Can I just point out that Apple clearly believes that HSPA+ does not fall under the 4G umbrella. They clearly accept that 4G access is not available outside of AT&T and Verizon (and the three Canadian carriers) on all their iPad pages worldwide...

By their own definition, Apple accepts that 4G access is not available to those purchasing an iPad which is 'WiFi + 4G' in Australia.

So to all those yakking on about how the large HSPA+ networks in Australia technically mean that Apple does off 4G -- you're wrong.

Apple should not being marketing this product as 4G, then taking that entire element back in their fine print. By their own admission, 4G is not supported in Australia, so therefore saying loud and clear that it is is misleading and deceptive.

Go for it ACCC.

Then the ACCC should take this up with the ITU.

[/B].

Excellent point that I dont think anyone had made yet.
It is rather pointless to say techically its 4G if apple themsevles say in the small print that they do not conscider that it is.

dont worry Australia

the USA doesnt have 4G either

Verizon and AT&T just rebranded their "3G" networks as "4G"

they claim speeds of 20mb up and down

however proper 4G is 100mb mobile and 1gbps stationary up/down

Yet as advertised by apple it can connect to 4g networks when travelling to america. The feature exists but their carriers don't support it.

Just like many in the UK don't support features like visual voicemail.

Technically since they said "4G connects to fast networks around the world" and it didn't say Australia specifically I think they are in the clear.

What makes you think everyone travels to america and that USA + Canada equals "around the world"? The world doesn't revolve around USA

Don't advertise it as 4G capable if 4G is not available in that country. Simply put 4G is only currently available for iPad in the US and Canada and should be advertised as such. Otherwise this is just false advertising and now amount of small print can make up for that.

That is what they have been doing the entire time.
You can also connect to the 4G LTE networks of AT&T in the U.S. and Bell, Rogers, and Telus in Canada.

Never said it revolves around the USA, even you said "USA + Canada".

And yes anywhere but where you are can be considered "around the world"

People want to sue Apple for anything these days. We can bank on the fact that a lawsuit will come from this. This is just ridiculous  Does that mean if someone buys an iPad and doesn't have a wifi network at home they can sue Apple too???

WiFi is a standard all over the world much harder to sue for that.

4G which was suppose to be a standard is now who knows what. Apple need to just pull 4G from Australia and move on.

Good. Apple should be nailed for this.
Not that this is the first time Apple been hit with misleading advertisements.
I hope they get slapped with a rather nasty fine over it as well. The only country that Apple should even advertise the 4G part is in the US since that is the only place it works.

You're on an Apple forum discussing the Apple world. In the Apple universe, the world revolves around Cupertino, CA. Don't get all United Nations on us, that's the way it is.

Right! It's Apple's fault that the telecoms around the world can't decide on a common world standard. This is the main reason Apple hasn't put 4G on it's iPhones. Making a single phone that will do everything for everyone is too darned complex and costly.

And that is not true, it is not just the US.

I'm not sure this is relevant, but where I live, 4G on this iPad is also not available. However, on the Apple site marketing the new iPad, it tells this in a footnote for the text explaining the networks it supports. Fixing the URL a bit, it seems to do this on the Australian website too: "*4G LTE is supported only on AT&T and Verizon networks in the US; and on Bell, Rogers and Telus networks in Canada. Data plans sold separately. See your carrier for details."

I guess that's not good enough when they boldly market it as having "WiFi + 4G" and I guess I could see their point. They could perhaps tone down the "4G" part but the problem for Apple is that marketing it as "WiFi + 3G" in the rest of the world would be claiming it as capable of less than it's actually supporting.

Simply a conflict on what the world supports vs what the device supports, outside of the US that is... :p I understand both how Apple see this, and how the regulators see it.

People where bitching about 4G how Apple was not bringing it out, this is why most places just won't get 4G at least not yet.

Spoken like someone without a clue hehe :D

Now that the heat issue has been squared away, we see what the next thing to latch on is.

Apple advertised 4G and it's not "real" 4g!!! hehe :D

Wait, so you don't want an
iPhone 4S (CDMA)
iPhone 4S (GSM 1)
iPhone 4S (GSM 2)
iPhone 4S Skyrocket
iPhone 4S Epic 4G Touch
iPhone Captivate Slide
iPhone 4S LTE
iPhone 4S HD LTE

Therefore before Apple will release a new product in Australia, it will be delayed by months to get its marketing checked and okayed by some lazy dude... GREAT!

Nope. No need for that. These bodies already exists and they are working. This is exactly what is happening in Australia in this case. Apple got caught with false advertisement, the problem will be corrected and the consumers will benefit.

It's not a "not "real 4G"". It's simply not a 4G.

The term 4G should be removed from all carriers. It has become meaningless. It's either a 3G network, or an LTE network. There is no 4G.

But people wanted their make believe 4G world. This is what happens when a company comes out with bull, Android market and just to keep people quite happy 4G is introduced but it still means squat in the real world. Welcome to human histrionics.

The problem is Apple tries to force it into a single standard. The other companies figured it out. The smart solution for Apple would be for the phones is to make different phones for different parts of the world. I would not be surprised if they do it for the next iPhone as the LTE is a complete cluster **** world wide in frequencies.

I was just about to send this in as a tip.

Good on the ACCC, thank you for actually sticking up for Australian consumers.

Apple simply cannot market the new iPad as being 'Wi-Fi + 4G' in Australia as this isn't the case. It's incredibly misleading. The only place the 4G or LTE labels should appear on the Apple Australia site is in the fine print, mentioning that it can access such networks in the U.S. and Canada, otherwise, they simply should not appear at all.

Btw, no one markets HSPA+ as 4G in Australia, only LTE.

That's right. In Apple's world, no consumer should have to do their research. They should simply be hand-held and have their *ss wiped for them, too.
