"In Apple, for thirty years under Steve Jobs, they had warfare, terror, murder and bloodshed, but they produced the Macintosh, the iPod and the iPhone. In Switzerland, they had brotherly love, they had five hundred years of democracy and peace – and what did that produce? The cuckoo clock."

Looks like a copy to me.
Looks quite different to me. Arms are straight and different lengths instead of tapered. Minute marks are different lengths. Red second hand is slightly different, but not much. I'd say that's the giveaway that it was "inspired" by. But then, they may have copied a cheap Walmart imitation.

There's not much to copyright on the design except the second hand. There's only 3 elements, and two aren't anything alike.

It's such an iconic clock that I had never heard of it before five minutes ago.

As another poster said, pay the license fee assuming it's reasonable and be done with it. Or just change it to a digital clock.

There's really no dispute here, but c'mon, a clock face? Are we going to start accusing Maxis of copying Sherwin-Williams' wallpaper because there's a similar shade of blue in the Sims?

Uh, when you are suing everyone and anyone for anything and everything, you better not steal something.

This is called willingness to pay - the average Swiss customer is too passive and stupid to complain against the outrageously high prices of his country - that's how they preserve their artificial prosperity, which is of course financed by a healthy current account based on luxury products and financial services (as well as dictators' money, of course).

Not to mention customer service, which is surely among the worst in the world except for public services like the Post and SBB (i.e., the customer is NEVER right).

And yes, I do live in Switzerland.

That's quite oversimplified and distorted ... Your live in Switzerland must be like hell, if I would have to live under such terrible conditions like you do, I simply would move to a much better place ... may I recommend Libya?

There ya go I fixed it, your welcome Apple. Anytime..

So Apple is Italy and Steve Jobs is a member of the Borgias family...?

And the Mac is Michelangelo....?...

C'mon, rounded edges and rows of icons??!!!!?
Oh, wait...

Apple copies too.

Wow, look at all you armchair attorneys here getting it wrong. OMG LOL the CLOCKS look the SAME it's COPYING Apple owes Switzerland a BEELEEON DOLALRS OMG LOL case CLOSED! Whoa there, Nelly. We aren't nearly that far along yet.

The clock is clearly a copy. No question about it, and no the relative widths of the hour marks and such don't matter -- taken it its totality, there is no question that it is the same design. However, it may or may not be infringement, and even if it is infringement, it may be legal. There are a number of bases by which this could be the case:

[...]

/I am not your attorney and this is not legal advice.

Terrific post, not quoting in its entirety, but some of you short bus'ers should probably track it down and read the whole thing :)

Oh for ****s sake. Do an update that changes the clock, tell the Swiss organization to kiss your ass and ****, and move on.

This issue is not worth fighting over. No on gives a **** about this clock.

The Swiss clearly stole the idea from Apple and just produced it faster.

Are you frekin kiddin' me

Lol... Why would Apple NOT do this ?

It's very "Un-Apple" like, if the Swiss stole the idea.

Apple always get into trouble. Seems to be quite regular..... We should all just accept it.

 So tired of these bogus arguments. This isn't the first time Apple's been sued by another designer from a different industry. It won't be the last.

Just admit that Samsung deliberately stole and then profited in the EXACT SAME industry. It's a completely different situation. Do you honestly think Apple will make billions of dollars from putting a clock on the iPad?

If Apple doesn't pay a licensing fee and/or changes the clock image, you may have a very small, mediocre point. Otherwise, you're just engaging in a flame war.

This situation is in no way shape or form even remotely comparable to the blatant copying Samsung did.

Actually now that I look back at it they probably should have used this one, you know with that prier art thing and all..

If they are blatant copiers, then yes. Ironically, you never seem to have this idea with Samsung.

No, I am just stating a few bad facts about CH - that and road traffic, of course. ;) The rest is more or less OK.
