The email doesn't state that this "optional." It states "locate the original packaging for use in returning the DTK. We’ll email you in a few weeks with instructions for returning the DTK." There's not "if you want to" or "if you return it we will give you" $200.

Then it goes on to say, "until your program membership expires one year after your membership start date, you’ll have continued access to other program benefits, such as Technical Support Incidents and private discussion forums."
Where does it say you MUST return the DTK by May? It only says it's sending out instructions, primarily for those who want to take advantage of the voucher that expires in may.
 
People like you are also of the same sort that complain when your favorite app runs terribly and isn't optimized.
When I have problems with an app, I contact the developer and offer to trouble-shoot for him or her. And if I have time, I also offer to beta test the app, which I have done many times.

You don't know me so stop with the "people like you..." rhetoric.

If some of you feel so strongly about the developers getting more free compensation, how about putting your money where your forum mouth is and give them money out of your pocket.
We want to, but we can only do so through the App Store that also keeps 15% to 30% of that margin for Apple. Hahaha…

I'm just kidding. The macOS doesn't mandate App store usage, so we actually can give developers 100%.

I didn't say anythng about May. You have me confused with someone else.

I pointed out that the email says "in a few weeks" we'll receive instructions for returning it, and that the language did not suggest this was "optional."

Who said that letter is the termination of the agreement? Show me where it says the DTK must be returned by May. Burden is on you.

DTK was always meant to be returned 1 year after the program started. Nothing in the agreement changed.

To be clear, I'm a dev and have the DTK. I'd like to think I have a well formed opinion about this subject.

A lot of developers in here having opinions on Apple and their BUSINESS relationship.

No one is qualified to have an opinion by that guy's logic, except thankfully - opinions require no requirements.

Troughton-Smith is a dev too and others, the people tweet cited in OP. so that argument doesn't doesn't make sense

...The only thing is when people say that its their equipment. It's factually not / this isn't an opinion. It's no different than car lease, except a lump sum and no buy out option.
 
Steve even gave developers that attended WWCD 2003 a free iSight camera ($149 value)

It’s called showing appreciation. It’s also good business relations. Check it out sometime.
What sucks about this is that a lot of companies (especially startups) follow everything Apple does. So instead of companies following practices like the one you mention (giving a way stuff as a way of showing appreciation to the people who help the company grow) we’re going to see more startups mimicking these new greedy corporate practices.

You're completely failing to understand what is happening in a few weeks.

"We'll email you in a few weeks with instructions for returning the DTK."

In a few weeks the email is going out. Nothing so far has said when the DTK needs to be returned (other than what was in the agreement). There's only an incentive to return it early for the $200. Otherwise, so far the agreement hasn't changed.

Sure, I can prepare in a few weeks. Nothing says I have to return it by April, May, or June. My program started on June 25, so I have until July to deliver it back.

Controversy[edit]​

The DTK was supposed to be loaned out on an one year lease ending in July 2021. However, the DTKs were rendered unusable in October 2020[10], only four months into the lease period. In February 2021, Apple emailed lessors of the DTK regarding returning the DTK, five months ahead of when the lease ended. As a result, there was outcry over the substandard amount of money paid to lessor of the DTK for essentially a breached contract[citation needed].[11]

Wikipedia is no authority on anything, but google it and you will see it is so. This isn't a figment of people's imaginations, its a loaner device.

Really the leased device was only usable 4 months out of the 12, so they should get 2/3 of their $500 back (again, imo). But won't happen.

What if you say you lost it? Just keep it. Pay a fee. In five to ten years, you too can be on Macrumors with an article titled, “anonymous developer sells original Apple M1 DTK on eBay for $10,000!”

Do you get the $500 deposit back with the $200 credit? Or, just $200 of the $500 back and Apple keeps the $300 difference as loaner fee?

I think its all sales final on $500 for the lease, and a $200 waiver towards a Mac purchase if they mail it back early. But it's to be mailed back by the end of the lease, as a requirement.
 
Starting with 11.0 Beta 6, Apple couldn’t be bothered to ship the proper kernel, causing the DTK to have severe performance issues and regular kernel panics, if not requiring complete OS re-installations as the APFS file systems would become irreparably corrupted losing data.

"You agree to promptly return the Developer Transition Kit to the Apple address designated by Apple no later than thirty (30) days after the end of the Term,"

I accepted the agreement on June 25. I have until July to return it. Today's email changes nothing about these terms so far and it's purely optional to return it by May for the $200 voucher.

You're free to keep the DTK until what it says on your agreement. Apple isn't forcing you to return the device by May. They're only incentivizing it. So don't take up Apple's offer and keep the machine until what it says on your agreement. Nothing has changed with your agreement with Apple.
Not quite… a term of the contract is “12 month lease, or upon 30 days notice.” You’re right that nothing has changed. But the DTK goes back immediately.

Not immediately. It simply must go back 30 days after the term ended. I accepted the terms on June 25 2020. My agreement ends on June 25, 2021. Today's letter hasn't said it's ending the terms earlier. I have until July to deliver it back.

Now, Apple wants it back. And owners are getting less than half of what they spent on it back as a credit to be used in three months on machines that are nearly 4x as expensive as the credit.

Isn't this $200 more than they agreed to?


Apple charged $500 for the DTK. Developers bought it to build and transition software for APPLE’S platform so that when the new devices came out, there was a strong catalog.

And the developers had the benefit of being in that first round, which is why they got them in the first place.

Which of these developer's apps do you think were part of the tipping point that caused people to run out and buy M1 Macs?
