Just more proof Apple is becoming worse that MS ever was.

I keep thinking about 'that' Superbowl commercial in the 1980's with the young rebel heroine hurling a hammer at the screen (ala '1984). Just an opinion.....

The real truth behind all these apple lawsuits can be surmised in just one word: Desperation. Apple is genuinely scared that it will not be able to hold on to it's market share for too long. In fact apple is seeing the greatest evolution in computing slipping away once more. Reasons?
a. It is impossible to hold onto a significant global market share with just one phone or pad, no matter how great they are, updated , maybe, once a year when there are other 40 at least manufacturers producing at least half a dozen phones and a couple pads each, updating them at least twice a year. It is in human nature to be varied and seek variety. It is thanks to this human tendency we have progressed from caves to space exploration. Yes one can claim that apple did it to an extend with the iPod for quite sometime, why not with the iPhone or iPad? Well an mp3 player is just that: An mp3 player. But a pad or a phone is something different all together. They are computing and communication platforms. And here's the next bit:

b. Dealing with communication and computing platforms you need other things to keep your market captive to your products. You need an ecosystem that will be sustainable. Apples ecosystem? The hardware, app store and soon iCloud. All nice. But not enough. Apple does not have any social networking platform. They do not have a far reaching email communication platform. Their mobileme email platform is as good and dead. The app store is no longer the only place you can get good quality apps. Furthermore apple’s insistence on a 30% cut for in app purchases and subscriptions is pushing publishers and content providers towards the browser based experience. Please note that I am not querying whether apple is right or wrong on this. Am just stating the facts.

c.The hardware:. Apple does offer great hardware. Only a fool would put that to question. Yet again only a fool would fail to realize that Samsung’s galaxy phone and especially the galaxy tab have got some impressive specs. Some of them better than both the iPhone and iPad. And if you dispute that please take a look at direct comparisons. Specs by themselves though mean absolutely nothing for the greatest majority of consumers. Yes every single one of them will drool over an iPhone but the 80% will go buy any other phone for a myriad of different reasons.

Now take a moment and have a glance across the fence. What do you see?

a. The hardware quality divide is almost breached and keep in mind that this means nothing to the majority of consumers.

b. The Goliath called Google is marching with the following:
1. The biggest and most reliable search engine.
2. A massive email based platform.
3. The fastest and most secure browser, all things being equal
4. A newly branded networking site which is not going to kill Facebook. It is different. It functions in a different realm and it will be as successful as Gmail.
4. An already established and highly successful mapping service
5. A highly successful mobile os

Now pause for a moment and consider how many of these services you are already using. Now if you as an apple die hard supporter can be so engrossed in the Google universe what’s to stop the other 80% of the global population to adopt not just these services but also the hardware they function on?

Essentially apple is not just fighting to retain market share. It is fighting for its survival as a closed ecosystem.

Disclosure: I have, I am and will carry on being an apple hardware and software user.

A lot of these patents have nothing to do with physical attributes of the device on question. Much more likely that these are patents related to software functionality.

I give it another year before apple loses market share

Mmm, no, this lawsuits are about physical appereance of the device

Actually they were the first to come up with that form factor.

The form factor being a thick black bezel on touch device. No one else had done this before and everyone else has since.

Really? Are you sure?

It may no be touch, but the 'form factor' is there.

This Philips medical pen tablet came out in 2007. Rounded corners and black bezel anyone? Should Philips be suing Apple? By the comments left here by those who support Apple's current litigation insanity, I'd say yes.

So they should just lay down and let others take off with ideas they see as being theirs, much like what happened back in the 80s?

I agree that the way Apple is doing things now can and does feel a bit dirty™, however I commend them for actually trying to protect what they perceive as being their invention / property. In some cases I think they are going about it wrong.

I still feel that we have the same Apple from 1984, they just happen to be showing their teeth a bit more during this round.

I am not 100% sure, but I believe a few Paceblade medical tablets even predate that one.

I agree however I think it has more to do with Steve Jobs having more say in the industry. The man is brilliant but hes also a megalomaniac and it shows. I wish Apple success however not at the expense of the rest of the industry.

i dont wanna live in a world that lets u patent "slim design" and "colored icons"

You do know it's not about patents, right? I disagree about Apple's actions here but I cringe everytime I hear people describe this and the Samsung deal as "patent" thingies.

