your best bet is to just send it in to apple care and see what they do with it.

Something just seems fishy here, as I've never had a problem with getting my phone fixed and I'm on my third 2G. One was even due to water damage, but I guess there wasn't enough water to set off the water sensor on the inside.

Additionally, I'd definitely try to get your friend to go in with it and act like it is still his. Apple, like almost every company, is much more friendly to people who actually bought their products from them.

i don't usually do this... but i couldn't resist...

Stopped working when I was collecting it from him, but I was on it a day prior to this. It was damaged first week in November...

I just said that the touch screen stopped working in one area. Which I am actually not 100% sure there was water damage, as it didn't get thrown in water or anything, somebody put a wet towel on it.

But no, never, ever say there was water damage, or mention water. When they asked what happened just say "I don't know, it just stopped working."

haha, good luck getting it replaced...

honestly, your best bet is to do what all the other guys have said, go to a different store, be nice, look presentable...

they deal with 100 a--holes a day, be the one nice one, and you might get what you want

also, the damage isn't that bad... i don't know what people are saying it's so terrible for, it's a phone, it's gonna get used and abused at least a little bit... we can't all keep phones perfect forever, scratches and dents are inevitable.

Agreed. You probably wear turned down solely because of that. I sure would have when I worked there.

You'd never guess what an Apple customer relations (I got told off for calling them customer services) agent told me today: All Apple Stores are not owned nor operated by Apple. Haha, what a joke. So actually mate, I'm sorry to tell you, you didn't work at Apple :(

Apple's retail stores (the ones called Apple stores) are owned by Apple. There aren't any franchises, they are all corporate.

Now, there are stores that only carry apple products but are not owned or operated by Apple. Washington and Oregon have The Computer Store, for example.
 
In this case the item is second hand and was bought as a private sale, not from a trader so all the goods are required to be is "as described": you don't get the same rights in a private sale as if you buy from a trader. Again, if the phone is faulty he only has recourse against the person he bought it from (his friend), not Apple.

Yeah I know, but Apple aren't voiding my warranty for that, but for the tiny dent at the top. I have checked, and they are not bothered about this.

we weren't talking about your warranty, but whether you had any statutory rights.

Either way, the end result is still the same. You're out money and a working iPhone. Sounds like you have 2 choices, either get your mate to give your money back, or pony up the cash and get if fixed yourself. Other than that, not too many choices as Apple seems to be standing firm.

How am I going to get the iPhone replaced..Apple don't offer any repair service for the 2G iPhone.

I don't know, I'm not the one with a broken iPhone. Try Googleing "iPhone repair".

Go talk to your mate. If he won't give you the money back, then how much of a mate is he?

He's not not offering to give me my money back: but where can I find an iPhone for £100? I'm not allowed to go on contract.

Whatever the outcome it seems Apple has clearly sussed you out. Hopefully you will stop trying to pull one over on them soon and stop wasting their time.

I suspect the first guy he took it to flagged the phone in their system when he saw the big dent that broke the phone. Sounds like anyone who brings it up is denying him because there are notes in the file essentially relating this guy as someone who is trying to get a phone replaced that they broke.

How the heck am I wasting there time? I'm a customer, and they are offering support. I'm not trying to pull one over on Apple: why would I do that? I'm a fan of Apple: I have a macbook, iMac, iPod, and Airport... If you look at the phone, the damage is VERY VERY minor. I accepted this, and paid £100 for it (got it reduced from £130). And it only stopped working the day I got it. And I know that this hasn't been an ongoing issue. I've been at his house before when his iPhone has run out of battery, and he's just stuck it on to charge. Get off my back.

You have no evidence that that dent caused the iPhone to stop working: And of course it gets flagged up on the system: and you can tell for a fact that the iPhone doesn't have a 'big' dent as you put it - the Genius at another Apple Store told me that they didn't even notice the dent when I showed them the photos.

So your buddy sold you a defective iPhone? Sounds like he should be the one you're mad at.
