Ummm, it's not like Apple called 1-800-Lawyer. Most of those lawyers are apple employees, they get paid handsomely, but no where near 300 million.

the 30% or 40% are for the 'no win no fee' lawyers, most respectable lawyers charge by the hour, regardless of the outcome.

The lawyers aren't Apple employees; they are in business for themselves. And, yes, they charge hourly. There are a lot of lawyers, and they have a high hourly fee, but the pay for their work should be at or under $10 million. Which is about 1% of the verdict. (There are likely other legal costs for things like hotels and flights, though).

It is a great example. They had a difficult relationship. She learned to love him for his faults and his strengths. Maybe you should read it. Or continue judging people you never met by faceless posts on blogs.
 
All companies are entitled to make a profit of course, but wouldn't you prefer to see Apple focusing it's efforts on bringing out a better, revolutionary iPhone?

How can they focus on that unless they make a profit from selling it? If the courts let other companies sell an exact copy by another company who didn't put in the R&D money and time, how can inventors have a chance?

Have you seen a single Android device manufactured by Google? You have not. That's why Apple is not even suing Google. Google (Motorola) on the other hand is suing Apple so if anybody there will pay something it will be Apple.

Samsung, HTC, etc.... they are the means too Google. Google is the creator of Android. Apples target has always been Google. The door is now unlocked. Go ahead and keep developing Android. Fine with me. Just keep your hardware emissaries in check. :apple:
 
Makes no difference to us in Europe or indeed Asia, South America etc. Courts elsewhere haven't taken such a isolationist view so we can continue getting an excellent selection of phones. It's America's lose not ours.

An excellent selection of iPhone knock-offs you mean. Now that patent law has been upheld, we will all benefit because other companies will have to do something to differentiate themselves from Apple. Everybody wins in that scenario.
 
I think Apple should get credit where credit is due. But if you think phones weren't already migrating to full touch screen interfaces then you're wrong. Having worked in the industry several years ago - I saw several models in the pipeline before the iPhone was ever announced.

If you're talking about iOS vs Android (leaving out hardware entirely) I will say again that what exists now is a natural progression. Did Apple make it popular - no doubt. Would the industry have something iOS "like" right NOW if it weren't for iOS - no one can speculate. But given that the industry was already moving towards touchscreen phones without keyboards (whether they were released yet or not) the same would apply to the OSes that would utilize them.

Apple, when creating iOS learned from the industry. What worked and what didn't. And improved upon it - made some things "their own." In turn - they still continue to look at what the industry is doing and either adopt it or not. It's technology evolution. We can thank Apple. We can thank Samsung. We can thank Google. We can thank all the players for pushing everything forward. I don't agree that Apple is the only party deserving of thanks.

You could be right. I just remember back to pre iphone. I couldn't believe how slow the progress was for cell phones. I mean it seemed almost at a stand still from my perspective. I literally had a Nokia clam shell, or candy bar one at the time. Then I saw the commercial for the Iphone on Apples site. A company that had never made a phone before. My jaw hit the floor. It seemed like they had advanced phones 10 years or more to me. I was not in the industry so I have that disadvantage. Perhaps everyone was about to make Iphones for their next model. But it seemed revolutionary to me. It made me angry when I thought of the garbage that "phone makers" like Sony, Nokia, RImm etc was putting out at the same moment. Anyways.
 
The jury snuck out the back door. I guess they didn't want to talk to the media. I understand completely, but it would have been nice to get their thoughts, particularly given how quickly this case was decided. Something must have seemed pretty clear cut to them.

Particularly what they thought about regarding the validity of Apple's design patents.

Android is not going to die... It runs more than phones and tablets. It's working it's way into digital cameras and other devices. That being said, TouchWiz evolved from Samsung's own "feature phones" to what it is today. :eek:

Icons in general to me look the same as some used in Nokias S-60 handsets and even some from the BlackBerry Storm. If it comes down to pixel comparison (which it has, and was posted here) are Apple fans in fear of competition or is the competition not allowed to provide an alternative to iOS devices. My BlackBerry PlayBook is a 7" black rectangle. A great tablet despite a tarnished image due to marketing blunders by RIM. Had it more success, it may have been turned into Applesauce... :rolleyes:

Anyone remember the Tucker sedan or the movie? I find a lot in common in some ways. While Samsung isn't a small company, they wanted to build a better phone than what they previously had in the past. Nearly every company who builds operating systems for phones or the hardware itself has had some influence from the iPhone.

I bring the car reference here as nearly everyone knows the original Ford Taurus which was a strikingly different design than the car it replaced (The RWD Fairmont)

It differed in many ways due to the change in sheet metal and flush glass and "aircraft" style doors eventually which the entire automotive industry was turned on its ear, many competitors followed the shape and design to allow a comparable product for consumer choice.

