It won't matter, once they get the cease and decists, Apple will have sold 8 million. Too little too late. ;)

They'll still have to pay Samsung and HTC money if they lose the case to them. That would diminish the profits of their 8 million iPhones. Samsung and HTC are also the biggest Android players along with Motorola.
 
The iPhone 5 shows significant design similarities to the iPhone 4S, Apple has an excellent case to sue itself.

An injunction will be hard. Because Samsung would have to put up a bail on lost revenue or profits from Apple. And AAPL makes like $30-40 Billion a quarter from the iPhone. Even if they only had to cover a conservative fraction it would break their bank. And if they lost they would have to pay that to APPL and could greatly damage their company and sink the stock.

Fun Fact: Apple would need about 2.5 Trillion Dollars to purchase them.

Samsung is far bigger and doing far better than Apple.

Now as far as the lawsuit goes, Samsung is appealing and the fine has already been reduced. Further the injunction on one of their devices is being lifted due to the ruling finding that it did not infringe.

To Samsung and HTC bringing a case against Apple. This one is going to be hard if not impossible for Apple to defend. Like it or not HTC and Samsung patented many, if not a majority, of all LTE designs, etc... Apple if they wanted to compete had to infringe upon their patents or license them. I guess you can imagine what they decided to do. Funny enough Samsung and HTC warned them prior. Now, this isn't some "design" ******** patent. This is a tech patent that actually is part of the working device. There is no ambiguity, if you copied their tech you copied it. There is no wiggle room, as Samsung still has in the "Well apple patented icons and the rectangle."

Apple should be incredibly worried about this and so should their stockholders. A strong case from HTC and Samsung, also don't think that Google isn't licking their chops with all those Motorola patents waiting to be unleashed.

To those saying Samsung is being a baby, wuss, they are bad for doing this, etc... You were the same people that were cheering Apple on as they are suing people over icons... Then Samsung and HTC come at them with a genuine lawsuit based on patented tech, not form or icons, but how the device actually operates and communicates and you all cry foul. Grow up and stop being blinded by your love for a company.

Samsung originally filed this complaint against Apple last August, accusing Apple of infringing on five of its patents with its mobile devices. The case was then carved down to four patents, after Samsung removed a 2005 patent for MP3 music track technology. The remaining four, which the ITC says Apple did not infringe, include:

7,706,348 -- A patent for CDMA wireless technology
7,486,644 -- A patent covering packet transmission on wireless devices
6,771,980 -- A patent covering dialing on smartphones
7,450,114 -- A patent for digital documents

Which means that essentially the ONLY patent left in question for the iPhone 5 are the once concerning LTE. However, since Apple bought the LTE chips, the rights transfered from the manufacturer to Apple. Assuming Qualcomm had the rights, if they didn't the liability is transfered from Apple to Qualcomm.

This is just a silly lawsuit - probably because Samsung is butt hurt and wants to make some clout in the media making Apple not seem like it is an angel.

I also find it funny how this is coming up on the heels of the hearings for Samsung's Galaxy Tab injunction.

You have the liability all wrong.
Qualcomm can be licensed to simply build the chips with the capabilities, but not actually be authorized to enable them. Meaning no license is transferred.
It would be up to the end user (Apple) to acquire a license to actually enable and make use of those features.
Chip makers, Qualcomm included, do it all the time.
It reduces production costs by making multifunction chips.

Different case. The one you're referencing is the August 2011 request to the ITC, right?

In this thread, the lawsuit that Samsung is adding the iPhone 5 to, is a California District Court case from February 2012. See Foss' patent list here. Judge Koh will also be on this case, btw.

We need a score card. Too many trials.

How about Apple and Samsung donate all of the money they're wasting on lawyers and lawsuits to charity. They're both pathetic.

Let's give this money for education in Africa - this will be more meaningful than spend money and all energy on such stupid things!
