The dates are still estimated without a firm commitment. Apple provide a link with your order which takes you to the following bookmark on their store help page.

what you said is correct it is an indication. But read the Email that was sent by Apple, it clearly says:

"Your Apple Watch will be delivered between April 24th and May 8th".

That is not saying estimated that clearly states that it will be. That is an order update and supersedes the original contract document. it is sent out to you clearly showing the Order Number and applies to your apple watch.

The original could be argued as you said but the e-mail clearly states "will be" not estimated.

So it is the majority of orders that feature the Black Sports Band which are yet to see any movement! It does prove an interesting theory of a manufacturing issue but I want to keep hopes up and think that Apple might just be filling up a massive batch of these for the UK!

I have ordered a black watch modern buckle and that doesn't even show in the list at all. That's a bit worrying :(

Of course it is a contract. It is enforceable under law. You have made a bid under the terms they have suggested and they have accepted your bid. That is what the purchase confirmation is. This is clearly stated under the European consumer act which has been updated to take into account online sales.

they may try and hide behind the original rules they set but that is mainly to try and discourage somebody from taking them to court. But a lot of times what they write is not enforceable under the law.

There is not a binding contract until Apple "accepts" an order, which is deemed to be an "offer". And the terms make it very clear that it only accepts an order when it is shipped. Legally speaking, Apple is under no obligation to deliver Apple Watches to people whose orders are still "Processing". This is the same for most online shops, including Amazon.

A purchase confirmation is nothing but an acknowledgement that they received your order.

You can trust me, I'm a lawyer.

It's not up to you to decide when a contract is formed. It's up to the terms and conditions you agreed to when you placed the order. Apple clearly state order confirmation ONLY happens when stock is available and the order is shipped. It's really super 100% clear in their terms.

Apple should just give me definite date of delivery - some of us have places to be and can't sit around waiting for the watch to arrive.
 
I think that the email was sent out as they knew of a delay and wanted to reassure the early buyers that they will be getting the watch within the two weeks stated. Let's face it, no one was promised an April 24th delivery. If they sent out an email saying we'd get it by the 8th then we'll get it by the 8th, no probs.
 
UPS237 from Philadelphia & Louisville (UPS's main hub), is inbound to East Midlands Airport, around 2 hours away!

There's been 3 UPS flights since Friday when we last saw an order change to 'Preparing for dispatch', as well as a couple of DHL flights too!

This leads me to believe we're going to have a massive wave of charges and watches preparing for shipment tomorrow!

Let's face it, no one was promised an April 24th delivery. If they sent out an email saying we'd get it by the 8th then we'll get it by the 8th, no probs.

It's still disappointing that a company with such vast amounts of cash cannot produce enough watches to fulfil all preorders made in the first hour and guarantee delivery of these on launch day.

They do this all the time though. Maybe they do it on purpose to create an impression of high demand. It happens with every iPhone release. It gets sold out, can't get one for weeks etc. who knows if the demand is really that great or it is artificially created for hype purposes.

In the past, stuff to the UK has come from China to Netherlands (split into euro countries) and then onto UK. Not sure if that's still the case, but Syncreon's main EU distribution is still there! Might be worth looking for flights from NL too!

I have a feeling it is definitely artificial and they intentionally hold back stock to create the hysteria that surrounds their product launches.

It is definitely odd I agree. Maybe it was a gross miscalculation of demand on their part? Somehow I can't believe that. I doubt we'll ever actually find out the reason, and most likely won't care once we have our shiny new toys :D

I think my watch came from China. I was charged on Tuesday and it showed as dispatched on the website on Thursday. However in my packing list I recieved with my watch is shows the shipment date as Wednesday.

We certainly won't care by the time we are playing with our new gadgets, but it's the principle ;)
 
Out of interest, has anyone seen the space black stainless model in the wild? Quite fancied that but didn't want the link bracelet.

The amendment to the contract i.e. the email is actually the forming the contract and has superseded the other parts by saying it will be delivered between 24th april and 8th may. This is because it is not dependent on dispatch anymore which is dependent on availability. By fixing dates, the company is obliged to deliver in those dates no matter if they have the good or not i.e. they have to source elsewhere if required.

I work as an oil trader and this is how the law works because this is how we make purchase and sales contracts. If purchase is dependent on dispatch (load dates) then purchaser is constrained by availability. If the sale is dependent on delivery dates, no matter what the problem the seller is obliged to deliver within those dates and source elsewhere to do it. Of course, that can be waived by a further agreement between purchaser and seller which supersedes that original agreement. For consumer law it is even more stringent on the consumers side.
