apple needs to be more realistic here - they were asking for $35 per samsung phone for the bounce back feature.

Perhaps it's not as simple as you make it out to be? Anyone who thinks this trial is about rounded rectangles is obviously drinking the Samsung kool-aid.

The majority of the amount that Apple is asking for is about their design patents and other trade dress.

Utility patents: Apple is asking $7 per infringing unit for bounceback and tap-to-zoom and scroll-lock = $150 million.

Design patents: Apple is asking $24 per unit = $528 million... OR an award for all of Samsung's profits = $2+ billion for those and other trade dress dilution. (I don't think they can get both royalties and award.)

Utility patent infringement awards are calculated by their percentage of contribution to the device, which is fairly small.

Design patent infringement means you can ask for everything the infringer made in profits, if the infringement is serious enough. Trade dress dilution has similar power.

So, yes, Apple wants to win on rounded rectangles with flat fronts, most of all.
 
There are only so many ways to design a four sided object with a touch screen interface. Why aren't they going after all the other manufacturers that have 'stolen' the idea?

because only samsung has copied so many decisions as to infringe on trade dress. its a valid legal concept, and if you dont defend your brand you lose the right to do so in the future. fact.

I still say I hope Apple puts the screws to Samsung and if Apple stole any technological ideas from other companies, that they be screwed too by having to pay royalties.

You have to protect your innovation period.

It doesn't matter the size of the company or not. If you invent something that someone else copies, then protect it. Failure to do so fails your investors, shareholders and yourself. It doesn't matter if Apple is selling 10:1 (pure example) or 10:9 iPhones to Galaxies or tablets or whatever. Protect it.

A similar example is a local company here in Ottawa. They make adult toys which are popular. Almost reaching $100 million in sales. Now other companies are copying it so they're going after those folks. Why? Well duh, because any other copy has the potential to take away sales.

I'll repeat so it doesn't look like I'm the fanboi - if Apple is guilty of stealing ideas/technology then companies should go after them too.

Yes, competition is a great thing, but invent your own and challenge....don't be a copycat by directly copying something. Shows your nothing but a cheap company imho.

First, this is a four-sided object: Image

Second, they aren't going after the other manufacturers that have made tablets or tablet-style smartphones because they don't sell as much as Samsung. Samsung has deep pockets and big sales numbers. As a competitive move, forcing Samsung to go back to the drawing board and redesign their phones would be a huge setback for Samsung and a huge win for Apple.

That is hardly the reason they are going for Samsung. They are going for Samsung because the orignal Galaxy S loook very very similar to the iPhone.

I've been following this quite intently, and I'll eat my shoes if Apple win the full 2.5 billion, as much as I love the company. Samsung (and a lot of other asian companies) seem to have a knack of copyright infringement in one way or another.

I agree with this. Although you will probably be called out for being a racist, etc., it so seems true. Looking at three South Korean companies - Samsung, Hyundai, Kia, etc. Hyundai tries so much to copy Mercedes-Benz, Kia tries to copy BMW, etc. So many knock-off products are produced in China in particular. There is no denying the facts.

I personally think Samsung (and Google to a degree) has ripped off Apple's idea's from 2007. I don't blame Apple for wanting to rid iOS of Google's services.

Both sides got to challenge the jury picks.

I believe that one of the jurors doesn't even own a cell phone.

Again, this is why some respected IP jurists like Judge Posner think that patent challenges should not be left in the hands of technically challenged judges and juries, but should instead be decided by expert panels at the USPTO.

(The related point of his being that clearly too many bogus patents are getting through nowadays. This is a result of the pay reviews now being biased towards how many patents are processed, and granting is usually easier than denying... especially with Apple, who is known for repeatedly appealing denials until at least some part is granted.)

Though I support Apple, I don't mind the imitations and copy-cats that put competitive pressure for Apple to step up its game each year.

So what you're saying is that if you spent many years and a fortune creating a painting, and you had it copyrighted, and someone came along and ran off millions of copies of it and made a fortune off of it, you wouldn't mind? You would "step up your game' and create more paintings for them to make a fortune on? Sorry, but I'm not that altruistic.

the icons look the same but the rectangular candy bar style design goes back many years. the iphone 4 antenna all around design was done by others as well.

Do you buy a product based on the look of its charger and cable? No. Icons are different now anyway. That computer doesn't look like any Apple product, it has seams. HP also made a case like that. Its just a way to fold the flap.
 
and in other news, the man who invented the wheel is now suing everyone who has used his invention. Car manufactures are quickly retrofitting their tires for a more square look. No word from the man who invented the square....

Copyright, Trademark, and Patent law prevents this from happening. Guidelines are all pretty clear. Like it's not possible to protect any clothing design you might come up with, enabling manufacturers to create rip-offs of wedding dresses the same day as the dress is revealed. Likewise, it’s not possible for Apple to protect the shape and cut of their packaging and shipping containers, but what is printed on them is protected. These laws are very complex, created by lawyers, to ensure that lawyers continue to make a good living interpreting them.

Apple has never complained about power plugs or cables. The only trial related items from that group are:

  • Phone icon - which had already been done before Apple used it.
  • Colorful icon UI - which is not an exact copy, but has a similar look when in the TouchWiz app drawer. It would not be surprising if Apple got some award there.

I'll give you some of the others, but that case wasn't made by Samsung, and the minicomputer doesn't really look like the Mac mini.
