No, it's not a feature, that's the whole fracking point. Apple designs it with a purpose in mind, and with use cases. It is not designed to be dropped. That is not a feature. Same goes for your laptop, your glass cup, the list goes on and on. If you use your device in a way it's not meant to be used, it may end up in a state that it was not designed to be in (i.e. broken).

Just because your kid throws a baseball through your front window does not mean the window pane has a design flaw.
Just because your kid drops your electronics onto a hard surface does not mean the electronics have a design flaw.

Are people just being argumentative for the fun of it today, or are they really this dense? :(

3 feet huh? Same height I dropped a blackberryback in 2004 when I was with Cingular wireless. They wouldn't do anything when the color screen (a new feature for Bb) shattered. I explained it was such a little height it didn't make sense. I was told anything over a foot was forceful and not covered by warranty. I sold it to someone for parts for $50... Lost $275. My iPhone is great. Dropped it even higher. Never breaks

I say government should get out of the way and let Darwin work and let the strongest of the species survive! It's no wonder we have the same dolts elected time and time again to Congress thanks to Congress propagating laws to protect the dummies that vote them back into office! I see their game! :D

Yes, America is really stupid in some ways, one of them being that you can sue for anything (ever heard that Weird Al song IM GONNA SUE?)

A cellphone is a mobile device, to be used when you're on the move and you basically carry it around with you everywhere. It's therefor handled much more than any other device or object (unless you're an compulsive w*nker). A lot of people will drop their phone and clearly :apple: neglected to take that into account when designing the device.

Still, Apple is being kinda cheap with this fragile glass stuff. It looks cool and breaks easily => money.

However, if you get a case like SANE people, it won't happen. About half of the kids at my school who have iPhone 4s broke them because they didn't have a case, and that was when the cases were free! :mad: Most of them broke the iPhones on our retreat (kinda rough camping trip). I feel no sympathy for people that stupid. :)
 
Guess the girl was holding it wrong. That's why it got dropped :rolleyes:

Mine's taken an unfortunate tumble or two and it still looks new. I also have it in an Element Vapor case and Invisible shields front and back so that may be a reason the glass hasn't shattered yet?
 
What a jerk. This is such a waste of time and money. If we all cried like this our country as we know it would come to a stop. You know what... my brand new vehicle doesn't get the mileage that the manufacturer says. Must be their fault... I'm going to sue. What a joke! Take some responsibility dude.

Apple should sue back for wasting their time. :)

there should be a law which sends people and the lawyers who make stupid lawsuits like this to jail. they are wasting tax money on these cases.

It already been shown by multiple sources that the iPhone 4 has a much higher than average breakage rate than other phones

I fully agree, but that doesn't mean they should be sued over a bad choice of materials. People knew it was glass when they bought it. They knew it might be a poor choice of materials (and that if they bought it they should get a case to protect the fragile phone). Honestly, I like my glass phone *shrug*. And with a case it's actually managed to endure a few drops, even one or two on the corner, with not a scratch.

What I would say the people suing might have a case is if they can prove that Apple was misleading in trying to say the phone was a lot more durable than it actually was. Or rather that Apple led them to believe the phone would be able to take those drops. But they'd have to prove that Apple's ads were misleading enough to reasonably say the customer had a right to think the phone's glass was special enough it could withstand a drop without breaking.

Yeah, that the problem - only the dumb ones that make all the noise are heard around the world, the smart ones are not 'loud' enough. Very sad.

But honestly I'm shocked how many people in the forum think this guy is right with his lawsuit - but than, I guess those are mostly apple haters and android fanboys that would do anything to bash Apple - this is sad in another way.

Nope, you know, I payed attention in school and real live experiments as a child and I learned that things made out of glass break when you drop them on hard surfaces. Based on the experiments made as a child, I also learned that you don't give you kids expensive glass objects, because chances are they make the same experiments. People, please use common sense

Where do you see the government getting involved in this? It is a private citizen suing a private company.

Yes - way to easy to make stupid lawsuits and no punishment for wasting time of the courts and therefor money from the government. Stupid things like this should be thrown out right away with a big fat fine. Everybody (in the US) is paying the bill for the stupidity of this guy.

Post here as a News discussion a while ago. iPhone 4 was having a much higher breakage rate compared to other phones and previous iPhone.

It was a few months ago but it was posted by one of the insurance providers.
