I just worked out another reason how this picture is fake.
On the first image you can't see the speaker/camera at the top, possibly because its a bad picture right?
On the second pic even though it is a closer and better quality picture, he has missed the top part of the phone out so you don't see it.

If its real, then the square in the bottom left should show the same image as whats on the main screen. But it doesnt.
No, the square in the bottom left show the last picture you took. And that square looks green-ish as opposed to red-ish like the screenshot.

i was actually waiting for someone to notice the upside down itunes store icon, but instead, dude says it isn't 3.0... very disappointing...
meh, still totally legit... the upside down icon is the only way to tell a real iPhone Video, that and the gianormous cock-eyed camera on the top right...

The one thing I find funny about this thread, is that despite everyone trying to somehow prove that his image is fake, nobody has came up with a decent reason yet 
The fact that his left arm is holding the iPhone as well as the phone taking the picture does not mean much if the image is flipped, like others have said.
It probably is fake but I've yet to see any proof that it is.
