This right here. Unable to file a police report is pretty much the guy admitting he was lying about not receiving it. Also, in California, the threshold is $950, which the iPhone 14 Pro Max alone would exceed.
I really don't think it's for you to speculate and accuse this man of fraud unless you have a foundation or evidence to do so. The guy said the police have designated it as a civil matter.

On the contrary, my iPhone 14 Pro was delivered launch day via the same means and had zero issues. Customer just needs to do a chargeback and file a theft report.

I couldn't imagine having expensive electronics delivered to my house. To the degree it's possible, expensive purchases are either made direct from the manufacturer in a retail store, or I have them held at the shipping centre for me to pick up in person. There is way too much potential for this kind of nonsense.

Now if this lucky individual decides to charge back the credit card or take Apple to small claims court, they'll retaliate by suspending his AppleID.
Every phone we owned has been delivered from our phone carrier but they use ups or FedEx to deliver not some random person

Of course, it would be dumb to use an Apple credit card to buy Apple products.

This makes no sense. Iirc Goldman Sachs underwrites and services the Apple Card and has to adhere to the same MasterCard and Visa dispute rights and processes that every other company does that issues credit cards with the 2 associations.

As others have said, just dispute it. Apple will lose the dispute because the burden of proving it was delivered is on Apple ie dispute rights favor the purchaser in non-retail/physical purchases and they’ll probably push the expense on Uber Eats when they lose.

While in dispute the purchaser isn’t responsible for paying the amount in question and it doesn’t accrue interest.

Apple has the serial numbers and IMEIs of both products. Someone’s going to have to register them. Pretty easy to prove based on geolocation and AppleID it isn’t the guy who bought them.

Apple's choice of partners is quite worrying, shows lack of judgement and is a reflection of Cook's values. Uber Eats, Goldman Sachs, what next?
You’re right about lack of judgement. You’re correct apple should have used Bernard L. Madoff investment securities as their partner. /s

The internet is great - a one off story and people are critiquing Tim Cook lol.

This is why you pay by credit card. So that when Apple refuses to refund for non-delivery, you can have the bank reverse the transaction.

Of course, it would be dumb to use an Apple credit card to buy Apple products.
Please explain.

FedEx or UPS insured w/ signature. If you need it same day, take an Uber to the store....but don't trust some rando person who signs up to drive for Uber...sketchy. Hope Uber investigates, but sad that Apple shrugged and gave up. Not a good look.

This happened to be with Uber Eats, but with food. The driver arrived, marked the items as delivered, and then left. Nothing was left at the door. The delivery photo was zoomed in on the bag and nothing else.

I contacted Uber and was upset, but basically after a short conversation I was told there was nothing they could do as it was marked as delivered and they are working to improve their service.

Same. I ordered a large Sushi order a few months ago from a restaurant I order from quite often and they never miss an item. Yet the bag came with less food than I was supposed to get and the way the bag was it was obvious someone had gone into it after it was stapled. Anyway I got no recourse from Uber as they said "This order is not eligible for refund but thank you for the feedback and we are working to improve blah blah blah..."

So I hammered their Twitter account here in Canada until someone replied and they actually ended up refunding me the order as a credit for Uber but it shouldn't have taken this much for me to get back what was like $150 CAD in food I didn't get.

I deliver apple products and have also ran into customers calling right when I step out of the store, trying to get out of signing for product. “ Hey, can you just leave it somewhere around the house so I don’t have to sign or maybe a neighbor can sign?”

Instead, Uber aught to make every delivery require a unique code that a driver asks for from customer and keys in to driver app before handing over product. No code no product. Return to store. No problems. No return to store equals deactivation of driver. Apple Store must scan product back off driver. Order clears out of driver app. Money goes back to customer. Repeat customer unavailable for code exchange equals customer blocked from two hour delivery.

Then the police would happily take a report for documentation purposes. Apple made the right decision. Sometimes it’s just obvious to most of us.

If the order was placed using Apple's Online Store's same-day delivery service, Apple should be responsible for lost or stolen orders if they never make it to the customer, just as they would be had the order been lost/stolen or delivered to the wrong address via UPS or FedEx.

Apple contracts out the same-day delivery service and it's all integrated and tracked via the order tracking on the order status page. The customer usually has no idea which courier is actually delivering the order. Apple requires a signature for every same-day delivery regardless of value (at least in my area), so they should at least compare signatures on the customer's drivers license with the signature that the driver used (forged) when they stole this order.

When this happened to me, there wasn't even a question, Apple quickly apologized and turned the order status to 'Cancelled' and credited my card. Maybe in my case, the driver never submitted a (fake) signature? Who knows. But the customer should never be responsible for lost or stolen packages/orders if a signature is not required or successfully obtained unless there is a waiver on file.

If Apple wants to offer this service, they need to take on the risk that comes along with it. If they can't recoup the lost funds via the courier that they contract with, they need to implement other measures as there are people out there who will claim items are stolen when they are not (unfortunately).

Perhaps in addition to a signature, the driver should be required to see (and match) the driver's licence signature and address before closing out the in-person transaction.

Every time we ever had an issue with DD or GH, we chatted, and they fixed it. Never ordered $2k though.
I think it is pretty crappy that Apple allegedly said they won't do anything, especially since Apple entered into a contract with the food delivery service. Either we didn't get the complete truth, or Apple has let down a customer who got screwed. if it is the latter, I hope Apple steps up and makes things right.

I'm so glad I live 0.5 miles from my Apple Store, easy bus trip or walk.
Another recommendation I would make, when you buy stuff these days at the Apple Store, put it in a discrete back pack before walking out of the store.

You don't know who is around these days or who is watching you. And don't stereotype it either, anybody can steal, even if they don't want it. There are people who just get a kick out of doing that stuff.

“the customer from California said they were unable to file a police report about the incident.”

This is nonsense. You can always file a police report. They may not do anything….but you can definitely file a report.

There is not something quite right here. Customer allegedly is out product and no entity is making this right?

I had an Apple Store product that was marked delivered by Uber Eats and never arrived here. I told Apple and after an investigation, they sent me a replacement product. I don't think their standard procedure is to tell the customer "too bad".

apple should smarten up. how can the use a delivery service with 0 accountability? i won't be using this service until they make this a lot more bullet proof. but i recommend using your banks charge back service for items never received as the article says.

Why doesn't Apple utilize air tags inside the products when using this service? It will minimize left and in the end it will cost more to replace or even get into a legal battle down the road.
Apple can track this phone as soon as it’s switched on.

Getting one side of the story on something like this in inflammatory. The customer will of course paint themselves as a victim with zero help, but we have no way of knowing how accurate that is. I see MacRumors reached out to Apple for a comment, but I wonder how long they waited for a response before publishing this story.
