In the end, that's the best option. The easiest thing for them to do is just swap it out with another GSM phone. If you're adamant that that isn't an option and the only way you are going to walk away happy is to get a CDMA phone then they should ultimately agree. Well I have a Genius appointment tonight. I'd like for them to explain how they are going to fix the issue if I agree to replace my phone (I have apple care) and the problem persists. At that point, I won't accept another replacement and will either request a full refund or they are going to need to find a way to give me a CDMA phone.
One thing to consider, when it comes to them returning your phone, it is actually easier for them to do so if you still have the original phone and not a replacement. When I was telling them that they could just return my phone and then I'd buy a new one they said that was fine except my phone I purchased wasn't valid anymore since it had been swapped out with a replacement. Ultimately what they had to do was do a return using my original order number that wasn't, at that time, tied to a serial number and that worked. Make sure to ask them about that. Best of luck!
