I agree with most of everyone here seeing after the update, i.e. while you had a duty to say it was 3rd party in the ad, the buyer is now being unreasonable in his demand.

I think the cleanest option which eliminates the buyer's warranty argument is give him $ to buy a new HD which itself will carry a 3-5 year warranty (so it will be at least if not longer than his AppleCare coverage for the entire laptop). From your post, it reads like the warranty on the drive he currently has will run out before his AC runs out.

But, he either has to send you the drive he currently has or you agree to deduct the value of the old drive from what you're sending him so he can keep both drives. He paid for 1 drive not 2.

In my case, I initially got shutdown by PayPal, but then I went back to the Genius bar and had them note on their Genius Bar/Apple letterhead that the laptop's AppleCare was not applicable to the installed HD and RAM since they were both 3rd party. The seller had since closed his PayPal account, so PayPal used a collections agency to find him. This was in the 4th month after my purchase, it took another 2 months to get it resolved.

It appears he is either lying, or he hasn't registered it yet.

Call apple with that Serial, ask if it's covered by AC. 1-800-MY-APPLE

Okay, I will after work.

BUT.....since the warranty was set to expire May 31st, wouldn't he have had to register AC BEFORE the 1 year warranty ends?????
 
He's trying to hustle you with the AppleCare story, tell him you've already given him the option to have the drive replaced through Seagate, and he can do whatever he wants now because you're done.
 
Here's what I just sent him:

"Apple says you don't have Apple Care. I'm not going to pursue this any more.

For the Seagate drive, all you need to get it replaced is the model number and serial number. No receipt. I won't go back and forth regarding my ad. The ad stated everything was under warranty until May 31, 2011. That statement was 100% true."
 
His reply:

The ad didn't state that there was any 3rd party hardware. If you didn't state anything then we assume it's 100% genuine. If you would have stated it had 3rd party hardware I wouldn't have purchased it and it would have made the computer worth less. If you do not want to come to an agreement I will be forced to do a charge back for the full purchase and the computer will be returned. It's your choice. You have by 5PM mountain standard time today to decide

Tell him to do whatever he's gotta do, he's acting like he's in some power position when he's not. He paid through PayPal(right?), so you're good.

I would add something about what he can do with my left..well, never min that part lol.

lol, yes, through PayPal. But if his CC card company comes after PayPal, then they'll come after me....

Then stop complaining. Either stop being a push over, or do what he asks. Moaning and whining and not doing EITHER things won't get you anywhere. I don't see why this thread has gotten this long. Just pick one route and stick to it.
 
So this was sold in March of 2011. Today is August 29. Counting only the full months passed - April, May, June, and July - that's 120 days since you sold it.

Even if he didn't receive his CC statement until May, that still puts it past the 60 days he had to dispute the charge. At least in CA (PayPal's HQ is in San Jose) .

You don't need to respond to him any more and PayPal will reject any sort of charge back to them due to the length of time. Hell even his own credit card company might reject it due to the length of time.

Paypal will tell the CC company they're SOL, it's not like when a CC goes up against some random person w/o a team of lawyers, PP doesn't have to bend over and take whatever the CC says.

Don't be. He had enough time to get things checked out and covered and it looks like he lied to you anyway. He is trying to get over. So, let him try to get the charge back because the CC company will deal with the vendor that charged the credit card which is PayPal, and they already rejected his case. All that is going to happen is them telling the CC company that they rejected it on such and such date because it was too long ago and the CC company will simply tell him he is SOL.
 
i'd feel the same way. :eek:

when i sold my laptop i made sure to mention it was upgraded ram/hdd.

realistically though, it worked when he got it and that's the end of it. as a result of you not fully disclosing all info, i'd do what acfusion29 said and send him the warranty info + your receipt or something (if necessary) for warranty claim. :cool:

From your post, it sounds like doing the manufacturer exchange thing won't be too painful. Tell him to back it up now, and contact the manufacturer or place you bought the drive....
 
If the HD is completely non-bootable, then as a buyer I would be pretty upset due to the loss of usage. And the buyer shouldn't waste more time in trying to fix it, since he bought a "working" model from you. While I do think you don't have to do anything since it is outside the 60 day window for returns/refunds, you should still let him choose between replacing it with a new HD from Seagate or stock as good gesture. And have him return the broken HD to you. Make sure you let him know that you don't have to do anything, but you are doing this as a good gesture, so that he can shut up about further complaints/threats against you. If I were him, I would choose a new ___GB 3rd party HD and be done with it.
 
Seriously man up and send him the hard drive or resolve it.

It is YOUR obligation while selling a product on ebay to be 100% clear about what the buyer is getting. You are the one in control of the product. Only YOU know the issues. The buyer should not have to take a gamble.

I love how everyone is saying the guy sounds like a dick and other nice things when YOU are the one being fraudulent. Just because everything was "technically" under warranty, it wasn't through Apple. That is withholding valuable information right there. The buyer assumes everything is on the up and up unless it is mentioned. They should not have to seek out any other info.

Let me put it to you and everyone else that feels you are in the right here, like this: What if Apple or PowerMax sold you a used or refurbished model and it had the same issue. And you bought applecare and all that and a few months later you went to go get it fixed at apple (duh), and they told you you can't because of said drive. What would you do? 100% of you would contact Apple or PowerMax and DEMAND your money back or the issue resolved. But somehow this seller should not have to worry about it?
