I don't understand why they are being sued when it's been said that it will be available late summer.

It's not late summer yet.

It's a good thing that "late" isn't something that can be measured. My definition of late summer might be the start of August but if AT&T's is September 20th, then I guess they haven't failed to come through on anything yet?
 
This is almost as pathetic as lawsuits against McDonalds for serving hot coffee.

I am aware that no one will probably read this (or care), but heregoes:

This story about the McDonalds hot coffee has been blown out of proportion by the media and popular culture. The woman that was the plaintiff in that suit suffered third degree burns on her genitals. McDonalds had, at the time the accident occurred, received several complaints and knew that there was a problem. The woman was actually severely injured. McDonalds continued the overheating of the coffee to save a few bucks despite knowing of the potential and history of causing injury.

But now, years later, it's usually used as a comparison for a frivolous lawsuit. Which is really too bad.

The basis of this case is False Advertising. During the 3GS Launch, Apple and AT&T heavily advertised and touted MMS on the iPhone 3GS and 3.0 Software Updates. Customers who had never had an iPhone before and who were unfamiliar with it, saw the MMS in advertisements and on the Apple website and went and bought a 3GS only to find out that it did not have MMS. That is False Advertising and that is what the lawsuit alleges.

Apple has NOW added "MMS support from AT&T coming in late summer" to all of the images on their website, but back during the 3GS release, they did not have that on their website. Here is a screen shot from back then. I will see if I can find any more. If you go to Apple's website, you will notice the different font and how the statement is in text instead of image and a different font. It was obviously added later.

Update: I'm over it. It's not worth my effort to try and find evidence. Let the courts decide it.

Every add I've ever seen (Print or TV) for the 3GS had the disclaimer about MMS.


As for the McDonalds lawsuit, the old lady didn't get millions. After McD's appealed, they decided to settle out of court for much less.
And there was a warning on the cup... just too small I guess.
Although I would like to know how insufficient the word "HOT" is.

Like a cup of coffee needs a warning in the first place. :rolleyes:

I also made this point on page 2. My point also was who gets 3rd degree burns from coffee. This lady had surgery to repair the damaged area, so no coffee should be this hot at all. I spilled coffee on my arm once and was freshly made and my arm was jut read for a while.

Wikipedia is not a reliable source at all for the fact anyone can edit it. Again if you get 3rd degree burns from coffee and need surgery, what does that tell you.. the coffee was boiling hot. Who drinks boiling hot coffee?? If you need surgery from a spill like that, there are issues with that coffee.

Edit: I agree about the email, but not everyone can receive email on their phones, or if they can, they don't know how to send emails. Threads have discussed why we need MMS, but there are always going to be different camps on this.

Who cares about any of that crap. Use your phone to make calls and email to send images. That is what it is designed to do. :confused:
 
well as far as coffee goes.

When I order Coffee common sense tells me coffee is HOT! This same common sense tells me not too put HOT things between my legs! :eek: as far this lawsuit dumb waste of time that will probably help delay MMS even more for what ever reason. :rolleyes:

Don't single out Apple with your a la carte complaints; NO ONE does that on contract, so complain to the entire telecommunications industry.
 
Summer ends like September 22nd. I get the feeling that some people are so impatient about a feature that they won't need, that they'd be willing to throw a month and a half of their lives away just to arrive to the exact date on which these features come out. Soon enough a lot of people will use smartphones and you just email the picture and get 10x better quality with the image. MMS severely reduces the quality of the pic/vid.
 
Speaking of this, that lady got MILLIONS of dollars because of this. I took a BLAW class last month and we talked about this. McDonalds lost millions because they forgot to warn customers on the cup that the coffee was hot.

Ridiculous.

A canadian responds

-- ask a Canadian what kind of service they get for $70 a month. I've had Sprint, AT&T, Verizon and T-mobile and of those, AT&T has so far offered the best service for the price in my local area -- all the more impressive considering how far behind their network was, and the millions of new bandwidth hungry users they had to support along with the iPhone.

As a Canadian for my $70 dollars a month I get a good voice plan plus 6GB of data, my MMS and tethering worked on 3.0 launch day, my data download speeds are roughly 2-3 times the AT&T standard, and I have never had a dropped call on my iPhone.

Answered.
