Anyone interested in suing Rogers over this. I'm still pissed about my 3GS purchase a year ago.

I called the store to make sure they had them in stock, raced to the store, stood in line and once was my turn I asked for my phone.

The girl said we're only selling iphones to new Customers, no out right sales, no upgrades, new contracts only.

Fast forward to today. I called the Rogers store, same deal no outright sales and no upgrades on Friday. Unreal.

Is that legal? At the very least it's false advertising, it should read "iPhone4 available July 30th to new Customers only" because that's exactly what they're doing.

Yes! IT SHOULD BE ILLEGAL. Like what the hell? That's not customer loyalty. If they do that to me, or anyone else. We should just threaten them to leave the contract, for another carrier where we can get the new iPhone 4 AND get it at a discounted rate. Completely ridiculous!

Was this a rogers plus store where you experienced denial ? Please say no....
If it's not legal as consumers we should stand up, take action and hire a lawyer and see what options there are?

That is absolutely ridiculous, so basically if you're a Rogers customer, as I have been for 9 (unfortunate) years I won't be able to go into a Roger store with my crappy 3 year old phone and get a data plan and walk out with an iPhone 4

Go into a proper Rogers Plus store. They better not deny you, or else you can definitely raise hell. If you walked into my store wanting to do what you said, we would be like, "great, let's set it all up and get it up and running." Commissions from upgrading to a data device are pretty good, so they definitely shouldn't deny you.

No, if you read properly... we're talking about carriers denying us purchase for PHONE only. Because the employees make commission on new contracts + upgrading contracts only.

Yeah I was thinking of going to the Fido store Friday morning and use my Fido dollars to buy a contract free iPhone... guess I'll be going to the Apple Store instead

So my thought was right. Whether you upgrade or sign up for a 3 year contract, the employee makes a commission, so they shouldnt deny me. Its only for people wanting to buy the phone upright and not extend, right?

Thanks
AE

I was about to do the same, but if you think about it. The Apple store will be more populated than the carrier retail stores. I don't think their so called 'policy' should stop you. Throw a fit if they deny you purchase. You have Fido dollars for a reason. Because, THEIR OWN COMPANY!!!!! rewarded YOU credit to show loyalty. It's not fair if they deny you. Don't let them drive you away.

Correct. According to what people have experienced here, and from what my local Fido store told me. Hopefully I have nothing to worry about, because there is no way i'm upgrading my contract. Fido sucks. They stack your contract !

Exactly. But either way a store shouldn't deny you either way, but you're right, the store doesn't make any money from an outright sale.

Just go to another store, hopefully there are more in your area. The more that store screws people over the faster it will close down from lost business.

And do tell us where this store is =)

I am a Rogers employee...I said that a few posts ago.

Sorry man, I replied to too many people i forgot whos who. I knew someone I just spoke to is a rogers employee. It turns out its you :) well I'm glad we got that cleared out. So to summarize things

1) If you are a new customer or upgrading going on a contract - - - they shouldn't deny you because they get commission.

2) If you want to buy the phone upright (regardless if you are a new customer or upgrading) - - - they might deny you because they dont get commission. Note, the phone will be locked to ROGERS regardless

Please correct me if I'm wrong. I'm just putting it out there for those confused, based on what I know

Thanks
AE

before you claim 'read properly', maybe you'd like to read the the post i'm quoting where he was told "no upgrades" (which can be all encompassing) ... just saying

Yeah Bell did the same thing when they released the Original BlackBerry Storm. I was super pissed. I went in anyways and asked for the upgrade and they did it without issues. On the phone they wouldn't even tell me if they had any in stock.

I wish u guys don't have to go through BS to get a phone. I hate the Big 3! They are the worst big businesses in Canada!! We should all complain to our MPs and get them to do something for US for a change instead of taking backhanders from the Big 3 and enjoying life!!

BTW are you working on friday? Are store employees allowed to grab an iPhone on friday?

Thanks
AE

Lol yes I am working Friday, and no we are not allowed to buy them unless they are outright, so I am having my girlfriend go to the Apple store to buy mine outright in the morning with her friend. I have my 3GS sold for $450, so the difference is just about the same as an on-contract 32GB.

Very smart move. I couldnt sell my 3G for much because I destroyed the crap out of it. it had a huge dent on the top right where the power button is. So noone would even consider buying it for their own use. I sold it on ebay for $150 to a guy who takes them and fixes them then sells them for double or so. So yea I would have went with your option if I sold it for 350 or 400. Tough luck for me and good luck getting your iphone man. I genuinely mean that :)

Thanks

Rogers Store in Conestoga Mall. Can the franchise legally set rules like that.

Might be better off going to a Rogers Video, they had 32gb 3GS on launch date last year.

Franchise locations can set whatever rules they want really. It's all up to the manager/owner of that store if they want to reserve sales to commission earning ones.

Yeah thanks. My girlfriend and our friend are going at like midnight to Square One. Our friend is getting one too so it kinda works out, and they are going super early to really make sure they snag one. I'll hopefully have mine by mid-day.

Cool stuff. Its a win win for everybody. I'm guessing your GF is not into the whole iPhone thing? Is the a CRACKberry fan? or just not into the latest gadgets, meaning she doesnt mind the wait? If she doesn't mind the wait then my Gf is very similar lol.

Yea it is stupid that the policies aren't the same across all stores. I'm trying to get an upgrade for another line in which I am an Authorized User Level 1 and am having a hard time finding stores which can do it, so far just a few huge ones in downtown Toronto can do it but not elsewhere in the city :(

Oh well at least I know I'll get one for myself!

The one guy is right. There will be a upgrade price for 3GS users who bought around launch date. An. I'm assuming it's gonna be either $200 ( if your bill is over 100) or $450 ( if your bill is under $100). Both prices are for 16gb model

Do I have to extend my contract to 5 years then, does it restart my 3 year or does it just play out my 2 year?

Oh she is an iPhone freak, but she wants to wait for the white. I was going to wait but I decided to go with black this year. Probably alternate colors every upgrade lol.
