That's a rough translation from Apple's complaint in the Samsung case:

The Galaxy tab violates the design patent number 000181607-0001 because:

* it has a rectangle form factor
* it has rounded curves
* it is a "slim design".
* it has a clean surface which covers the frontside
* it has a bezel
* it has metal around it

And my favorite:

* when switched on it shows colored(!) icons on the screen.

I am not kidding, that's really what Apple is writing in their lawsuit.

Err, doesn't that describe a thousand phones that came out before the iPad/iPhone? Especially the colored icons bit.

Slim design has got to be the most ridiculous one after the colored icons. Letting Apple patent making devices slim is like letting Ferrari patent making cars fast. Sorry, if the car you manufacture exceeds 200 MPH, you gotta pay licensing fees to Ferrari :rolleyes:

So they have a right to 30%? Does Microsoft deserve a cut of all compatible software sold for Windows? Why does Apple deserve this? Because they review apps they get 30% of all sales? Geez.

This is the stupidest thing I've read this week. Do you think Best Buy and it's ilk are charities? They deserve their cut because they operate the store in which the software is sold (that's how retail works, whether it's brick and mortar, or online). They run the servers, they provide app storage and bandwidth for delivery, they handle payment transaction, they handle collection of taxes for the regions in which you sell your app, they handle disbursement of payment to the developers. They handle EVERYTHING other than writing the app. If you wanna bitch about rates they want for in app sales/subscriptions then that's fine. That's something that is worthy of scrutiny. Taking a 30% cut of app sales is entirely justifiable.

The App Store has been a god send for developers. It has given a huge number of independent developers (I'm one of them) the means to make more money than would ever have been possible without it. Apple taking a 30% cut in exchange for an audience the size of the iOS user base, and little effort required on the developers part in the "sales" end of the process is a bargain and a half.

Hm- this does describe the Galaxy Tab, however, I've never held a Motorola Xoom, but it appears to have black plastic on the edges rather than metal. So you'd have to broaden even those claims, it seems. (Note that I'm not a lawyer or anything)

The best thing Apple did was come out with a better looking iPad.
Sorry, but the iPad 2 is the most uncomfortable tablet to hold/use for any extended period of time compared to the Xoom, Galaxy Tab and even the Acer Iconia.

The beveled edge sucks. How many iPad2 owners are in fear of snapping off the damn connector or mangling it because of the beveled slot?
I prefer the original iPad form factor over the new one.

Obviously, I don't think anyone here is a patent lawyer, so I know we're all just sharing our non-expert opinion. :D

However, even if what you say is true or accurate, then is this a reflection on Apple or our US patent system for allowing such broad claims to be patented?

To make an outlandish point.... If you hold the patent on cylinder objects, with a handle, and closed on one end for the purpose of drinking hot liquid, then you have the right to go after every coffee mug maker. That's how it works.

My point is, ALL manufactures these days are guilty of filing patents that are very general and broad. Of course, they are the weakest to defend too. But I'm assuming there must be something here the courts see in Apple's suit since they have granted them a injunction against Samsung for these claims you point out. They don't do that without cause.

But what the heck do I know? I'm just like the rest of you here... an armchair lawyer. :p

That's the complaint itself. I was pointing the Design registration document on which that complaint is based. Of course, not being fluent in german, I am simply going by the accounts of other people here.

Maybe you'd like to point out what other claims were made above and beyond the Community Design registration ?

You sir need to read what you just posted.
The doc KnightWRX posted is contained in the link you posted and is the heart of Apple's complaint. See page 23.
This is the heart of Apple's complaint and it's complete BS that Apple was even granted such a generic design patent in the first place.

I will bet real money that the patent gets revoked.
 
All Apple is doing is repositioning the Tab and resizing it to make it Samsung look infringeful (?). BS.

Xoom? Someone actually has one to hold for an extended period of time?

I don't have any fears of breaking anything off with the iPad2. Other than the headset connector, but that's an issue on any headset jack. Nothing unique about the iPad.

Maybe a more accurate thing to describe is that the bevel edge makes it a little awkward to plug in the 30 pin connector? But breaking it? No issue there.
 
It's me or the iPad on the picture of page 39 doesn't have 4:3 ratio and resembles a lot a 16:10 ratio like the Galaxy Tab?
It's obvious that Apple distorted some of the images in an attempt to help their case.
I've held both tablets in my hand and neither could be confused for the other.

The Galaxy Tab is bigger and the shape is more an elongated rectangle where the iPad is more like a sheet of paper in dimension.

It's obvious to everyone that all these tablet manufacturers didn't out of the blue get the idea to include a mobile OS on a tablet, rather than a full-fledged desktop OS like Microsoft seems to still be trying to do... Not that there's a better way to do it or anything, but all these Android tablets are just mimicking the iPad, like Android did with iPhone OS in the first place.

Maybe you're too young to remember, but IOS was not a first dedicated mobile OS.
 
So many copy-cats nowadays! I am not for Apple to own the mobile market, we need competition in the market, and what is going on within the tablet world is nowhere near real competition.

What more do you want from the market?

Samsung Tab 10.1 has a larger screen, better camera, and cool ass operating system.

Motorola Xoom is blazing fast.

Acer has a DUAL screen tablet.

Until Windows 8 releases (supposed ARM support) and we start seeing Windows 8 tablets, then not much is going to change.


Also, on a side note, I bet apple is chasing them down, simply because they have a shiny black bezel. Big whoop. In no way has the Xoom slowed down iPad sales. If people want an android tablet, then that's why they are going to get.

Lets not fret on small cosmetic features. It cost more to sue Motorola then it would if you would let it go and maybe lose 1 - 100 ipad sales.
 
Maybe Fusion Garage should sue Apple?

After all the joojoo design & actual launch predates that of the iPad and it's all glass with rounded edges and a tapered back :rolleyes:
