Apple has all the grounds in the world. Someone else is posting images claiming it's an apple product. If it has a negative effect towards the company then it could be slander.

Not only that, if you were going to say they have no grounds, don't they have to prove it? Did apple say "Here is proof that this is in fact our new ipod, now take it down"? No, they just said stop posting the image and all these sites took it down. No legal action was actually taken. If Apple wanted to sue, then they would have to show proof sooner or later.

What all has apple said to cease and disist before other than the timezone video a month ago? I haven't really been following news about apple before this year.

To answer your question, in the last couple of weeks, Apple has sent C&D's about:
- Screencaps of Build 9A500n of Leopard - on http://news.worldofapple.com
- Screencaps of new screen sharing program

I think others make good points about the file and "spy pic" themselves. I think there was more manipulation than even we think, probably to avoid having to take it down, but the core concept (intellectual property) is still there, which is grounds for a C&D.

Would Apple ask me to remove Babya Logic pictures? They might they it's theirs but I could at least prove that I own the code and images.

Therefore, it is not definite, but a valid inference that those stub nanos we saw were real or close to real. Blegh.
 
If any of you work in ANY type of advertising job, you all know the photoshop image (which I guarentee is what apple uses) has to be quite large...

Also add in that the product looks like crap and they named it "NanoFlower.PSD" ...

I am in design and advertising, so I have to volley these points back to you.

If this is truly a potential ad mock-up, then they would most definitely not be hi-res. We don't sketch in hi-res -- and this is clearly a sketch, given the unaltered shadows -- since there's a very high probability that it will be rejected along with 90% of the other concepts that are produced.

Which brings up the fact that the images are of poor quality and that the shadows are incorrect. That would be typical in this situation as well. These potential Nano photos would be provided by Apple and would be individual image files -- all shot in the same way under the same lighting -- hence the fact that the shadows are all identical. These images would be for mock-up purposes only and therefore wouldn't be of high quality -- remember, they're looking for concepts, not finished art.

And finally, the fact that it's called "NanoFlower.psd." Don't assume for a second that we're so organized and sophisticated as to name our files in some fancy way that includes job ticket numbers and such. My experience in the field hasn't been that way at all. We name our files in a way that we'll know what they are without opening them -- in this case, it does kind of look like a Nano flower. :)

As to whether this Nano is real: I can't say. But I *can* say that there's nothing definitive in this possible ad mock-up that says it's a fake.

Well, we can always hope that this is some sort of trial balloon by Apple to gauge reaction... and if this thread is any indication they will get the message that people do not approve. Alternately, it could just be misinformation from Apple to throw off the competition or to out a leaker.

You're confusing a C&D with an actual winnable lawsuit. A C&D is a threat, and is used largely to avoid going to court and demonstrate good faith on the part of the plaintiff should a lawsuit actually result.

All of which aside, I think everyone's assumption this is an "ugly" iPod based upon a set of flat grainy images photographed off of an LCD apparently with a mobile phone camera is absurd. Especially when you consider Apple has only ever produced one iPod model that could remotely be described as attractive (the original iPod nano.)

I'm listening to Rimsky-Korsakov on my 10gig 2nd gen iPod right now. The music is beautiful. The device is ugly. And somehow, those that followed in the full (disk-based) iPod line, just got uglier and cheaper looking. Apple has produced some very desirable looking hardware on the computer side of late, but the iPod's desirability has always had to do with ease of use, size, quality, and functionality, not its looks.

I'm sure that if it's for real, this new nano will do just fine. And hey, at least it doesn't have the chin!
 
Don't forget the current Shuffle. Everyone I know loves that thing for it's looks AND ease of use.

Why is it that Engadget seems to be immune from these C&DO's? They still have the iPod image up on their site, and the leaked iMac keyboard photos on their site stayed up. And I recall, tons of folks insisted those keyboards were fake at the time. You just never know with Apple.

Apple has copyrights on the click-wheel. Even if it wasn't the real deal, the fact someone made a product with their click-wheel is grounds.

Truthfully a C&D is not a legal step, the legal team is just the people who did it. There will be nothing filed to the courts about this situation and who knows what apple would do if people kept them on these sites. The way they look is so similer to an iPod in design and the click wheel that Apple can most likely have legal opposition if they wanted, but all that has happened is Apple asked to take the pics down.

Now that I know that Apple has done this before and most were real products, it kind of sucks to think this could be real, but I will keep my hopes up that this is fake and think about other things like a new operating system and maybe a full screen iPod.

It's hard for me to believe with all the products apple has released in the last 5 to 10 years being so sleek and perfect, that this would even cross their minds. I would be beyond shocked if this was really released.

Seems that Apple hasn't targeted my posting of Windows Logic screenshots (by the way, which are real:eek:f actual software that I have code for.), but target other users posting iPod and OS X screenshots instead .

As an owner of a 1st gen and 2nd gen Nano, if 9to5Mac's image is correct - even if it's just form factor - then I'd be sad because I think it's ugly.

I wonder (if this is indeed all true) if this isn't a replacement, but an addition to the line. Could it be that this Video Nano would be sold alongside the current Nanos?

Someone in the "iPod Touch" thread offered the idea that the current Nano would remain unchanged and what 9to5 is calling the new Nano would be an "iPod Mini" sandwiched between the Nano and the "iPod Touch" (which would have the same form factor as the iPhone).

I wouldn't mind this, to be honest, as it would essentially just be a shorter 5G iPod (Video), replacing the current line. The Nano would remain a music/photo-only player designed for portability and the "iPod Touch" would be the new "top of the line" unit.
 
Well apple just called engadget.com and DEMANDED the pics be taken down!

Yupp I just read it on the site. It seem like 9to5mac wasn't playing around. Things are heating up, the anticipation for new iPods is huge and I expect for info/pictures to leak in the near future.

It looks like the Nano is going to be a shortened iPod Video with flash. I wonder where this leaves the compacts Nano as we know it today, will it still exist for people who strictly want music playback?
