Industrial espionage is normal thing maybe apples HR need to dig into background a little more on sensitive projects even if the diversity quota box needs ticking

So has he been to Court and entered a guilty plea, or does that not matter in trial by internet?
Apparently reading the freaking article doesn't matter when it comes to writing internet comments.

In a second interview with Apple's security team, Zhang admitted to taking both online data and hardware (a Linux server and circuit boards) from Apple during his paternity leave. He also admitted to AirDropping sensitive content from his own device to his wife's laptop.

A foreign national in the US is expected to follow US laws? Does that expectatoin apply to US nationals who go to other countries?

There is no such thing as off hours in Silicon Valley :p

UBA system (if Apple) has it should have caught or at least flagged this activity. Nonetheless, Apple did very well as compared to many other firms, the moment the saw some red flags, they moved swiftly and took assertive and prudent actions.

Of course you are not just "expected" but required to know the law of the country you are in and to follow it.

Ignorance of the law is not and in this country at least, will never be, a valid defense. It's your responsibility to learn what is legal and illegal where you are working.... 99% of those questions are satisfied by the simple "does this sound like it would get me in trouble" litmus test.

Why was he allowed to download trade secrets. Surely this stuff should be read only with no option to print, copy or email.

No alternative. How many Americans enroll in graduate school in science and engineering? Probably can be counted on one hand. The key is to have more Americans to study engineering. I'm not sure how that can be achieved.

And how much are we doing to encourage American students to pursue those careers or even offering additional financial incentive for them to do so?

Instead we are packing our graduate programs with foreign nationals who in many cases are in the US on programs from their host countries that pay for their entire education....

US industry "wins" because they can usually hire these people at a lower wage than an American citizen and the foreign nation wins because they get someone educated at a top school who learns a ton about industry and will eventually bring that knowledge home to help them better compete with the USA.

It is short sighted thinking.

We should welcome foreign students to our universities but we should prioritize Americans going down those career tracks instead of the Fed underwriting low interest loans for American kids to go to expensive four year colleges, party their asses off and get a degree in something worthless like Communications or basket weaving and then whine whine whine about how they can't pay off their student debt and how they need a $20 an hour wage working at Starbucks.

The article states that Apple has file security that requires special permissions in order to work with those files. Security team would also get an audit of user's activity in those file systems such as copying files to other media.

More than likely it was this security that tipped Apple off in the first place that this guy was trying to rip them off.

Wow, you're a man with real empathy! We are talking about a human here not a dead product! Amazing how things are being worshipped and humans are being used these days! What a greedy world!
So its ok to steal someone else's inventions ? Why dont you invent something for a change which could cost you a fortune, and then see it being stolen by someone, then see that someone makes a ton of money using your invention?

Honestly, there's a lot of spin on this. I wouldn't be surprised if they found something to nail him for or if he's able to defend himself.

Look at this,
The Washington Post said:
Records and closed-circuit TV footage also showed Zhang entering the autonomous car software and hardware labs on April 28, documents state. He was seen leaving less than an hour later carrying a computer keyboard, some cables and a large box.
That's nothing. That is typical behavior for somebody that um, I dunno, got fired. Pack up your things and leave.

There are tons of studies related to penalties as a deterrence. Most agree that longer/harsher penalties aren't really a deterrent. Here's a short piece from the National Institute of Justice.

I will disagree. It's not about deterrence, or recidivism or anything like that. It's a punishment. You do this act, and this is the consequence you can expect, whether one thinks that's worth doing the crime or not.

Regardless of his sentence, it's safe to assume his life career path is over. Don't think for a minute Apple doesn't insure this follows these people the entirety of their natural lives. As it should. :apple:

No, he will eventually be returned to China (figure diplomatic intervention at a high level), and he will be able to work with no problems.

Yes, let's set up a Pre-Crime Division. An investigation into a person's past isn't always going to predict future actions. Based on the news stories, the guy had no criminal record.

