my original bluetooth apple mouse works fine with the macbook and the bluetooth mighty mouse works great on a friend's intel imac!
i installed the new apple mouse software on both intel machines - if anyone else is experiencing a similar problem, please chime in!
if it's a driver problem, i hope apple posts an update soon. i was looking forward to messing around with the new mouse tonight, back to the regular wireless mouse for now...

The Mighty Mouse Tech Spec web page indicates that the System Requirements are Mac OS X 10.4.6 or later.

I paired the one at work without installing the supplied driver, and the speed was great even better than my Microsoft Bluetooth Mouse.
I subsequently installed the driver (which required a reboot) and paired the one at home. The tracking is HORRIBLE you can barely tell the Fast and Slow settings. The Microsoft and original WIreless Mouse work great......
