This thread is like a stuck recording.

Take any bunch of pages and the arguments for, against, for and against seem to be about the same.

I wonder if Jason will look good in orange? (not that I think this is likely).

The reality is we won't know squat till it happens.

The soap continues. How long will it run for?

Although when my phone went missing and I knew where it was the police didn't go raiding, the same thing for my college laptop (paid for by them so you'd think they would want it back).

Exactly...because you are a nobody (no offense) with no clout. Apple gets what it wants because it has political power backed by tons of money. Nothing just about the process.

It's also the means he used to commit a crime.

Allegedly. And way too many people here are positive he is guilty because they love Apple so much and anyone who opposes them MUST be evil. Scary to think these are the kind of people who would be on a jury if you were ever on the burner.

So its ok for the police to overlook the law themselves when investigating crime?

I don't think we should turn this into PRSI.

And what law would that specifically be? This is already a grey area as the "journalist" was dealing with trade secrets.

If I used my car to get to work every day, then one day used it to smuggle drugs, should it not be confiscated as evidence simply because I need it to get to work?

I'm not the DA. I'll flat out state that I hate Apple. But that doesn't mean they aren't entitled to protect their intellectual property.

Moot point. From reading numerous reports it seems California has laws that protect journalists from just this sort of thing. Furthermore it seems the investigations have halted while the Police themselves look into if they have broken the law (at least proving such law exists).

So a journalist could go kill someone, take pictures of the body and report about it, and be protected by the "law?"

It's obviously not a blanket protection and considerations have to be made. Neither of us is clear on what exactly that law covers, and it's not up to either of us to make the final say anyway.

Where did common sense go? Comparing a murder to this is insane. This is about MONEY...not good vs evil.

You're taking what I say out of context.

No I am not...you are trying to argue semantics by using the dramatic example of murder. Law is not black and white regardless of some people's insistence. Why? Because humans and our actions are not. That is why there is discretion everywhere from the arrest to the sentencing. But sadly there is also unfair influence on that process because those people applying the discretion at the highest levels (prosecutors, judges) are elected and therefore have self preservation in mind first and foremost.

I was trying to illustrate the point that a journalist is not free to do whatever he pleases. There are indeed special protections for journalists, but whether this particular instance falls under them is questionable.

Throughout this case lawyers will do what they do best, interpret the law. If the police did violate the law, then they will be held accountable and any seized materials will not be admissible as evidence. You're rambling.

And if the police ARE found to have been wrong the damage done to Jason Chen will not be undone. They will not pay for his loss of wages, legal fees and right the damage to his reputation by publically declaring their mistakes. When they are wrong they say "sorry" and turn you lose. This is not "justice". And if he tried to sue them he would likely lose because of protections that the government enjoys in such events.

If he didn't want to risk it happening, then he shouldn't have bought a "lost/stolen/whatever" prototype.

So what about those people who didn't do anything to even warrant attention. Those who are wrongly arrested. I am talking about the greater flaws not this individual case.

Holly crap!

Who ever thinks this is about some iToy is missing the point!

This entire news item is about all of us and about our freedom.

This in fact is direct attack on us and should be taken personally!

A direct attack on me? Taken personally? What does this have to do with me? Like I should fear the man coming to my house and confiscating things for no reason? Last I read, they had a reason. How it plays out is how it will play out, but at least let the process take place. It is not about one phone, it is about the R&D that went into it, and I believe any company has the right to protect their intellectual property rights.

I feel no threat to my freedom by this.

This is not what is being discussed. We are discussing someone who knowingly bought "lost/stolen/whatever" prototype, held it in his possession instead of turning it into the police, dissected it and posted a news story about it earning an untold amount of money in the process.

From someone that posted "This is about MONEY...not good vs evil," you sure have made it into a discussion about it. You are indeed rambling.

And you are trying to dismiss what I say by calling it "rambling" just like people call others "trolls" or point out typos...I expected better from the "voice of reason"

I also disagree with your description of the events.

You are changing your argument every post so I can't follow what you say. Now you're falling back by saying I'm trolling you so you automatically win the argument. That's not how it works.

What is a crime?

People are forgetting that Apple never reported the phone stolen. Thus, no crime has/had been committed.

For your information, US is already a police state and it´s only going to get worse. This is what happens to ignorant slobs. So get use to being slaves!

p.s. 911 was an inside job!

My position on this is clear :)

This news are just the latest thing in series of Apple draconian moves in last couple of years or so - and this news, at least in my case, were final bullcrap from them to make me decide to boycott ALL their products in the future.

Until this news I was boycotting only iDevices and from now on I am including Macs to it too.

Enough is enough!

If we are not careful with things like this, if we don't show them that we respect our collective freedom more than their crap iToy prototype that THEY LOST - than we will actively and directly support draconian agenda they are setting up.

I am not prepared to do this hence the BOYCOTT!

And sorry about my imaginative / metaphorical style of writing :)

What a tard, good luck with your boycott.

I never said you were a troll or trolling. I said your "rambling" comment was just a tactic like those who call people trolls....designed to dismiss or belittle what has been said. I do not think you are a troll at all.

God, I'm happy, that I'm not living in the USA.

Do you remember Apple's 1984 commercial? The fight against the Big Brother? Apple is it.

The US is already a police state. Even so more ... There will be blood.

You have to understand how search warrants work.
I know how search warrants work. I'm not an idiot.
When a search warrant is served, the police knock on the door and announce themselves once. If no response is heard, the police enter the premises to secure said evidence. This is how it works, search warrants in general are upheld by all levels of our court system.
I wasn't questioning their right to do that, I was questioning its necessity. They serve the warrant at a time when the resident is very likely to be gone (being a working man), and big surprise, he isn't there. Why not serve the warrant in the early morning before he's left for work? Why not call him to open up the house, he's a public figure and surely quite easy to find? They have control of the premises, executing a warrant isn't a time-sensitive task under those conditions. Indeed, if they really believed time was of the essence, why give him the morning to destroy evidence? No, the only reason you show up when you know the owner isn't there and then proceed to bash down his door is because you're making a statement.

Can you be any more of a drama queen with this. Really? Good lord...
