I don't understand how Apple could even be expected to do anything about it.

There is absolutely no way that Apple can tell the difference between a driver and a passenger.
 
Can't people take some ****ing responsibility nowadays? We're talking about adults here. If I cause an accident it's my fault, I'm not gonna blame a ringing phone, a talking friend or a crying baby.
 
First off let me say that is its 100% the driver's responsibility. When I am driving if I get a text message without looking at the phone once I say "Hey Siri Read my text messages". Its not perfect and when it doesn't work I am of the mind frame oh well. What does bug me is Siri saying "Would you like me to show results for that. One thing I like about google assistance is that it reads the answer to me much more efficient then Siri. I wish that Siri did that a little better. I am hoping in addition to not disturb while driving that Siri can be updated to never use the screen. But at the end I am responsible for driving my vehicle safely not worrying what my phone is doing.
 
I couldnt say it better then the judge,

And, as much as I appreciate the Judge and his decision, it aggravates the hell out of me that these cases make it to court over and over and over again. How is this crap given class action status. How is this even allowed to go to court. We have laws in place to punish or hold those accountable for frivolous lawsuits. What meets the standard if not this!!!! People are retards, their going to sue. I dont expect morons to not be morons, I do expect the courts to shut this garbage down when morons try and get a pay day. And we can quit with the useless redundant laws saying "no texting while driving"
Yeah duh!!!! We already have distracted driving laws AND reckless driving. Im pretty sure staring at a phone screen and reading would fall under the reckless driving category.
 
It's crap like this which exemplifies what's wrong with the U.S. Well, that and a whole lot of other things. But this gets at an underlying problem of everyone being so greedy and lawsuit happy. Mark my words, greed and hate will be our undoing.

There are no law suits in the UK?? The US legal system is based on English Common Law. The nature of the suits differs from country to country - the standards for libel and slander in the UK are different than the US, so there are UK suits that would never make it into a courtroom in the US. Different strokes for different folks.

Yes, the taxpayer pays, in part. A losing plaintiff also pays, in part. The respondent also pays, but may counter-sue in the case of a successful defense. Julio's lawyer may also be paying, as a speculative business venture - they may get a fat percentage if they win, nothing if they lose.

The taxpayers pay, because we want it. If we ever need to have a dispute judged, we need a system in place to provide judgement. That's true in every nation on Earth, as far as I know.
 
This person was involved in a car accident. Sue the car companies. After all, they made the car that was used to get in an accident!
 
This is so silly. Them suing Apple and not google suggests that iPhones are somehow inherently more distracting or dangerous than androids. If one company is sued, then every single smart phone manufacturer should be sued. That being said, it’s idiotic beyond words that anyone would try to sue a phone company for people being idiots. I’ve never heard of someone suing makeup companies for causing car accidents, or fast food restaurants, or FM radio stations for playing ****** music so people need to fiddle with their radio to find a good song. It’s utter idiocy. If anything they should be trying to sue the car companies. They’re the ones that make a lethal peice of machenary. Or even better sue the state for giving an unfit person a liscence to drive.

Unknown to most ppl, most states including mine, Maryland, prohibit doing anything behind the wheel of a car, besides DRIVING! Like eating, cell phone, makeup, reading, and you are not to have earbuds or headphones (both of them at the same time) on while driving. I see so many drivers now a days with headphones on, you are supposed to be able to hear emergency vehicles !!
You have to take responsibly for your OWN actions

Erm I beg to differ Apple..... your ideology of car safety has been an absolute joke! The new do not disturb whilst driving mode is a very very very lloooooonnngg time coming!
I use my phone for SatNav so it sits in a holder in my view like most people, and it's damn annoying for the screen to light up just cause I get some junk mail!!!!

Perhaps not liable, but the addition of better "Do Not Disturb" features should continue to be applauded and encouraged.
That honestly doesn't matter either, because its usually only a one click option to disable function, when it asks "are you the passenger"
Most of these ****s are instabooking, or sum thing stupid with social media! This country is ****ED, FULL OF IDIOTS!!
 
I'm so fast that iPhone 8/iOS 11 will automatically go into DND-while-driving-mode when I go for a run.

So the other day, I got into an accident because the other person sneezed. I have decided to sue the bacteria, virus, and any allergens that caused the sneeze. That'll teach those fools. See you in court all you microscopical organisms. Since some people sneeze when they look at the sun, I'm also including the sun.

Damn, the bacteria and viruses keep dividing! Discovery will never end.
 
How ever I should add suing Apple because another driver crashed into you is pretty desperate and far reaching money grabbing!
Their are laws for that, but pretty much most people take as much notice of them as they do the speed limit. It's good at helping with population control though as both crimes claim a fair few lives every year...

Bars and bartenders are sued all the time for giving a drink to someone who later has an accident, instead of denying them access before driving. Ditto with gun makers and sellers, for not providing user checks / technology.

One could almost (but not quite) argue that phone makers aid and abet phone junkies by not denying them access while driving.

Unlike with some of the other proposed analogies people have posted, I think this latest guy's point was the the technology exists to stop many distracted driving accidents, but it was not made available to the person who hit him.

I doubt he expects to win, but I would not be surprised if some California lawmaker suggested that such software become mandatory.

Agree with Apple/courts on this one

Driving is a priviledge, not a right. It is yours and my responsibility when on the road to drive safely and follow the rules of the road. it is the drivers responsibility to limt their own distractions and to drive within their own means.

When I get in my car. My phone goes into the central console. And it stays there until I arrive at my destination
