After buying a new Radeon HD4850 off these guys and it not arriving after about 10 days I googled and found this forum topic. I too have been scammed and lost about £100 is seems.

The time in my paypal dispute for the other party to respond ends tomorrow I think, and I will probably get the same "no monies for you" reply. I just registered to say I am willing to participate in any joint action to bring these fraudsters to justice.

I really thought paying through paypal would get me a lot of protection, I've heard some awful stories of businesses having their accounts frozen and emptied by paypal becuase of a single dispute, but it seems that they only really care about ebay transactions :(

Poor student here too, really can't afford to lose this money, but what can you do....
 
thats exactly the item i purchased from them and never received. Im afraid I dont hold out much hope for you getting your money back :(

I also thought using paypal would give me more protection and was gutted to find out it didnt. Sounds like a case for watchdog....in fact Ive just been to the Watchdog website and reported what has been going on, Ive mentioned this thread and hopefully they will get back to me wanting to speak to as many of us as possible :)

I suggest that everyone goes to the BBC watchdog site and reports this company, they have the powers to investigate this in a way we dont

Hi just joined after finding this forum on google search.

We have also fallen the victims of this company. Paid for a laptop £643.00 on 16 September and never received delivery.

Opened a dispute with paypal which closed yesterday with the standard reply as per the previous post above. Basically as the seller has no funds in his account paypal can not issue any kind of refund. Spent a very lengthy amount of time on the phone to them going round and round in circles and getting nowhere !!!! Paypal are emailing us address to write to make a formal complaint. Contacted our local police who have opened a fraud investigation on this and have asked us to fax over all documentation. Also spoke with Trading Standards who gave some guidance on trying to make a "chargeback" through our debit card company.

Have had to ring our debit card company three times as we were getting conflicting information from them. Have today contacted their head office and they were much more helpful. They are sending us out a "Disputed Debit Card Transaction" form to complete as the lady stated "you have paid for goods and not received them". Still not holding out much hope of getting the money back though but feel as if we are trying everything possible.

Will keep everyone updated but it looks as if this could run and run.
 
feel free to quote me in this thread if the police want any further evidence from others. I would be more than happy to provide further evidence, I cant even get through to my debit card companies fraud line :(

Spent £342.50 and put in a dispute ending on the 4th Oct. Phoned paypal and give them a good shouting at. Paypal are bloody useless when it comes to them doing something, it seems their policies favour the person commiting the crime. Obviously have no money back from them so I have phoned my bank and asked them to put a claim in. Now this is on my business account so I don't know if i'm proteced. I doubt it though because I used a debit card. :mad:

Is their any joint action we can take? I imagine if we all club together instead of complaining individually someone must take more notice?

If so its possible to track the IP address of the computer used. The Police can then go to the ISP (internet service provider) related to that IP address and track down the physical location of the computer / Internet connection that was used.

It's possible that they could have masked themselves, but they might not have.

I've still not heard back from PayPal yet! Was supposed to hear back yesterday and no one else will do anything until PayPal have finished their 'investigation'!!!

We obviously arent going to get anywhere with paypal. Can i suggest referring to links I have posted about reporting this to trading standards, watchdog etc. My friends partner is a trainee criminal lawyer so I will ask her advice on the matter. I would recommend reporting this to your bank as soon as possible.

Just spoke to the RBS fraud line, and as I willingly gave my details out they wouldnt consider that an act of fraud. They define fraud as being someone obtaining my details and using my card illegally. As opposed to someone just ripping me off

My review with paypal ended on the 4th and I believe I was if not the first, one of the first and got zero back. When I spoke to paypal they confirmed all the money was long gone, so why they had to take 10 days is beyond me?

I'm hoping Barclaycard will imdemnify the loss, but I read the small print and looks like they don't cover paypal transactions! In otherwords they know this fraud is real and don't want to be stung so pass this back to the consumer.

Anyone had any luck with the police or trading standards?

I've never had a problem getting money back off paypal from my credit card.

Which bank are you with? and when was it?
I think they changed the rules recently because no one on this thread can get their banks to do anything because they make a special exception for PayPal.
This effectively means you're less secure with PayPal than if you pay directly with your credit card! (outside of ebay that is...) :mad:

what annoys me the most is the following from paypal

We're working with the seller to recover the rest of your refund. We'll let you know when the seller is able to full refund your payment."

Yet they provide no way to add additional comments about the case or to request additional details about the seller. Even more frustrating as we know the seller isnt responding to anything from anyone, all known mailboxes (not sure about the yahoo address) are giving mailbox full messages. Why dont they say "we know they are cvon artists we are working with the police etc to resolve this"

I've done it many times before, and I generally use a nationwide cc. It's never been questioned, it's always been the same process and the claim form is sent straight out.

Last time was probably about 4 months ago, I can't say for sure.

There is nothing secure about paypal, inside or outside of ebay.

Maybe Nationwide are a bit more helpful because they're a building society. Barclay's wouldn't do a thing. I'll try them again though, and threaten them with switching to Nationwide...

I spoke with the Trading Standard's office just now, and I have been given bad news.

We are not protected if we payed by Paypal. If the funds are not availiable in the seller's account, then the refund cannot be retained.
If you paid by credit card through Paypal, you are not protected. The contract has been made through Paypal, and so if the money is not in the seller's account, the refund cannot be retained.

However, if you paid by credit card only, you are protected by law and can gain a refund. Lucky!

I, for one, have lost my money and I am NOT happy.

Hi all,

According to the pdf here, there are 'other ways' than the small claims court to try and get our money back. I imagine they'd all be useless in this case, but I will happily write a letter to the address on my invoice, in an effort to ascertain whether it exists, that sort of thing.

I don't suppose we can take people to court if we don't know where they are... we could also try finding the company registration details, if they exist, so if we do go to court (if it's even possible to bring a joint action in small claims) we've got as much info as possible.

Hi all,

Thought I'd delve a bit deeper into the moneyclaimonline.gov.uk site, and have a look at the details needed to make a claim.

When I put in the address on my invoice (322 St John Street, London etc), the website came back with the info shown in the attached jpeg.

I shall delve a bit deeper, at Companies House, and the Insolvency Service, so we know who is using what address, whether they're solvent etc etc.

No; mine was order no. 1359.
Cheers for the Companies House reminder, I've got the same address as you for Company No. 06658556, and am continuing to try and find more details about the others.

I haven't yet got all the details, but it appears that a claim in the County Court doesn't have to be answered, as long as the address is the registered one of the firm, the court will accept that all paperwork has been delivered properly, but I do not know what bearing that has on whether you get any money back...

My order number was different.
Assuming the order numbers went up sequentially, and started around the 1300 mark, we're looking at at least 200 people. But could easily be double that. Probably paying an average of about £400??
That's anything upwards of 80 grand they've scammed. I'd say that was probably quite a serious crime!!!
I don't think the route with this is to try to take this person to a small claims court! It's to find them and have them arrested and sent to prison for theft/fraud and then have our money returned.
