My new iPhone 4s was out for delivery all day Friday. By 9:00 pm I was concerned that something was not right. I called UPS and the CS agent told me that if it was on the truck it would be delivered that day, no matter what. At 12:00 midnight the UPS tracking website changed to "will be delivered by 10:30 am the next business day". I was pissed...Called UPS and CS agent told me she did not have a reason why he did not deliver. I live in doorman building so there is not a time when packages cannot be left. Someone is always here. When Monday came and still no delivery, the UPS website changed and said " Exception: The merchandise is missing. Your package is damaged and is being held and the UPS sorting Location." So I called UPS. They wouldn't tell me anything, other than there would be no delivery. That their contract was with Apple, not me, and that I needed to contact them. I contacted an Apple CS agent who told me Apple Loss Prevention would have to open a ticket, and I would not get a credit nor be eligible for a replacement until Apple LP signed off on it, and could be as long as 3-5 business days. I escalated it to a supervisor, who basically told me the same thing. She would try, but basically I was screwed. When I called her again today for a status update. She told me that Loss Prevention had opened a ticket, that it was stolen, but due to the volume of people in similar situations( IE: people whose phones got stolen) that it would take several more days before my account with ATT could be reset to allow me to get into the line to replace the stolen one...I am still surprised that someone at UPS stole my iPhone.

Sounds like there was a rash of problems like this in NYC. One theory- I wonder if they hire a large number of temp employees for large one-time shipments like iphones. It could be that they don't vet those temps as well as permanent employees.

Update:

AT&T came through eventually :) (well assuming things go through as they said). All it took was three hours on hold and talking to 8 different representatives.

They offered to reverse the charges and reset my upgrade eligibility- which was all I wanted. Let's just hope I can snag a 4s at the apple store soon :D

No compensation?

I've read enough stories about new phone and video game pre-orders that have been absolute nightmares, that I will NEVER pre order. The thing is, 'people' don't give a damn about your stuff or whether you get it on time.

So, I take 'people' out of the mix. I go to a brick and mortar store and buy it myself on launch day, if I am interested enough.

Sure, I do the occasional order online, ebay, etc, but when it comes to something that I consider high value/ time sensitive, or a 'pre order' situation....heck no.

I didn't ask for any. I thought their resolution was fair- I'm not trying to be greedy here.

That said, I will be asking them to waive the upgrade fee ;)

your package is insured by ups they owe you the value of the contents... whether it be 549 649 or 749.

IS that true? UPS wouldn't even talk to me about it after my iPhone 4S was stolen by them, (never even made it to my house). They told me their contract was with Apple not me, and that all inquires would have to go to Apple. Technically wouldn't they owe Apple?

Yes, they would owe Apple, but the issue is still between you and Apple. UPS doesn't necessarily have another phone there for you to replace the "stolen" one. Apple on the other hand...

I really doubt that her iPhone wasn't shipped. That iJustine chick would do whatever to try to stay relevant cause her 15 minutes were up about 2 years ago.

The iPhone 4s about weight 4.9 ounces (plus add a bit more with the packaging).

If there were nothing in the box, why didn't she notice it when she picked it up?

That's a little surprising to hear. UPS seemed eager to investigate when I talked to them. The job of their loss prevention department is to keep that kind of thing from happening.

Almost happened to me last year w/Fedex delivery...

Whoever packed the box in the shipping box didn't seal it properly or cushion it. It was wide open.

For what?
AT&T didn't lose the phone, UPS did.
AT&T did the right thing by refunding the money and resetting his upgrade eligibility.

For the hours that the OP had to be on the phone to get the problem resolved, lost time from using new iPhone, stress, etc... I think there should be some form of compensation in addition to just problem resolution.

Again, he was on the phone for hours because of UPS. I think AT&T fixed the issue. The time loss is the fault of UPS.

Not really. The time loss happened because AT&T's phone support has terrible hold times and is way too fragmented with different departments.

But like I said, I couldn't reasonably expect compensation for my time.

My replacement iPhone arrived today, with a free case courtesy of Apple. I was also informed that the thief (a ups employee) has been caught.

I agree, ups was very eager to get to the bottom of my situation as well. Especially when it became clear the phone was stolen by one of their employees.

 Really? Interesting.

How about $15 for every hour I didn't get to use my iPhone.

Plus another $10 for every hour on hold (I hate being on hold).

Add an even $500 for my "stress".

Another $1700 for the vet bill to treat my dog whom I kicked in frustration over the incident.

And another $800 for lost sleep and depression.

Let's see, add the 0, carry the 1, hmmmmm, a million dollars!

That sounds fair.

(sigh)

Well Yeah my time does have a price. My Verizon phone was stolen from the Fedex Depot. Verizon refunded the money to my account. Credited my account a months bill and rest my eligibility on the account as well as another account.

I thought I was about to be on the same boat. FedEx in NYC never showed up to my apartment, yet on the website it said that nobody was home. I swiftly decided to go down to the warehouse to get it, once I get there I notice that they are taking FOREVER to find the package. BUT then she comes and hands me my package, I open it in front of her, and voila, 1 iPhone 4S and 2 iPhone 4 ! :D

In my own case, the lesson learned is always buy directly from Apple. My first call to them was on Saturday morning, they were immediately on top of the situation. Wednesday morning I'm playing with my replacement phone, and Apple generously allowed me to pick out any phone case I liked from their online store, which also arrived Wednesday. It doesn't get much better than that.
