even more sad part is there are lawyers here that will take up the case, despite how dumb they will look representing it

judge should have thrown this crap out before wasting a lot of time and tax dollars
 
Wow, wonder if we can sue the radio stations because we may change the channel while driving? Surely its their fault for not playing what I want to hear at that moment causing me to change the channel and rear-ending someone, yes? I mean there is no way that could be MY fault for not paying attention. Heck we can include the radio manufacture too for not locking out the change dial while moving. :rolleyes:

In all seriousness, I hope the judge fines them for wasting his and the courts time on stupid sh** like this.
As I've gotten older, it's become much more difficult to change stations while driving. I wish I was joking. I wait until I come to a stop or ask a passenger to change the station.

Suing Apple, in this case, is akin to suing a farmer who grew the grain used in a alcohol product that caused a fatality.

This is a deep pocket lawsuit, a grab for money, nothing more.

But This is the world we live in now. Where someone feels the need to take advantage of something they believe has the potential to withdraw a large amount of money based on actions caused by themself. Fortunately, Apple has a league of attorneys that are likely well-versed with this types of cases that surface, but end up leading to a dead end.
 
I hope Apple doesn't tweak iOS in the future so that I have to tap "Agree" to a message that basically says, "Don't be an idiot behind the wheel; and if you are, we're not liable for your actions" every time my phone connects to my car. My car forces me to agree to a message like that every time I turn the car on before I can do anything with the screen. It's annoying, but I understand why they have to do it in today's lawsuit-happy society.
 
I blame alcohol companies because I am allowed to misuse and drink before and while driving.
I blame Nintendo, because it allows me to play my Switch on the go.
I blame humans, because I can make love while driving.
I blame the installed radio, because of a radio jockey made some rude comments and caused me to use my vehicle as a weapon.

and many more.... When will it all end? This dude is looking for an easy cash grab. If you blame one, you have to blame all things that can be a distraction.
 
Ensuring control of a vehicle & its surroundings is a 100% driver’s responsibility. In some countries they fine you for having any cell phone in your hand while driving, regardless of the phone’s size & “smartness”.
 
The person suing was HIT by someone using an iPhone. The victim was 'allegedly' doing distraction free driving and was hit by an idiot using their phone while driving.

My guess was that he isn't getting the 'cha-ching' payout he wants from the driver (or the driver's insurance), so he is suing Apple for making a device that diverted the other driver's attention.

Either way, it is stupid. Apple isn't liable, they just have the deep pockets that the victim hoped they would settle out of court for a big amount. He gambled and will lose. Everyone's comments are spot on, personal responsibility. If you cause a crash due to your distracted driving, you are in the wrong and your insurance will pay for it. If you aren't insured, you get to go to court and file for your damages and medical. If you are killed by a distracted driver, your family can go after the driver for what the court will give. However, the manufacturer of the device that distracted the driver isn't at fault.

America was founded upon two things...War and lawsuits. This is par for the course.
 
We all seem to be in agreement that this is a pretty cut and dry case of the driver needing to take personal responsibility for their own actions.

The interesting part is that things like a trampoline in an unfenced yard are considered an attractive nuisance, in which the land owner is liable the injuries sustained on their property because they failed to prevent those kids from coming and using it. Could someone argue the same of a phone? That it presented far too of an attractive distraction like notifications and failed to prevent them from trying to use it while driving? I can certainly see the argument being made, though I don't know if you'd totally be able to sway a jury.

In the future I think we may see more of this type of case. We may even see people win. With iOS 11 we have the option to silence notifications when driving (the phone can tell you're in motion and block them out). It's only the next step to make that not optional and block all notifications while in motion. While it would suck, they could certainly force people to click an acknowledgement screen much as we do with in-car GPS systems, stating we understand we should not operate it while driving and releasing them of all responsibility should we choose to operate in a unsafe manner. I think that day sadly is ahead of us as more and more use their phones while driving.
 
So they added driving mode after the lawsuit?

Can we sue Apple for not being able to use a headphone jack? Maybe they'll bring it back
 
I cut my finger. I am filing a lawsuit against the maker of the knife. We are going to be holding anti-knife rallies across the country and the MSM will soon be filming hit pieces where children and puppies are hurt with knives. The tears will flow and the people will rally. All statues of people with swords will be taken down and all stores with knives looted. All books with pictures or mention of knives will be burned "for the children". This great evil in our society must be rooted out... Anyone who uses a knife is a "knifeist" and should be put in jail for practicing "knifeism". We will unite the world into one big knife-free zone of security, peace, and freedom.

How could anyone possibly think this is Apple's fault? If there was ever a frivolous lawsuit, this is it.

Gun manufacturers are being held responsible when people do not safely handle guns and people are killed or injured. Apple should be no different.
 
Well it's true, Apple is NOT responsible, just like a steak knife manufacturer is not responsible for someone using one for violence. *rolls eyes*
