so you ripping off an ATT customer by not returning a phone makes it better somehow?

How is he ripping them off? They bought a 16GB and resold a 16GB. So it happened to be a 32Gb...but the seller didn't lose any money.

But I still think buying unsubsidized when a subsidized option is available is nuts.

This iPhone 4 was not purchased from a reseller, but a At&t customer looking to make a quick buck.

Whoa, this thickens the plot. So sarcasticdesign cannot be the seller....The guy who's been on here as the eBay "seller" has been implying the whole time that he's a legit Apple approved reseller (with his whole iPlastic bit). So why didn't you say this sooner when he was trying to justify the mistake to you (in hopes of swapping it)? Wouldn't you have pointed out this obvious incongruence other than in a mundane response to someone arbitrarily trying to sum up the story?

You also said explicitly earlier that AT&T did not play a factor in anything. Well now that you are saying you bought from an AT&T customer "lookin to make a buck" it might indeed play a factor depending on how the seller (pre)ordered the phone (through Apple or AT&T).

Hmm..

I'm not "locked", I can cancel and pay the ETF. After you consider the fact that it's pro-rated.....I still win.....the longer we both have service...the more I save.

correct. but he couldn't do a hardware upgrade at all.

and...

$299 (32GB) + 1st months service + ETF + activation fee + tax.

that's more than $700. he paid $700.

It's not a big deal. The seller can't sell it as new anymore, so it's not worthwhile for the buyer to send it back since the seller can't make too much more than $700, and the seller would have to pay shipping back.

BARELY..but also, I won't be cancelling after only 1 month.

And if you aren't eligible for an upgrade, wait. Blowing $700 on a phone is not a smart thing to do with your money.

what if sarcastic design is the real ebay seller or his wife is the real ebay seller.

give us a link to the ebay page

Thank you, This is how I priced it out.
After thinking of all the time/gas/trouble I would go through for a iPhone 4. I decided eBay was the best bet.

You really think I would post the eBay link? So some bored fanboy can send a message to the seller?

Again, I just got VERY lucky.

And I still you think should do the right thing, not because we sold you the phone, but because you posted this, our other buyer found it, and want you to make it right for the guy who got the 16 when he paid for a 32.

You actually believe there is another buyer? It was a fake post to make the OP feel guilty.

I think the OP should just feel foolish for throwing away money. :p

I thought you already admitted you weren't the seller? Anyway, my solutions are really your best options if you are the seller.

My bad. I must have missed that. If it's the ebay sellers fault well then that's the cost of doing business especially if he himself doesn't catch it and is just trying to make a quick buck. If the seller paid for a 16GB one himself then it's Apples mistake they are out the roughly $22 which is the price difference between the two flash chips.

Life's not fair. Good grab OP :)

I agree.

I just reset my MBP and turned the iPhone 4 on/off and reconnected it to iTunes.

It's still showing 29.06.. So i'm pretty sure it's a 32GB.

I would have kept it as well. The seller advertised it as a 16gb sealed, never opened iPhone 4. As far as shes concerned, she sent what was advertised. If it was opened and repackaged incorrectly, well, that becomes the sellers problem. If selling something that expensive, she should have been more careful. Now if she advertised it as being opened for photographs and OP received a 32 instead of the 16 and another buyer received the wrong phone, the right thing to do would be to return it.

Sounds like it was more of a packaging error on Apples part. Under those circumstances, no way in hell I return it.

that doesn't mean anything.

he could be on tmobile and went to the AT&T store (which is probably OOS), and did what i suggested. instead he saved some money on eBay and got next day shipping.

btw, why are you so concerned with what people waste their money on? let him be, if he wanted the iPhone 4 now, then let him have it now. for all you know, this guy could be loaded and money may not be an issue in his life. $700 to him could be $7 to us, who cares.

OP, keep the phone :D

Not concerned, just stating my opinion. And most "loaded" people don't get that way by being stupid with their money.