Where the US patent system is screwed up the EU is obviously in even worse shape. A patent should only be issued for something that is a breakthrough not just a common-sense, good idea. Just think of all the products we all use on a daily basis that look basicly the same as every other item item that does the same function. Flat-pannel TV's is most likely the biggest one. Or the computer monitor you are looking at the read this. Then we have digital cameras they all look mostly the same. What makes these products different is what is inside them not what we see on the outside. And allowing patents on the way a product looks is just dumb.

You're failing to see that ad in the proper context. The "dictator" in the ad wasn't Microsoft, but rather IBM (note the blue-ish hue to the figure on the screen which is often thought to have been a reference to IBM's nickname "Big Blue.")

Secondly, the ad was referencing IBM's domination of business at the time and the lack of regard tech companies had for the slowly emerging area of personal computing--something the debut of the Mac rectified almost overnight. Apple is still serving the personal computing customer better than anyone out there right now. IMO, they're still on point with that 1984 commercial better than anyone else. Not sure why you're so eager to flip that scenario on them just because they've finally had success with it.

Dont forget MSFT. Regardless of how much crap we might throw at them, they own the pc-market, and people - believe it or not - trust them. Brand recognition is a huge factor.

1) Bing. Sure, its not as good as el goog, but the way its integrated in wp7 is nice. Add Nokia maps and navigation and were pretty much ready to go. All essentials are there (although not globally), and good-enough by all standards.

2) Cant say i like Live, so ill keep my mouth shut about that. But - MSFT has a significant share in both Facebook AND skype. Deep integration offerings will always trumph everything else in the long run. Not only does it open for better user experience, it opens up new dimensions as far as innovation and generativity goes.

3) IE9 seems nice, and does HTML5 well. HTML5 will be huge for apps (as its theoretically platform independent, giving clear incentives for developers).

Sidenote: The way things are going Apps (in general) are likely to get commoditized for various reasons; i.e. Apps will become an industry asset. (HTML5 will boost that process).

Could add some other stuff (like the convergence of platforms, taking off with Win8), but i wont. Waste of time, on these boards at least. Just saying, i wouldnt be surprised if the "Wintel" of this century will be "Winokia".

I agree with your final point. It is a hard line, and I am not sure what Apple's feelings are with regards to the industry pushing forward. I have always wondered if Woz was in some control of the company, if he would push for a more cooperative relationship with other companies, as opposed to competitive.

That being said, some within current Apple circles still feel that google took unfair advantage of their close relationship with Apple during iPhone development, to get a head start on Android. On that subject, I have no opinion to give, I wasn't in either company. ;) .

What more do you want from the market?

Samsung Tab 10.1 has a larger screen, better camera, and cool ass operating system.

Motorola Xoom is blazing fast.

Acer has a DUAL screen tablet.

Until Windows 8 releases (supposed ARM support) and we start seeing Windows 8 tablets, then not much is going to change.

Also, on a side note, I bet apple is chasing them down, simply because they have a shiny black bezel. Big whoop. In no way has the Xoom slowed down iPad sales. If people want an android tablet, then that's why they are going to get.

Lets not fret on small cosmetic features. It cost more to sue Motorola then it would if you would let it go and maybe lose 1 - 100 ipad sales.

In practice, the Xoom is considerably slower than an iPad or an iPad 2, you have not apparently used any of them. I believe your cool ass operating system comment is a little silly. It is an operating system that is extremely error prone and with little to no App support. Cool stuff.

I had the Xoom for 2 months before selling it for an ipad2 duo the Motorola’s poor product support outside of the US.

The Xoom have complete different hardware (screen, ports ect) and software (stock Honeycomb) compared to the ipad. Also the two piece metal and rubber design of the Xoom looks nothing like the ipad.

I'm getting pissed off that Apple is try to decide on what tablet I can buy at my local electronic shop. At this rate I'll not going to spend anymore money on Apple products to fund their trend of stupid bullying.

Can you imagine one laptop company suing another one for have a laptop that fold together, have a screen and keyboard.
