Section 301 of the Trades Act of 1974 gives POTUS the ability to do exactly what he’s doing.
I don't see POTUS listed here and I don't see POTUS doing any investigations to determine which countries are using tactics that are unjustifiable, unreasonable, or discriminatory and burden or restrict U.S. commerce.

As usual, it's Trump doing what Trump wants and to every country, even those with only penguins to have his retribution.
--------------

Section 301 of the Trade Act of 1974, as amended, provides a legal framework for the United States to address unfair foreign trade practices that negatively impact US commerce. It allows the US to investigate and take retaliatory actions, including tariffs, against countries that engage in such practices. The provision is triggered by a petition from an interested party or at the discretion of the United States Trade Representative (USTR).

Key aspects of Section 301:
  • Investigation:
The USTR investigates foreign acts, policies, or practices that may be unjustifiable, unreasonable, or discriminatory and burden or restrict U.S. commerce.

  • Retaliation:
If an investigation finds a violation, the USTR may take retaliatory action, including tariffs, to address the issue.

  • Scope:
Section 301 addresses a wide range of unfair trade practices, including those related to intellectual property protection, market access, and trade barriers.

  • Examples:
Investigations have been launched regarding China's forced technology transfer policies, EU beef import regulations, and digital services taxes in various jurisdictions.

  • Super 301:
There's also a provision called Super 301, which requires the USTR to identify priority countries for trade negotiations, although it was less frequently used in recent years.

  • China:
Recent examples of Section 301 actions include tariffs imposed on Chinese products in response to unfair trade practices, such as the forced disclosure of intellectual property.
In summary: Section 301 provides a powerful tool for the U.S. to address unfair trade practices and protect U.S. economic interests on the global stage.

Let's assume the cheapest iPhone 16 Pro or iPhone 17 Pro becomes $1999.

What will that do to the used or trade-in prices of iPhone 16 Pro when people want to trade them in a few months from now?

Of course, I don't want a repeat of what happened to used car prices during the height of COVID... having said that... due to that unfortunate event, I bought the car that I was leasing at the end of a 39-month lease. The reason was that I was able to sell the car to CarMax and made a small $21000 profit.(after paying BMW Financial the lease buyout price)

There is no massive shortage of skilled workers in the USA.
I work in semiconductors in the USA. We are able to find skilled workers as long as we offer better compensation than the food trucks down down the road.

Given how much of the actual manufacturing is automated these days, it isn't like workers are pressing chips into sockets by hand. This stuff is surface mounted, and I have worked in those facilities, too. Training people to run tools like that is well within the realm of realistic for decent workers. You do not have to be a MIT graduate who narrowly missed out on a Nobel Prize to run a solder wave machine or chemical vapor deposition tool.

Apple surely prefers paying skilled workers $2.90/hour (via Foxconn), which they cannot do in the US, but there are skilled workers in this country. Since labor cost isn't the issue, according to Tim Cook (if you believe him), there shouldn't a cost barrier to manufacturing in this country. I get how it is hard to advocate for a $20/hour minimum wage while at the same time not paying your workers that, but that kind of is the square Apple is on.

Thank you for stating this. While everyone is busy bashing administration, maybe they’ll realize that THIS is the actual issue.

Sounds like this giving Apple just the right amount of days to get a ton of iPhone 17s in the country before tariffs hit. I expect to see a lot of leaks and day 1 updates….

Taiwan has laws that state that TSMC can not manufacture the latest tech outside of Taiwan. The US plant is two generations behind because of that.
Bottom line.... maybe someday we could (should is whole other question) move all the manufacturing of the parts to the US but it's complicated -- very. Trump doesn't do complicated. If it can't be boiled down to a slogan and rash action he can't handle it.

Let’s be real: Tangerine Palpatine isn’t “planning” anything. That guy’s skull is the equivalent of a glass jar full of dying fireflies.

On Thursday, he’ll wake up and see that tech stocks have tanked even further, and more “exemptions” will come in. Four days later, after Chinese state media calls him a dirty name, he’ll institute an eleventy billion percent tariff instead.

There is no plan. There is no rationale. There is only the ravings of a lunatic moron, who 70+ million of his fellow idiots trusted with far more power than he deserved or was ever capable of exercising with even a modicum of wisdom or restraint.
Guess the left should’ve ponied up a better candidate than the laughing, loser, hyena from California. Maybe Trump wasn’t a great candidate, but he as far better than the alternative choice. The fact that Harris still lost by a wide margin, even with NY and California’s population on her side speaks volumes of how bad she was. Perhaps next time, run a candidate that does something other than check boxes for the wrong reasons.

With the AI race going to overdrive, this seems like the opportune time to artificially make oneself pay a lot more for chips.
Those "on-cloud" AI chips used by OpenAI and competitors don't need to cross US borders and be subject to tariffs.

I’m not about to defend Harris, but she only lost by 2.3 million votes out of 150 million+. That’s not a “wide margin.” Plus, she became the Democrat candidate in July, giving her just a few months even to build a campaign. The fact that she still only barely lost is far more a sign of Trump’s weakness and lack of a mandate than anything.

The current Congress won't. They are too scared to defy him. All we can hope for is that more people come to their senses and vote Dem at the next congressional elections on November 3rd 2026. Until then, IT'S CHAOS!
Hahahaha. Hilarious. Vote for people that want to make the government bigger again?

Vote for people that think women’s sports should be destroyed? Or people that want to pack spending bills with “pork”?

Get real and don’t vote ever again.

You need to check your math. It is well known that Frump won by the smallest margin EVER!

Yes, that’s why I said even with NY and California in her favor. The wide margin part was the electoral college and swing state differences. She was a garbage candidate that wasn’t even qualified for her Senate seat, yet alone the presidency.

They should’ve pushed Dementia Joe out about a year before they did, and ran a more moderate candidate if they wanted to win.

He's actually using Section 232 of the 1962 Trade Expansion Act.

Kinda crazy how many laws Congress has passed so that they can hand the tariff responsibility to someone else isn't it?
Chairman Trump has passed 192 edicts that weaken your democracy. Aided and abetted by Congress!

Things are looking quite fascistic from this side of the pond in the uk.

Good luck America

The election was over by 9pm. Wasn’t even close. All the swing states voted against Harris. She was a terrible candidate. Trump wasn’t my favorite (Desantis was), but still, Harris was a terrible choice.

We don’t have a Democracy in the US.

Your country has a “royal family” and had to combine about billion countries together to even by relevant on the world stage.

Not much room to talk.

Chips used to be made in the USA. Motorola, Intel, IBM, TI and others all made their chips in the USA.

Part of the problem was that the cost to build clean room foundries in the USA was higher and it took longer to build them. There were also environmental obstacles put in place that other countries didn’t have. So naturally factories moved to locations where it was easier to operate and advance.

Apple shouldn’t be let off the hook. USA first is great for the country.
Agree with you but this community will scorch you for not supporting AAPL. Have to have a a bunch of shareholders or people who really love Apple or Tim Crook.

Ah well, I was planning on not buying anything much for the next year anyway, since I've been overspending on tech, cameras, mechanical keyboards, and fountain pens. Hopefully the current administration will all be in jail for contempt of court, and we can go on with our lives.