I've been to china many times and have a ten year visa myself.... the fact is China CELEBRATES theft of foreign technology, insider information, etc. This is the way of communism.

They teach, FOLLOW do not think for yourself... it's a great way of training people to stay inline. So when they send students over to learn, they remind them, regularly, they have family back in China (i.e. You work for us or else!)

There are TONS of cases or counterfeiting (ARE YOU LISTING Amazon and Jeff!!??) American made products to simply benefit China.

Did you know, this IS a FACT, that China subsidizes shipping and it's actually cheaper to ship a product from China to a US address than it is for you to mail the exact same package to someone across your hometown! China is in it to win it and if that means lie, cheat or steal it will do it!!

Of course Xmotors denies any involvement with the guy...
But we'll see if in the future Xmotors will release any research/development/product that in fact use Apple's IP.

I'd say Apple's physical security protocols are weak. I work for a company similar size to Apple... and I'm a very privileged employee who can access important data/devices but for me to actually take a company's small hardware device out of the building is impossible... let alone taking an entire Linux server... OMG!!!

And downloading classified data at exponential level compared to previous times... for a period of two weeks and didn't get immediately terminated? I'd say their cyber security protocols are weak too.

If I was working at cyber security team, unusal pattern is something I ALWAYS keep on top of my reviews at least weekly if not daily. Not only I record/review activities but also write my own program to do automatic analysis that will allow me to detect deviations.... like when someone downloads a lot more than usual... or downloading data at a rate that can't be possibly be consumed by any fast reading person.

Several thousand employees is way too much exposure on a secret project. It should be compartmentalized and streamlined further if possible. They need to reduce the number and really tighten up the ability of people to leave the building carrying hardware.

The real worry is how many competitors are trying to hack each other to steal secrets.

Years ago and I have heard it still goes on, if you sent ideas to Steve Jobs using an email with your own domain name then you would see that your site would be visited by Apple's competitors. I can bet this still goes on. You can try it now and post results or feed it to Apple. Send emails to Apple's board and check who visits your sites in the following days. It means the competitors are sniffing emails being sent to specific email addresses.

I don't know the method they use. I'm an architect and graphics designer and don't know how emails can be intercepted.

Wow, you obviously don't know a thing about the H1B program, especially how it has been abused for the last 20 years. The program had decent intents, but for the last 20 years it has been used for a source of cheap labor for tech companies.

Just search the web for "H-1B abuse" to educate yourself.

Did vladi delete his post? I was about to say his analogy of H1-B workers to top rocket scientists that were sought after WW2 made no sense. Walk into almost any IT department in America and H1-B workers are walking around.

this is exactly why I don't trust the Chinese... from their phone manufactures to people. communists will aways be stealing.

China is constantly stealing American technology (with the blessing of their government that even encourages people and tries to get them to do it), and more needs to be done about it. For one American tech companies should stop hiring so many Chinese nationals.

Why not put a travel ban against China in the name of national security? If we don't like them, ban them!

No wonder Apple wants people in that country as customers! :D

Yes, I also had one pulled from this thread. You can say H-1B, China, etc... as long as you don't "name any names".
He was partially correct in his claim that H-!Bs are "hard to get". But that has only been the case in the last year or so. Due to certain changes by <name withheld>.

Censorship is real here.

This is how propaganda and disinformation work...

Step 1: State an unprovable assumption that is designed to make the reader angry.

Step 2: State a second, unprovable assumption based on the first, unprovable assumption, along with a list of retaliatory responses that mirror a current political position that the author is attempting to justify.

Step 3: Try to get a blogger somewhere to focus on the unprovable assumptions and other inaccuracies as a way to justify a political stance, then peddle that blog to a large propaganda outlet like Fox News as a way to legitimize the misinformation.

You forgot Step 3. Maybe you're still working on that?

Yes, folks, this is how it's done.

This is the foundation of Fox.