If an idea is not patented, it is not stealing. Has Android patented the pull down notification? They have applied for a vague patent which may or may not be approved and may not cover Apple's notification system. Prior art as well.
That's not the point. The point is they point out stealing is wrong, yet they do it anyway. Patented or not, it's stealing. Remember Windows Vista copying OS X Tiger? That is stealing.

I guess what I don't understand is the gloating and cheering for Apple and the hostility towards people that like phones besides iPhones. I fail to understand how Apple winning $1 billion dollars helps individuals. Some of the responses read on here like some individuals think they actually one something.

And all the "Suck it fandroids!!!" "Stupid Android fans!" and etc type comments, I don't get it. Why make it so personal what type of phone someone buys? Does it really matter what phone Joe, Bob, and Linda are using?

I assume all those cursing at Samsuck or whatever other name doesn't own a single Samsung product?

This reminds me of my brother in law telling me I was an idiot for wanting to drive a fuel injected car instead of something with a carb. Who cares?
 
US courts and citizens protecting US interests. Samsung was never likely to get a positive outcome in Apples home territory it would seem.

A disastrous day for consumer choice in the US. Makes me thankful that I live in a nation that doesn't have such a protectionist view. I will have a better choice and indeed the right to choose, as a result of living under a court system that doesn't pander to the $ over common sense.
Oh b*llshit. You just don't like the result and so are blaming a court system which you don't even understand. Nokia had no difficulty winning when they sued Apple in the US.

Leaving aside the question of how choosing one multi-billion dollar multinational over another is "pandering to the $ over common sense," which enlightened republic do you live in anyway.

I was wrong about the Apple and Google employees making it onto the final jury:

The judge herself dismissed the Apple employee because he openly said he wanted his company to win.

The Google employee... who has a patent pending on an Android GUI feature... said he could be impartial. The judge said she believed him and overruled Apple's initial objection to him. So Apple used one of their final four dismissal freebies to get rid of him.

Another potential was the father of one of Apple's legal team. He was dimissed early after he said a lot of his family had worked for Apple and they considered themselves "a loyal Apple family".
 
The main thing to takeaway from this, which I think most people are missing is this: Just because Apple won does not mean that they will have a monopoly. Nor does it mean that Samsung has to do something completely different.

What it DOES mean is that companies will have to be compensated (via payments, royalties, etc) for allowing companies to use their technology. So Samsung can have phones that have the snap scrolling, double tap to zoom, etc, as long as they pay apple for the rights to use that (which this case shows they didn't do).

Now I'm not saying that our current patent system is amazing, but its what we have. Perhaps cases like this will spur changes for the better. However, until then, perhaps companies like Samsung and companies in China will stop blatantly ripping off Apple products and OS.

Or do you prefer to stick with your tiny incremental updates? Because that's all Apple will give you smartphone wise if the competition is not allowed to compete due to over zealous issuing of patents. After all giving the US citizen more wouldn't make them come back year after year to repurchase essentially the same product would it?

Yes I want the best phones available. Like I said, I am glad there is competition in the cell phone market. Competition is good for the consumer. I dont want Apple to get complacent, which they would if they could. I am just saying that Samsung just totally ripped off the iphone. The own inter-office memos basically spell it out. This is about justice. I dont believe that Samsung should be allowed to catch up on billions of $ in research and risk, by so shamelessly coping what Apple did. Thats all. IMO its wrong. You don't agree?

Google bought the OS from a small startup which was called Android Inc.

Handset developers can choose to use Android as the OS or go with the WP7 standards.

Patents ENCOURAGE innovation. Notice how all "smart"phones were alike prior to the iPhone. Apple created the iPhone and smartphones took a huge leap forward. Because of their innovation they have a right to be rewarded (in an effort to encourage innovation). The reward is that they are entitled to profit from their innovation. They are able to profit because other companies, like Samsung, are not allowed to copy them. This is how the market system works. If companies were free to copy each other no one would innovate because there would be no incentive to innovate. People do not innovate for innovation's sake. They innovate because they can profit from it. Being able to defend your patents is crucial to your ability to profit. If Apple had NOT won, that would have been the death knell for innovation. Everyone would just keep producing what every other company did. This is GOOD for innovation people. It's a poorly considered argument to say this kills innovation.

Really? Cause it seemed like to me it was very limited compared to my Windows PDA (of which there were many smartphones that had the Windows mobile OS that my PDA used). For one at the time you couldn't add any apps to it, you could only use what Apple pre installed. It seemed kinda silly to me.

Of course, I'll say I don't think it would have taken off if Jobs hadn't relented and allowed third party apps on it. The reason when I finally gave in and got it (cause the 3G had GPS and I got lured in by that <- I wouldn't consider it until that was pointed out) that it got so useful for me was that I could easily find apps for it that I wanted and on top of that they weren't that expensive (Or I could find free ones). Even easier than for my PDA (of which I had a favorite site to go to to buy apps).
