If an idea is not patented, it is not stealing. Has Android patented the pull down notification? They have applied for a vague patent which may or may not be approved and may not cover Apple's notification system. Prior art as well.
 
I haven't read this entire thread, but did someone actually say this? You are spot on that, without Apple, we would still be stuck with the "choice" of our favourite clunky, keyboard laden phone with miserable internet capabilities and a handful of poorly programmed java apps provided strictly by our cell provider. What a great future we missed out on thanks to Apple.

Hardly. This isn't the end of Android. If anything, Google and others will work even harder to differentiate it from iOS as a result of this.

The people that did similar notification systems before apple did not patent them either. That is why they are prior works to Apples patent and that is what makes Apples patents invalid and then Samsung have stolen nothing from Apple.

They won't look at whether the Nexus S does or does not have a bounce back feature, or whether the Tab 10.1 violates the iPad's trade dress. They will consider whether the denial of admission of evidence was permissible.

Perhaps, if the appellate court rules that a) the evidence should have been allowed, and b) that it might have reasonably swayed a jury. My guess is that it wouldn't overturn the whole thing, but that it could result in significant portions being reconsidered, if the appellate court overturns the judge. Most of the damages were for smartphones.

This doesn't create a monopoly. If Samsung wants to continue to make sales they are going to have to innovate themselves. That, for the consumer, is ideal and a win-win situation.
 
Jeez, I didn't know you could be a fanboy of a multibillion dollar international corporation until I joined this forum.

I cant speak for you, but Apple saved me from clam shell phones and Blackberries. That is my loyalty to them. I hated my Nokia clam shell!!! :p
 
The jury snuck out the back door. I guess they didn't want to talk to the media. I understand completely, but it would have been nice to get their thoughts, particularly given how quickly this case was decided. Something must have seemed pretty clear cut to them.
 
Apple deserved to win - any reasonable person can see that Samsung copied the iPhone. I'm so glad that legal process didn't get in the way of common sense here as is often the case.

To those complaining about smartphones getting put back 5 years, that sounds about right because that is about as far forward as the iPhone brought us when everyone started copying it! In reality it won't be as bad as that for competitors anyway but maybe they will have to actually put in some work and come up with some original ideas in future.

THAT is what will ultimately benefit consumers.

But - let me ask you this - sincerely. Do you believe that Apple is entitled to 100% of Samsung's profits for the phone for a handful of patents? I don't think so. I'm glad Apple didn't get the 2+ billion they were seeking. They didn't deserve that much. They deserved something. Just not everything.


I'm not saying what I think they deserve or don't. I think its good their is competition. I would hate it if there was no comp for Apple. I'm just saying these people and their retarded "big strike against consumers", "Samsung didn't totally reverse engineer and rip off the Iphone" are just so dumb that it hurts.

I think Apple should get credit where credit is due. But if you think phones weren't already migrating to full touch screen interfaces then you're wrong. Having worked in the industry several years ago - I saw several models in the pipeline before the iPhone was ever announced.

If you're talking about iOS vs Android (leaving out hardware entirely) I will say again that what exists now is a natural progression. Did Apple make it popular - no doubt. Would the industry have something iOS "like" right NOW if it weren't for iOS - no one can speculate. But given that the industry was already moving towards touchscreen phones without keyboards (whether they were released yet or not) the same would apply to the OSes that would utilize them.

Apple, when creating iOS learned from the industry. What worked and what didn't. And improved upon it - made some things "their own." In turn - they still continue to look at what the industry is doing and either adopt it or not. It's technology evolution. We can thank Apple. We can thank Samsung. We can thank Google. We can thank all the players for pushing everything forward. I don't agree that Apple is the only party deserving of thanks.

So Samsung didn't copy the iphone huh? Christ where do you people come from? You and your country are the kind that would rather not have the cure for cancer if it meant that the company who invented it made a profit.

All companies are entitled to make a profit of course, but wouldn't you prefer to see Apple focusing it's efforts on bringing out a better, revolutionary iPhone?

Or do you prefer to stick with your tiny incremental updates? Because that's all Apple will give you smartphone wise if the competition is not allowed to compete due to over zealous issuing of patents. After all giving the US citizen more wouldn't make them come back year after year to repurchase essentially the same product would it?

Makes no difference to us in Europe or indeed Asia, South America etc. Courts elsewhere haven't taken such a isolationist view so we can continue getting an excellent selection of phones. It's America's lose not ours.
 
US courts and citizens protecting US interests. Samsung was never likely to get a positive outcome in Apples home territory it would seem.

A disastrous day for consumer choice in the US. Makes me thankful that I live in a nation that doesn't have such a protectionist view. I will have a better choice and indeed the right to choose, as a result of living under a court system that doesn't pander to the $ over common sense.

Will obviously go to appeal so we can expect this to run and run.

Hilarious. Absolutely hilarious when you look at all the **** that Samsung pulls in it's own country. It's CEO committed suicide rather than face his corruption trial. They've been caught bribing the government. They continue to use banned toxic chemicals and order the arrests of any Koreans who try to protest. You want to see protectionism, go see Samsung in Korea. They OWN the government there.
