How about returning the iPad within Apple’s return window??? Problem solved. Nobody is entitled to damages from this whatsoever.
I didn't return mine because I traded in my 5th gen to reduce the cost. I guess I could have and bought another 5th Gen but really, its a great device outside of scrolling quickly in the vertical orientation. Once you get where you want, its easy to look at and its great for video and other things.
 
Mac news are dumb sometimes. One user complains on Twitter, gets picked up by all mac news websites, the issue gets amplified and lawyers get involved. I bought an iPad mini at launch, noticed the jelly scrolling once. I use it daily and totally enjoy it. If someone doesn’t like their iPad mini they should’ve returned it
 
I believe these are Lawyer driven Lawsuits, in which the Legal Firm cuts a backroom deal with some individual OR individuals, & then files the Lawsuit.

I've carefully Read & Analyzed that $100M settlement that Apple agreed to with TWO OTHER App Developers, & in which that Legal Firm gets $33.3M of the total, AND it's a Total Joke of a Settlement !

The ONLY ones who are winning are the Lawyers !

Apple could & should put a stop to it, & ASAP !

Apple should "publicly" state that the Lawyers can ONLY get 10% of the settlement value !

That would put an immediate end to it ALL !

Stupid move by Tim Cook & his Apple by NOT doing so !

In fact, in the $100M settlement doc, they openly state that they are OK with the Lawyers for that case getting 1/3 of the Total !

Tim Cook isn't fit, IQ wise, to run a powerhouse like AAPL !

Even a little kid could immediately conclude Apple screws itself !

Always eager to defend Apple? Am I the only sucker that pays for the products full price and I don't get the "defend large corporation on the internet discount"? :/
I don't have an opinion on the matter since I don't know enough but it's entertaining reading the comments :)
 
If you're being honest you're lucky. Its obvious. Not that everyone is put off by it but to say you dont even notice it is hardly believable. They said themselves its there and normal so its not like it has not been acknowledged.
Of course he is being honest. Just because a minor issue is there does not mean you have to notice it. Anyone being honest knows this is an “issue” with LCDs, but it is fairly minor and you dont see it unless you specifically look for it. If you focus on reading and understanding the content, you are likely not to be concerned by what has been documented to be a minor issue

Jelly scrolling aside, does anyone know (or can anyone speculate) why Apple changed the orientation of the display controller? There must be a good reason because they wouldn't have changed it otherwise.

Perhaps they expected it to be used primarily in portrait mode (e.g. for note-taking with Apple Pencil) so they oriented the display controller vertically for this reason.
 
My guess the second lawsuit coming might be the dimming of the MBP 2021 screen because operating temperature higher than 25 Celsius.

If you google a little there are many excellent articles, even ifixit mentions “common”. So no, no real expertise needed, just reading. Also, not defending apple because it is a common problem, not an apple problem
 
If you bring up a frivolous lawsuit and you loose, you should pay not just for your lawyers but those of the defendant and the whole judiciary time (judge, court room time, etc.) you engaged for your crap.
There are pros and cons to both approaches. (In England, loser always pays for everything) But I agree, we should tilt more towards punishing stupid.

It's not going to go away unless there's laws limiting what greedy lawyers can get out of the settlement. Which will never happen as lawyers themselves run the government.
 
I actually tried to notice it on mine I bought last week and couldn't, so either they improved something or my eyes are defective I guess.

(or some people are blowing this out of proportion)
 
These lawsuits are tiring. This is a free market economy, if you don’t like the product, buy something else next time. Bad product design is not illegal.

You're thinking laissez faire, which is not good for anyone, either. We have a free-ish-erino market economy with protections in place for consumers to make sure we don't have lead in our water (MICHIGAN) or glass shards in our food.
 
Like everyone else, I sent mine back. It killed me because I was otherwise ecstatic about the device (I love small/compact things, and also the edge-to-edge design), but it was an utter deal-breaker. But a class-action? Come on, guys. This is a simple "vote with your wallets".

Colorado resident Christopher Bryan on Wednesday filed a class action lawsuit against Apple that accuses the company of fraudulently marketing and selling the sixth-generation iPad mini despite being aware of a so-called "jelly scrolling" defect with the device, according to court documents reviewed by MacRumors.

A few days after the sixth-generation iPad mini was released in September, some users started to notice that text was appearing slightly uneven while scrolling in portrait orientation on the device. Specifically, text on the left side of the screen appears to ever so slightly lag behind text on the right side of the screen while scrolling.

The complaint, filed in Northern California district court, alleges that Apple is aware of the defect, yet continues to sell the iPad mini without fixing the defect or amending its marketing materials to reflect the existence of the defect.

In late September, an Apple spokesperson said the effect is "normal behavior for LCD screens," according to Ars Technica's Andrew Cunningham. iFixit also said the effect is common for displays, but the repair company speculated that it may be more prominent on the new iPad mini due to the display's controller board being mounted vertically inside the device, rather than horizontally like in the fourth-generation iPad Air.

The lawsuit seeks damages in an amount to be proven at trial for any person in the United States who purchased a new sixth-generation iPad mini. The proposed class still has to be certified before the class action lawsuit can proceed.

I think I will stay with the Mini 5 over this defect.
 
It's not a bug, it's a feature. I play with the jelly scrolling on my mini all the time. My thumb is often wiggling up and down to make the display do that.

So, rather than return it, they raise a class action lawsuit. THIS is a prime example of why this should be outlawed. Apple should counter sue for harassment.
 
Nothing is stopping anyone from not buying or returning a bad product but who would pay the awful $500+ pricing to begin with for a display that belongs on a <$100 product.
