ROFL!!! YEAH! Right....

Sound like you watch too many Japanese movies.

Eventually Apples system will catch it, if not than sooner or later you'll do the right thing and return it.

I'm sure there is a tracking number from the shipper that you could give apple and there shipping department could go back and track it and find out how a 2000 dollar plus mistake happened.

Merry Christmas and Happy New Year to everyone

Everything is audited and I wouldn't do the happy dance just yet. Once someone alerts them to a missing system, they'll track it down and see where it went. Just let them know and avoid the inevitable outcome. Plus it saves you from looking like a thief.

I don't know why everyone has got on their high horse about he should return, he didn't ask for it. Just keep it unopened for a month and your next credit card bill comes and your order is complete and if you hear nothing keep it.

As for Apple coming after him. It depends if it was addressed to him or not ie if it was an error on Apple's part or the carrier's. If it was the carrier's then Apple will just use their insurance they have in place with the carrier and get the credit that way. It's then in the carrier's hands to try and find it but seeing as to them it's a relatively small amount i doubt they'll bother though if it was 20 MP i'm sure it would be different.

If the error was on Apple's then i doubt they will come after you as there most of been an order placed for you somewhere along the lines (maybe by a customer service rep ticking the wrong box or something who knows) as a MP doesn't just jump in the back of the van on it's own!!!! I'm not sure how legal it is but i would say that if Apple don't contact you after a month to just keep the MP and use it and if they contact you after that time just say that you didn't hear anything so just assumed it was a present from them.

It would be interesting though if you looked up your serial on one of those apple serial sites to see if you can find out a bit more about your present.

Haven't heard of this. Got a link to one of the sites you are referring to?

During my Time-Out period (don't ask) I've been checking the local laws that governs this country... And apparently anything that arrives (unsolicited goods) can be kept by the receiver as a gift, resold or otherwise and once more, I don't have any legal obligations to return it. And it's an lawful offence for them to charge me.

The Consumer Protection (Distance Selling) Regulations 2000 (the "Regulations") came into force in the UK on 31st October 2000. Rather than cover all details of the Regulations, this Article highlights the most important requirements.

Inertia selling / unsolicited goods

A person who, having sent in the course of business unsolicited goods to a person with a view to the recipient acquiring them but who has neither agreed to acquire or return the goods, makes a demand for payment or threatens legal proceedings to get payment will be guilty of an offence. The recipient of such unsolicited goods may use, deal with or dispose as if they were an unconditional gift.

Soo.. that means Apple can come knocking but I can blatantly refuse to return it and there's nowt they can do. They can't even charge me. :D

They'll just raise the price of the Mac Pro to compensate for it. With interest of course. :p

Haha!! Guilt trip? Nah... Sorry I don't have a concious besides goods are going up anyway, especially with the devaluation of the pound :D But everything here is pretty cheap perhaps thats due to the almighty JPY! ;)

In your quote it says "with a view to the recipient acquiring them".
That is not the case with your "gift".

p12, The Sale of Goods by Michael Bridge (Oxford University Press):

"[...] a number of points have to be satisfied. First the goods have
to be sent with a view to the recipient acquiring them. This would
protect the sender if the goods were mistakenly sent to the wrong
person or the wrong address."

Is the book your quoting from about Japanese or American law as I don't think American law in applicable in Japan.....

Please refer to an earlier posting and you'll learn the package was addressed to my home but I didn't order it, nor doesn't appear on my invoice.

Good on you. Apple screwed up. Not your problem. Keep it. You didn't steal it. Apple sent it to you. True it's totally in there error, but it's their error. Not yours. I wouldn't feel guilty about it. Everyone else is just jealous.

Thats a shame you lack common courtesy. Imagine if you owned a business and misshipped something and someone like you got it and was like this.

Plus, the misshipment is not considered unsolicited goods. Unsolicited goods used to be when a company sent out something in the mail to you with a bill. If you didn't return it, the bill was valid. This is no longer happening because of laws that allow you to keep stuff that is sent like that.

In your case, you ACCEPTED a misshipped package. By accepting it (i wonder if you signed for it) you are accepting a sales contract from apple. IF they discover this and bill you, you are responsible for the bill. this is not a case that would have acceptable negligence. you can't say, well i didn't order anything, you did. in the process of your order, something else was shipped.

The funniest part to me is that you come on a forum and talk about it and how you plan on keeping it.

Urotora Akira, is that right? is that how you spell it?

I signed for it cause it came as part of my original order... I was expecting to receive one system not two.. I didn't know about it till the driver told me to wait, there's another box!

if the second box had your name on it, and you signed for it, you acknowledged that you received it. You were expecting something else, and got something you did not order.

My guess is you are probably 18-20, and really don't understand the implications of how you are doing business with other companies.

The best part is, though, you are posting it all here, and it is now all in record, so you can't turn around and say anything to the contrary. and i bet apple sales management is getting a good laugh reading it as we type. thats the cool thing about public forums. with just a link, you can email anyone and have anyone look at it. you should be proud of your boasting...

I feel for you. I do hope that someday, you make a mistake, and someone screws you over. then, you can look back and know what it is like.

Plus, you need to work on your website. the links in your blog and other links just don't work right.

oh, so did they ship it to you in england?

See, you're speaking to me like you know me; like i'm daft enough to post and use my real name online. Sorry, I don't trust the internet that much, especially public forums. Urotora Akira happens to be a nickname only.

As for my website, well, I don't use the blog on my domain any more, all my bloggings are on mixi. Have fun!

Ok, so did the second box have your name and address on it?

If it did, then yes, you should lawfully be allowed to keep it. If it didn't, you are unlawfully keeping it and you should've reported it to the shipping company and some poor customer is sitting with your cinema display instead of his/her Mac Pro.

i don't know you but i know enough of you and people like you.

well, have fun with your stolen merchandise. tell yourself it was unsolicited and enjoy it.

it will come back to haunt you, and i hope sometime in life, someone screws you over then you can come here and boast how awesome it was someone stole from you.

It's hardly stolen.

Yes, paperwork attached to it has my details on it just like the order with the exception of the order number.

actually, it is. you'll find out shortly.

cheers.

Well, I assume they'll know where they made a mistake. I'm waiting for them to knock on my door with a smile and a request to take the system from me, any day now... Besides, I don't have any uses or space for a second system. And should no one comes by the end of January, I'm gonna sell it, as it's unwanted. Perhaps gut it and use the case for my PC.

don't let these people try to guilt you into feeling bad for apple. they are a multinational corporation worth billions. its not going to break them. i promise. keep your mac pro.
