want to use our service on your own big 106" projection screen, it's extra' And then everyone would say 'WTF, it's the exact same service on both screens, so it costs you the exact amount of money, so why are you charging me extra?"

Explain this: I pay $25 per month for 2gb of data usage. If I go over my 2gb, I am AUTOMATICALLY charged $25 more and given 2 more gb of data to use. WHY should I also pay $20 a month to receive ABSOLUTELY NOTHING for the additional $20??? I gain no extra gb's, no faster speed, no better service...NOTHING

To me, tethering (while I don't use it) has no guilt attached to it. I agree that tethering with mywi is not legally right, but I don't believe it to be morally wrong. OP and others ask me to justify my use of tethering apps and I respond by saying I don't need to justify anything to myself or others. People are going to respond by saying psychopaths don't believe murder is wrong but I really don't care. I believe that I am a morally upright citizen and unless I see AT&T crashing because of illegal tethering I shall say carry onwards my brothers!

Ok.. The iPhone is your unlimited data bank. You can use it all you want for free. But if you start drawing data from another bank (another device) you have to pay

You really dont have a choice if you live in the US. Yes, you can jailbreak, then unlock, but at what cost? If something happens to your phone you either have to lose your unlock (most likely permanently due to software updates) or you have to stick yourself with a problematic phone.
