Wow, that seems extremely risky for the buyer? He literally gave you $750 and hoped you would keep your end of the bargain? What information did he get from you to go through with that? I'd love to understand why this buyer seemingly took such a huge risk.

i know i just told him i had a lot of emails and other people were offering it.

he met at my house and seen my license to confirm i live there.
signed a contract stated the item and no refunds

Interesting. I don't think I'd let some stranger in my house like that, but I'm glad it worked out for you!

I need more details, please. Specifically, when I go to my Verizon page, and click on "upgrade my device" on a line I recently purchased an iPhone 6 on, it tells me a device is waiting to be activated and doesn't offer any upgrades. Ok, great. I get that.

But does all this mean is that once the newly purchased phone is activated (on another account, should I sell it) then it will drop off of mine? I paid full price for the phone, I didn't have an upgrade to use.

I guess what I'm asking is.... the new phone seems tied to my account right now. What unties it?

Not that I'm going to sell it, I am not. I am giddy with excitement about Friday. I'd just like to understand the process.

Didn't I see some famous person at one of the launch day opening on TV buy a iPhone from someone that just walked out with it, at a very good profit? Did he not have the right to do that or the iPhone owner not have the right to sell their property? Nothing wrong with it to me, if I put in the work and time to get a phone that they didn't or couldn't why should it be wrong to sell it if someone wants to give me a profit? Specially since Apple controls how many any one person can buy. That said I ordered 2, stayed up until 4:30am because Apple's site wasn't up and I couldn't get through on ATT, they will remain in my family, replacing an iPhone 4 and an iPhone 5, I can't wait!!!

You're never going to see that money FYI

If I could get away with interjecting a related question, what's the normal procedure regarding activation/sim cards?

Obviously, sounds better to sell the phone as "new, sealed", but I've seen arguments both ways (here and elsewhere) about whether it's necessary to open and activate first and whether it's a good idea to remove the sim.

I will be doing this as I ordered 4 gold 64gb unlocked and 1 silver 64gb unlocked all arriving on the 19th. Also have a few 6+ arriving between 10/1-10/6 so not too bad there. Def not 3-4 weeks like a lot of people got. I originally ordered around 12 iphones not noticing the limit so they cancelled a lot and I had to re order which is the reason I have to wait on some of them  BUmmer. I do plan to keep 2 of them but not sure which colors yet

Don't hate, they might not even sell and then I"ll be stuck returning the gold 64gb back to apple :p super stoked on getting a new iphone though...I currently have the 4s so this will be a HUGE upgrade. I will be picking the 6.

Interesting. Did you order all of them from apple.com? How many apple id's did you use? When did they cancel your orders? Did they cancel the orders in such a way so that you would only have 2 iPhone's per apple id? Or is the limit 4 iPhones per appleid (2 iPhone 6's and 2 iPhone 6 Plus's)? How do you plan on selling them? / Have you done this before?

That's a really good question. What information is needed to activate an unlocked Tmobile iphone from Apple? Will the buyer be able to activate it? Will he need the sim card? Will leaving the sim card in let him activate an account in your name? Does the phone need to be activated in the US (if you're shipping it abroad)???

Exactly the questions I have. I have three lines on my family plan. I ordered 3 new 6 Plus and 2 of us know for sure we want them. The third is almost certain NOT to want it. So I'm considering selling it (once I decide for sure my color choice suits me... got one of each color!)

So my options are to send the phone back/get refunded or try to sell it. I think right now it's somehow linked to my account, even though it's not activated.

How to sell unopened? When the buyer activates it on their account, will it automatically de-link from mine?

I'm with AT&T. Right before I switched to MobileShare, I used an available contract upgrade for a 5S to sell on eBay. I couldn't find a definitive answer then, either, so I opened it, activated it, and removed the sim. It sold ok and there were no problems. I always wondered whether it was necessary, though.

Put the sim card in. Turn it on. Done.

Awesome and congrats. You stand to make a mint and deservedly so. With the reward comes some risk though.

Not trying to start a flame war here. Just presenting a fact. Tmobile's T&S state you can't sell a phone for profit. Interesting that they wrote that. I don't see how they could enforce it.

You're talking about clause #18 in TMO's Terms & Conditions, right? You left out the first sentence:

Misuse of Service or Device. By activating or renewing Service with T-Mobile, you agree that you do so because you want Service from T-Mobile and not for any other purposes.

You're not allowed to sell a phone for profit if you're under contract or that phone has been activated on TMO's system for your use. It's not a blanket ban on reselling phones. If you own the phone and are not under contract, you are free to do with it as you wish - including reselling it for a profit.

I'm not with Tmo but if I do try to sell one of mine, it wouldn't be for profit, it would be to give someone a phone at what I paid for it sooner than they would have gotten it by ordering. Also, it would recoup my costs sooner than just sending the phone back.

My question remains though, the phone as of today is tied to my account. How does it untie itself? This particular order was placed with Apple, but under my verizon account page, it says the line "has a device waiting to be activated" or something.

Good call. I vaguely remember the wording being different in the past. I just think it's an interesting clause. That's all. I've worked for a major company and "donated" devices I've won to family and friends since I don't have a use for them with no issues.

What about selling iPhones on Launch Day at / outside Apple stores? I mean, you'll surely have tons of people that weren't able to get the color / size they wanted. Does anyone have any experience with this? I can easily picture it happening. I feel like some people might sell their phones after waiting in line even though they didn't have that intention going in, just like some people sell their place in line, without expecting to.

That may be, but please be a little more specific and cite examples of when anyone has been prosecuted for doing such a thing.

Virtually all goods, foreign or not, are trademarked. Once a buyer legitimately purchases an item, he is free to do with it as he pleases - use it, destroy it, give it away, or resell it at a price that the market will bear. Maybe not in China, but at least in most countries with free market economies.

Tell that to Ferrari and how they are going after Deadmau5 for his "degradation of the Ferrari image".

I noticed that there are many people who are looking at paying +$100 over retail for these phones on craigslist or kijiji. And they are buying them in bulk. So most likely to reship back to China and re-sell.
