How the hell do you appeal something that's already been appealed? Just because apple don't like the verdict doesn't mean they can constantly appeal to the lawsuit that they started.

You've got that wrong, it was Samsung that started the case.
 
It's a lose-lose for Apple. Win the lawsuits, and their public opinion is hurt. Lose the lawsuits, and Samsung gets away with copying.

If Steve Jobs really wanted to wage "thermonuclear war", he could have just sold the iOS devices with $0 profit like Amazon does and take Samsung out. It seems like Apple is too obsessed with making the biggest profit per item, selling their stuff at the market price that's inflated by demand. You can't take over the market like that.
 
I''ve been reading through this and similar type threads like this with amusement at:

1. People who claim had the situation been reversed "fanboys" would gloat, yet they are gloating.

2. People claim breaking/killing/demolishing Apple's monopoly is good for consumers. Yet praising that "DROID" is taking over. How's that good for consumer choice?!!

3. People saying apple should get back to innovating, and that shapes should not be patented, but thinks it's okAY that others don't innovate, just make one similar, but patent theirs...

I'm all for the court making its ruling in favour of Samsung if it's finding is such that they didn't copy... BUT I think forcing a company to advertise for another is beyond childish. I've seen contempt of court being thrown around o-0 I doubt Apple is the first company and or individual as the case may require that has spoken out about a ruling. The advertise ruling borders abuse of power IMHO.

I agree this is the reason Apple won in USA and lost in every other country.

They haven't lost in every other country. It hasn't made it to court in most countries.

There are tons of cases, you hear of a minor decision against Apple somewhere and the uninformed think that means they lost in every other country.
 
Does Apple only have to post these ads on their UK site and in UK publications or will we be seeing them in the US too?

UK courts have no jurisdiction in the US, so they cannot order Apple to do anything here. It will appear only on apple.co.uk.

As odd as the ruling might seem to some, it is the ruling of a UK court. You might agree or disagree, but I think people have to accept the ruling. It is a UK court and it is not ruled by anything but British (and to some extend EU) law.
Not all countries have the same laws, get over it....
 
I now think less of the British courts then I did before. How does "cool" get into any of this? I would like to know from our British friends what it takes to violate these types of patients in the British Court System. I too have the same question, at times, of our court system. Why is this soooo hard? My eyes can tell me a lot about similarities. Why can't the courts see it too?:confused:

You mean you had a great understanding of the UK courts to begin with? Please, tell us more.

Pointing that out isnt cloating.

There is also a difference between gloating and thinking its good a stupid lawcase had no effect on the market.

Neither of them has a monopoly.

The issue with this was that plenty of other phones and pda's already had simular shapes.

So no people dont think that, people are just tired that apple seems to be less innivating then before and instead has decieded to battle other companys in court, probably thinking they are the richest and can just bully other out of the market, or at least hamper them enough.

I actually think its a great punishment, the lawsuit came in the news with the claim from apple that samsung copied them, this is just setting the record straight .

Depends, this ruling is for the whole of the EU, dont know the words but its possible they have to put it on all eu sites.

Uh.

"market price that is inflated by demand"?


That's how the free market works. if the market will pay the price, it is not really inflated.

Apple are a publicly traded company. to sell things at a loss, or no profit, or not the best profit they can obtain is not acting in the best interests of their shareholders, which can cause unrest, problems in the company, etc.

What good is taking over a market if you're not going to be making any money out of it ? Dumping is not a sustainable business practice. Once you dominate the segment, you can't just jack up prices.

Apple would be better off with veiled threats and licensing their patents to other players. Then they take a cut of their profits and still keep selling their stuff at high margins like they do today. The lawsuits aren't doing anything to really help them, but licensing out their technology at a rate just under what litigating could cost the competition would.

No, read the ruling. It will appear on all of Apple's European sites. This was posted earlier in the thread.

Apple has to post on Every EU site, not just the UK you wont see this in the US.

And those slating the UK judicial system, take a close look at your own before making the silly comments. No countries court system is perfect including the high and mighty USA.

They can sell at whatever they want and set an RRP. The demand is there to sell at these prices.

Weeks before the original iPad's announcement, everyone was expecting the price to be $999, not $499.
