My wife is a corporate defense attorney, and deals with product liability on a daily basis. The corporation she works for owns a very large number of diverse subsidies. I saw this thread, checked her phone and reported my findings. She wasn't terribly concerned, even as the thread grew, and this issue received attention from CNet, etc. It was precisely when Forbes ran the article that my wife declared, "Defective is defective, and I paid too much to keep a defective product."
I've seen HTC ONE reviews on youtube, and most of them had a phone with 4.1.2 installed. That might have bothered me, but 4.2.2 seems just fine to us. Verizon sent out their own update last week, and are supposed to get 4.3 sometime soon. I wasn't thrilled with iOS 7, but there are some features I like. We don't need the latest version of Android any more than we needed iOS 7. As I stated earlier, my wife is thrilled with her new phone, and had it in her hands all weekend. She didn't do that with the 5s, but that's subjective. The 5s groups pictures according to event, and so does the HTC. The HTC also has a slideshow function that automatically adds music, and can be sent to FB as a slideshow with music just by touching an icon. I'm not knocking the 5s, but this is a very cool feature. That could be one of the reasons we're not anxiously awaiting the next OS update/upgrade. We bought HTC's Media Link HD, and that allows us to mirror the phones' content onto our TV. We can stream a movie, and still use the phone's screen to read emails, make calls, etc. We can use iTunes on our rMBP to stream movies and still use the computer's screen, but that's not possible yet with the iphone or ipad. We are quite happy with our decision.
