exactly. and just like car companies say how their cars are more spacious than their [named] competitor, or have better mileage ratings, or more horsepower . . . a commercial needs to tear down the competition while building their own product up. this is a classic contrast piece that i personally think is effective and humorous.
Personally, I find the yoga ad a bit offensive in its slamming of Vista. How would Vista mess up his Yoga billing? If MS had been as aggressive in slamming some aspect of Macs, say when 10.0 came out, or because Macs ran fewer apps, we'd have been pretty upset.The "Vista Sucks" campaign is getting a bit tiresome. Why not concentrate on how great OSX is instead? I think even my grandmother, is aware that Vista has not lived up to it's potential by now.
Can Microsoft actually take action against Apple on these ads?

no, a enterprise/company with class doesnt need to blackmail another competitor. its not about showing one individual strong points anymore...
only the weak ones need such a way of ad. (apples ads are kinda like politics... hillary blackmailing obama and the other way around, its not about who they are and what they stand for. its about what the enemy isnt)

Apple has posted two new 'Get a Mac' ads featuring actors Justin Long and John Hodgman playing "Mac" and "PC", respectively. The two new ads continues with some more attacks against Microsoft's Vista operating system, but also points out why Macs might work better:
Yoga - features Judy Greer as a Yoga instructor frustrated with Vista.
Breakthrough - brings back the Counselor who points out that PC's issues comes from having different vendors responsible for the hardware and software, while Mac's all comes from one vendor (Apple).
Apple has also continued with custom web ads which has run on many prominent web sites.

Still, if your grandma knows how bad Vista is I'd guess that's probably because of these ads, which is exactly the point. There's no one but Apple relentlessly communicating that message to millions of consumers out there.
