I’m hoping they can get away with a lot. Because if not it could have unintended negative repercussions in the tech industry. The question will be imo, did they intentionally mislead or was this unintended.

Just playing Devil's Advocate here, but Apple demoed something that at the time wasn't even being developed, in an advertisement for the capabilities of the device and the tech. I'm sure people bought it based on that ad so I do think it can be argued that they intentionally misled customers about the capabilities.
 
Mistakes happen, but this has been sloppy for some time now. I thought the iCloud Messages delay was bad. I don’t know what’s so hard about not advertising key features until they are confident enough they can be rolled out soon. They already gave themselves a huge release window. Please, stop advertising features 9 and 10 months in advance of rollouts. Some of the features they announce are good, but not even game-changing (like said iCloud message syncing - which still sucks on the Apple Watch as far as keeping your messages clean and organized).

This is so true! It’s obvious money grabbing. To me I don’t get why everyone is so mad, yet they promoted the lineup with Apple intelligence, but they also clearly stated it was rolling out over time. I could understand the anger if Apple downright pulled all Apple Intelligence features or just cancelled new Siri, but they haven’t. They’ve simply delayed it as it wasn’t ready for the UNANNOUNCED launch date. The people creating the law suits won’t be doing it because they’re angry, it’s just an easy cash grab. I think many, if not all, will be thrown out.
 
All of these lawsuits are gonna end up combined. There will be a settlement, but each member of the class will get $1.25 while the attorneys get $100m.
For a while, I was receiving lots of these $1.25 checks from BofA settlements. What a sleazy company, surprised they are still in business or still use their services. I wonder how many people actually deposit these checks?

This is true. At worst, these people should be given their money back and exchange for their iPhones. Maybe they’re going with mental pain and suffering? 🤦‍♂️

People may disagree react, but that’s only because they know I’m right 😉

Maybe those two people can just return their new phones and get a refund. Throw in the model they traded in (if they did). Millions of dollars? Most of which go to lawyers anyway? hard pass

It will be interesting to see how this develops.
 
I've been pretty annoyed at the longer Apple cycles and slow updates on Mac Pro line hardware and proper software updates the last few years, but these suits are ... pathetic. Lawsuits should be for when actual injuries or material losses occur, not when the 4,000th feature of a smartphone isn't quite as good as someone expected, especially when everyone knew and understood AI was the rapidly evolving hot new "thing" that would be changing every few months and disrupting thousands of industries and markets.

Frivolous cases hurt everyone. It wastes the time of the courts and citizens, raises prices on honest consumers, it prevents Apple from investing in new R&D, and hurts workers all around the globe who won't get raises because more money than necessary is getting pumped into international attorney fees. Lame. Gross. In this particular set of cases, I hope Apple routes them.

I'd be willing to bet the majority of people who bought the phone were going to buy it anyway. Either because they buy it every year or because it was their upgrade time. I sincerely doubt many people bought it for Apple Intelligence especially when last year's 15 Pro also was listed as functional for AI.

Apple clearly intentionally misled people by creating a fake demo. Ideally, they would face consequences for that.

There probably are some people who bought an iPhone 16 because they wanted to use Siri with Apple Intelligence. But the fine print at the time said "Some features and additional languages will be coming over the course of the next year." So anybody who has purchased an iPhone 16 knew (or should have known) that Siri with Apple Intelligence was not yet available and that it would be a beta feature when released. Presumably, there are no damages until the one year period has expired?

At that point, what would the damages be? What portion of the purchase price would be reasonably attributed to the Siri with Apple Intelligence feature?

Also, I expect that the number for whom the promised Siri with Apple Intelligence was the deciding factor in purchasing an iPhone 16 is very small. Surely most people don't buy new phones for future features that they know don't exist at the time of the purchase. Plus, you have all of the people who got "free" iPhone 16s as part of carrier deals. Would those people not have switched carriers, upgraded their line, etc. if the "free" iPhone 16 wasn't advertised as having Siri with Apple Intelligence "coming over the course of the next year"?

Personally, I would have purchased my iPhone 16 regardless of whether or not it had or was going to have Siri with Apple Intelligence.

Instead of a cash settlement and the lawyers taking $$$,$$$,$$$ and class participants taking $-$$ each, I'd rather Apple just give everyone who purchased an iPhone 16 a permanent increase in their iCloud storage space. That won't happen, of course.

Whoever makes money off this is obvious not going to refuse it (alternatively, in the event Apple wins this, I expect a big sigh of relief), but we're still not getting the promised features one way or another.

I didn't buy an iPhone 16 mini, because they don't make any. I would have if they did though.

As it is, I upgraded my iPad Mini and Macbook Air, in a large part due to Apple Intelligence. Not only do I not have AI, or anything like it, but I traded in a perfectly good iPad for one that's functionally identical.

Worse, however, is the Macbook Pro that I bought. I upgraded the specs of it, because I knew that LLMs need a lot of RAM. If Apple doesn't get AI out before the m5 CPUs are releases, it will mean I bought a computer a full year too early, based off of a premise that was demo'd as a fact.
