Also, some stores are not "receiving" their shipments into the stock system until it's closer to when they open to avoid this issue. So you may get lucky if your local store has shown no availability.

I too am seeing taxes that are too high. I bought the 32gb model for $299. My tax rate is 8%. With the contract free price that best buy lists of $799, (which is $50 higher than apple), the tax should be $63.92.
I'm printing out the apple store shopping cart showing the correct tax amount and bringing it to bestbuy when I pick up the phone. hopefully, they can make an adjustment.
It would require you to return the next day and return and repurchase the phone.
Is there any downside or problems to doing this, and with the same item, return and repurchase at the early upgrade price? I can't imagine so...but just not sure.
Would I be able to price match the iPhone 5S by calling Best Buy today and having them credit the difference of $50 since they charge $50 more than apple.com and at&t.com for the full contract price? Would they be able to do this after picking it up.
It should not be an issue in your case because there was no contract tied to the phone. However, if it was reversed, you could have an issue. Once the IMEI is activated under contract, the phone can not be immediately resold upon return.

Ok, about to do this then, thanks for your help. And would there be any kind of restocking fee with the return and re-purchase?

There is no restocking fee. However, if you want to be absolutely 100% safe, leave it sealed until you go back. You don't have to wait till the next day, I'm just preparing everyone that the system will be slower than normal.
There's going to be a lot of disappointed people that are doing this.
Not trying to be negative, but last year some stores didn't get their second batch for 3-4 weeks! Some took 6 weeks to get 64gb models. Your best chance of getting one at Best Buy will be today!
My local region now reads In-Store only. No more online pickup option.
Ordered one from Verizon earlier, and then cancelled that due to the ability to order from Best Buy on release date. I am going to be extremely disappointed if Best Buy does not come through. We are not able to cancel orders in the Processing Order state.
