You shouldn't have sighned the waiver.

Then he wouldn't have gotten a damn thing. Trust me. No lawyer is going to hand over something that represents a settlement without a waiver. In exchange for his vow to not sue over the issue he received a TC and whatever else.

Basically the kid doesn't seem all that together so a waiver is probably the best thing Apple could have given him.

Either you're crazy or there is a permanent dark cloud over your head. Either way, Apple isn't going to be able to fix that.
 
If a person gets a faulty product, they should at least get a good money compansation to keep the faulty device.
 
I'm going to college for film- I was in charge of a production, I had to write a script, film, and produce it, since my phone wasn't reliable, all of the production went to hell and I wasted a year because of my failing grade and lack of film.

Being a big complainer myself, I never write these kinds of comments here but this one warranted it:

You really should have gotten another phone immediately instead of waste a whole year (!) and ruining your career. That's simply CRAZY. I mean: I empathise with your situation, but there's no reason in the world that you should have allowed a stupid phone, even such a nice phone as the iphone, to ruin ANYTHING in your life.
 
It's pretty easy to buy a Nokia POS off of ebay for $20 (I did) and pop your sim card from your iphone to that when it goes down. Whaddya know, no loss in phone service!
 
dudes I work at a Tech Support and this thread starter just sounds like one of those annoying f*kheads that just won't go away even after you throw everything you got at them! refunds, free products, upgrades.. you name it...I mean seriously RTFM!

11 Iphones....!?!?!?!!! Just be happy Apple actually cared enough to give you the THIRD one, seriously you're one of these idiots costing companies thousands of dollars because of nitpicky little OCD problems. Which in the end makes them spend MILLIONS on tech support and LESS on product development.. That means we get ******** Iphones and more idiocracy hotlines for the average fruitcake with an Iphone.
Failed your classes? waddafuk does that have to do with the Iphone? Dude have you ever heard of having a CHEAP BACKUP PHONE laying around?

This is a true story.. a woman calls the support hotline two days ago and asks me to fix her Internet.. halfway thru the conversation she starts blaming the Recession and her barking dog in the background! I'm like.. "Waddafuk does this have to do with the recession lady?.. well it might actually have something to do with the recession in your little head"

GET OVER YOURSELF! Stop blaming everyone else for your problems.. I'm sure your teachers didn't give you a failing grade with a written reason of "the students Iphone didn't work so I failed him"
I hope they don't give you the 3GS because you certainly don't deserve it.. specially after failing THIS hard...11 phones.. geezz.!

He go burn by an apple product more than likely defective.
Remember the lady who spilled hot coffee in herself at mc donalds she got millions. I think Nokia or motorola got sued for the same thing.
If anything he could have got an out of court settlement.
 
I understand your frustration but I think you have to stop blaming your iPhone for all of your life problems. If one is in production and your phone breaks just borrow one or get a different type of replacement. It shouldn't knock you off course for more than half a day - certainly not a year. I know lots of people who have had their iPhones replaced once or twice but 11 times starts to sound very odd. Perhaps it's time to schedule a group session with you, your iPhones and a good shrink.

He got burned by his iPhone and accepted a settlement which came to him in the form of phsyical goods. Under no circumstances would Apple Legal have allowed for the transfer of goods that acted as a form of a settlement to a person regardless of injury or loss without the execution of a waiver. If they did not have him execute a waiver then whomever the lawyer was should have been fired. Apple's legal team is there to protect the company from loss. They did that. The cost of the TC to them was nothing compared to what the OP could have gotten.

I remember the lady, I remember the phone issue with Nokia or Motorola ... I also recall no one settling for a Time Capsule as a result of being burned by a cell phone.

Whether he could have gotten more or not is irrelevant here. What he has today is a complete and total failure of reason surrounding his inability to function in school.

Dude... seriously. I do some production as well, and when it comes down to getting the job done, you ditch a bad phone and pick up a friggin gophone if you have to. After one issue with my phone I would have dropped it in a well before I would let it get my production off schedule. No way you can blame a failed production on a phone. If thats what you are trying to do then you are in the wrong business.

When I studied I didn't have an iPhone. Hell, come to think of it, I didn't have a mobile! And somehow I passed with flying colours.

Everyone has a phone nowadays. To say that something failed because you didn't have a phone is utter poppycock. You're trying to tell us that non of your friends nearby had a phone? You've got a mac, as we've seen, which means your contacts will have been synchronized, so all the numbers you will have needed will have been on your computer.
 
You should've get 2 phones instead of time capsule and headset. so you have a phone when the other one is in the shop.:D but seriously 11th phone is little too excessive I would say, Since you have a year worth of warranty, why don't you wait until you really can't stand it anymore?
It's an expensive phone but we shouldn't abuse the system by exchange it for a speck of dust under the screen and stuff. Eventually price of phone will go up higher to compensate all the refurb phones that we got. :eek:
 
When I was working in tech support we referred to problems such as those supposedly experienced by the OP as ID-10-T errors (and no, not to the customers). I definitely think it applies here.

It's a wonder how film producers ever made films before there were cell phones.

Just get a different phone.

OP, I and many others wish you well finding another phone supplier, I suggest Blackberry.

However, speaking as a University lecturer in your subject (well, audio Post), if a student of mine had come to me with your story I would have laughed them out of the office, (I'm know for my intolerance towards avoidable problems...).

Seriously, a consumer unit (like any phone) is not safe enough to trust an education or a career to without a workable back-up, and I'm truly surprised you continued to trust such an obviously PoS phone after having gone through so many.
